LOCATION: The site is located at 1820 Acacia Drive within the Town of Estes
Park. Legal: Lot 1, Davis Subdivision

DESCRIPTION/BACKGROUND:
This is a corrective rezoning request. Lot 1 of the Davis Subdivision was zoned “I-
1” Restricted Industrial prior to 2000. In public hearings for the 2000 valley-wide
rezoning, the property owners requested that their property remain zoned “I-1;”
however, the property was rezoned to “CH” Heavy Commercial. When the property
owners approached staff about developing their property, they became aware of the
rezoning to “CH” Heavy Commercial. The proposed storage unit development is
allowed in both zoning districts. However the side- and rear-yard setbacks are
greater in the “I-1” zoning district; instead of zero-lot-line setbacks, ten-foot
setbacks are required. If the property is redeveloped in the future, the “I-1” zoning
would allow for a wider variety of industrial uses.

III. REVIEW CRITERIA - CODE AMENDMENTS (REZONINGS)
Since this is a corrective rezoning the review standards for code amendments
(rezoning) do not apply.
This application does not fall within the parameters of staff-level review, and will
be reviewed by the Estes Valley Planning Commission and Estes Park Town
Board.
IV. REFERRAL COMMENTS
This application was routed to affected agencies and neighbors, along with a
development plan application to build storage units on the property. The
development plan application falls under staff-level review. All submitted affected
agency comments are related to the development plan. Staff has not received
comments from adjacent property owners about the rezoning or development plan
applications.
V. STAFF FINDINGS

The Project Description/Background found in Section I, and Referral
Comments found in Section IV of this staff report are included as staff findings.
VI. STAFF RECOMMENDATION - REZONING
Based on the foregoing, Staff recommends APPROVAL of the rezoning.
VII. SUGGESTED MOTIONS
APPROVAL
I move to recommend approval of the rezoning to the Town Board of Trustees with
staffs’ findings and conditions.
CONTINUANCE
I move to CONTINUE the rezoning to the next regularly scheduled Planning
Commission meeting because… (state reason for continuance - findings). Note: In
most cases, the applicant must agree to this, otherwise a continuance is deemed
approval.
DENIAL
I move to recommend DENIAL of the rezoning to the Town Board of Trustees
because… (state reason for denial - findings).
