A complete application form provided by the Staff Attached 2. All applicable fees as set forth in the adopted Schedule of Fees. Attached 3. As applicable, a list of the specific Code provisions (with citations) that are proposed to be amended, the proposed wording change to the provision and a written explanation of why the change is requested. Proposed amendment Allow "schools," as currently defined in the EV Code (including boarding schools) as a use -by -special -review in the RE-1 zone. Why the change is requested The Eagle Rock School was originally developed in 1993 under a previously existing Estate zone that permitted schools as a use by special review. In 2000, many portions of the EV were rezoned and ERS was given an RE-1 zone, which did not specifically allow schools. This essentially made the ERS campus a "non -conforming" use. This precludes any improvements to the school facilities as well as potential expansion. The requested code amendment will: a) make the Eagle Rock School a "conforming use" again, allowing lawful improvements to, and replacements of, existing buildings; and it will b) allow Eagle Rock School to expand its campus facilities consistent with its evolving needs as a unique and innovative educational institution for at -risk students. \, (i \\ 1\0, ' This amendment will also apply to other similarly zoned properties in the EV. However, being regulated by the "use by special review" provision, only properties specifically approved will be able to take advantage of it. For properties specifically approved, this amendment will provide a suitable zone in which to create schools. Granting "schools" as use by special review specifically within the RE-1 zone also assures the community that there will be a reasonably low underlying density, should a school be approved and another use be desired in the future. 4. As applicable, an illustration comparing the existing zoning classifications of the subject property and all adjacent properties to their proposed zoning classifications if the rezoning request is granted. Not applicable. Zoning classification will stay the same, including adjacent properties. 5. If the rezoning request is intended to allow for a specific use, project, or development, all requirements for a "development plan" as set forth in Section III.0 above, unless waived or modified by the Staff. The zoning amendment in intended to not only make existing uses "conforming", but also to allow for future expansion of ERS facilities to meet the needs of students, faculty and staff. A conceptual development plan is attached. 6. A written statement of how the proposed amendment meets the standards for review of rezoning requests, as set forth in §3,3 of this Code. 1. Physically, the impact of Eagle Rock School is minimal on the planning area. It is not visible from Dry Gulch, and the only indication of the school's existence is the drive that accesses the property. p55 3. Revise the Regulatory System to encourage low density, low impact development in the North End. o Maintain the low density character of the North End. p. 55 Eagle Rock School, the Storer Ranch, and the MacGregor Ranch Trust properties represent significant individual parcels within the planning area. Eagle Rock and The Reserve (portion of Storer ranch) have set aside significant open space. Cluster development patterns should be utilized to enhance open space opportunities. (Cluster development groups building sites on a parcel and preserves or leaves open the remaining land. The Concept allows for savings in development and service costs and for preservation of open Space.) The proposed development plan would continue to maintain a low overall density (<30 units on 640 acres) and would continue the existing clustering development patterns. 3. The Town, County or other relevant service providers shall have the ability to provide adequate services and facilities that might be required if the application were approved. Relevant service providers are already serving the ERS facility. 7. Any other information deemed necessary by the Staff to make a fully informed and deliberate decision on the application. PUBLIC HEARING NOTICE A public hearing will be held to take public comments on an amendment to the Estes Valley Development Code (EVDC) as follows: Estes Valley Planning Commission Tuesday, February 20, 2018 1:30 p.m. Board Room, Estes Park Town Hall 170 MacGregor Avenue Estes Park, Colorado An amendment is proposed to the EVDC to add "Schools" as a use allowed in all zoning districts. Currently Schools are limited to two residential and two nonresidential zoning districts. Table 4-1, Permitted Uses: Residential Zoning Districts, and Table 4.4 Permitted Uses: Nonresidential Zoning Districts would each be amended, where Schools would be a permitted use in all of the Residential and Nonresidential Zoning Districts. The EVDC currently requires review and approval of a "Location and Extent Review" for Schools. This would be eliminated, and instead, any proposed Public School would involve meeting Col- orado Statutory requirements, and any proposed Private School would require approval of a Special Review. The Definition of Schools" would be amended, in Chapter 13. Definitions, of the EVDC. This would mainly differentiate and clarify the definition and use classification for "Public" and "Pri- vate" School. Additional changes to the Estes Valley Development Code may be introduced, discussed and recommended for approval gener- ally relating to the above amendment.
