We are going to take advantage of the RIVERSIDE PLAZA by
building a BEER GARDEN on our property adjacent to the PLAZA.
It will be fenced according to the Liquor Laws. Fence will
be three feet high, sturdy and nice looking.
Some small tables and chairs will be placed in the area.
Fence will be removed and stored in the winter.

Pedestrian access from Nagl Walkway,
Riverside Plaza and pedestrian bridge
across Fall River
Section 17.16.050, C., provides that, in the C-D District,
outdoor eating/seating areas may be permitted through
special review. Applicant is proposing to install a new
doorway and small outdoor seating area at the southeast
corner of the Wheel Bar building. The seating area would be
defined with use of brass railing materials. The maximum
extension to the east from the side of the building, would
be ten feet. Applicant's statement of intent indicates the
fence will be removed in the winter. Town and EPURA staff
have met with the applicant to define the fence placement in
the southern portion of the seating area.

It should be noted that in the C-D District, a minimum ten
foot setback from Fall River is required. Applicant is
considering extension of this seating area into this ten
foot setback. Consideration of use of this area would be
subject to review and approval by the Board of Adjustment.
Both the Planning Commission and Town Board conduct a public
hearing on this request.
III. PROJECT REVIEW
This request has been evaluated pursuant to 17.36.030,
Special Review Procedures. Staff findings are as follows:
o The location is suitable for this use.
o At the southern end of the seating area, location of
the bridge and improvements need to be considered to
allow for proper pedestrian circulation. A minimum
clear width of seven feet should be maintained between
the fence and any obstruction in this area.
o Use of this area will be subject to the C-D District
sound transmission standards. Applicant should provide
assurance that noise levels will be monitored and
enforced so as not to interfere with adjacent
properties. Although no lighting has been indicated,
light sources also need to be contained in the
premises.
o Utilities and services are adequate for the proposed
use.
o Applicant has stated that the fence would be
constructed with brass railing and materials. This
type of construction is compatible with the Riverside
Plaza improvements. A detail of fence material/
appearance should be provided.
o The proposed use is consistent with the objectives of
the C-D District.

V. STAFF RECOMMENDATION

seating/eating area, with the following conditions:
1. The fence be constructed with brass materials and a
detail of fence appearance be provided.
2. A minimum width of 7' be maintained between the fence
and any obstruction.
3. Fence anchoring method be approved by EPURA and town's
Public Works Department.
4. Access to tree grates and irrigation system be
maintained.
5. The town will prune the trees in the seating area to a
height of approximately 5 feet. Nothing should be
attached to the trees.
5. Sound and light transmission standards be adhered to.
It should be noted that extension of the outdoor seating area
into the 10' setback from Fall River would be subject to
additional review and approval by the Board of Adjustment.
The Planning Commission could indicate concurrence with that
extension subject to that review.

Dear Steve:
As we discussed on Wednesday, April 26, I have the following
comments regarding the proposed outdoor seating area:
1. I have a concern regarding the placement of the proposed
fence in the area of the pedestrian bridge. Preferably, a
minimum width of eight feet should be maintained between the
fence and any obstruction.
2. The area in front of the existing entry area should be
examined for the outdoor seating area. The doorways could
be modified to fit this use.
3. Access to the tree grates and irrigation system needs to be
maintained.
4. The Town will prune the trees in the seating area to a
height of approximately five feet. Nothing should be
attached to the trees.
5. A detail of the fence anchoring method should be provided.
Also, information should be submitted on proposed fence
material and appearance.
Perhaps we should meet the week of May 8 to review any additional
comments that have been received.

EPURA staff met with Mr. Nagl on Tuesday, May 9, 1989 at the
location of the proposed beer garden. Based on discussions and
modification of the area's layout (Mr. Nagl is to document) and
mutually agreed to that morning, including a verbal commitment from
Mr. Nagl to surround the area with a brass railing, the EPURA staff
has no objection to the proposed use of this property.

Notice is hereby given that on May 16, 1989, at 1:30 p.m. in
the Board Room of the Municipal Building, 170 MacGregor Avenue,
Estes Park, Colorado, the Planning Commission will hold a public
hearing for the purpose of considering a site specific concept
plan for the property and purpose described below, approval of
which may create a vested property right pursuant to Colorado
law. Also be advised that on May 23, 1989 at 7:30 p.m. in the
Board Room of the Municipal Building, 170 MacGregor Avenue, Estes
Park, Colorado, the Board of Trustees will hold a public hearing
on said concept plan, which may also create a vested property
right.
