Variance Review and for a Planning Commission Special Review (Request
No. 40). We also submit supplemental information addressing what we
felt would be relevant issues.

HYDROTUBE BACKGROUND
The manufacturer of the HYDROTUBE water slide, Design Works, has
more than twenty-five years of experience in fiberglass products. Key
personnel in Design Works have designed and manufactured state-of-the-art
products in fiberglass, with technical credits ranging from the design and
development of the first Corvette fiberglass body, the design and
development of ski gondolas, to custom fiberglass work on Air Force One.
Design Works, Inc. has also had extensive experience in the waterslide
industry. They have built slides for over 25 locations (see Exhibit 1), from
a ski resort in Colorado to a mall site in Portland, Oregon.
Design Works, Inc. has designed its water slides to be clean, safe, and
fun to ensure patron satisfaction as well as to compliment other recreation
and vacation oriented businesses in the areas where the slides are
installed.
OWNERSHIP/MANAGEMENT
The proposed HYDROTUBE for Estes Park will be owned by Ray E.
Sessions, Kim R. Sessions, and their families. Kim is currently employed by
HYDROTUBE, U.S.A. and plans to live in Estes Park and manage the
HYDROTUBE on a full-time basis. He is familiar with the operation and
management of HYDROTUBE slides.
HYDROTUBE SPECIFICATIONS
The cross section of the flume is tubular for maximum safety as well
as to provide a unique ride experience. The tube is four and a half feet in
diameter on the inside. The entire tube is translucent and provides ample
light for riders and for those in the watersled to be viewed from outside.
The seams connecting the sections of the tube are smooth, due to close
dimensional tolerances achieved by the manufacturer. All flume
components are constructed of hand -laminated fiberglass for maximum
strength. The inside has an exremely smooth gelcoat finish so no pads of
any kind are required - just the rider in his or her swimsuit (see Exhibit 2).
A sealer on the exterior of the tube gives it a weather proof finish. The
approximate flume thickness is one quarter inch. All seams are sealed
with a special gasket material and held together with locking stainless steel
fasteners.
The typical length of a single HYDROTUBE waterslide is generally
between 200 to 300 feet plus an entry pool. The slide and structural
supports are engineered and built to industrial and architectural uniform
building codes. The entire waterslide takes up relatively little space (about
one half acre) and since every installation is unique, each slide is
engineered to local site conditions. The slide can be designed around trees
and other obstacles to fit the site. Other specifications are listed in
Exhibit 3. Consultants from Design Works are on site for the entire
installation of the slide to ensure the slide is properly installed and owner
and local government specifications are met.

BUILDING MODIFICATIONS
All necessary remodeling of the existing building will be done in
complete compliance with uniform building codes.
The slide is to be installed so it does not extend above, nor in front of
the building. In this way, the view from the highway approaching the Park
will not be affected. Large trees on the lower part of the property will
partially screen the slide from the road and adjoining property owners.
SECONDARY SITE ACTIVITIES
A snack bar is planned for the main floor of the building. Concession
sales will be modeled after the concessions in theaters with soft drinks and
candy being planned for now. Other possibilities for concession sales are
popcorn and hot pretzels - but still within theater concession parameters.
The installation of video game machines is planned for part of the
second floor. Neither of these activities is a primary activity, both are
supplements to the waterslide.
SUPERVISION AND STAFF
A supervisor is always present at the top of the tube to regulate the
riders' entrance into the slide. Another supervisor is always "on duty" at
the bottom of the slide to control activities in the splash pool. In this way,
slide traffic is regulated from the top and potential problems are avoided in
the splash pool.

In addition to the slide supervisors, as a general rule one person would
work in the concession/ticket stand and one person would be free to help
wherever needed. The manager or assistant manager would always be on
site to provide constant supervision of all operations. Thus, four staff
members and the manager would be on the site at any given time.
TICKETS
Tickets cost $3.50. Each ticket is a plastic bracelet worn around the
wrist and is good for ten rides on the waterslide.
DRESSING ROOMS/LOCKERS
Exhibit 4 shows pictures of the dressing rooms of a summer slide site.
Dressing rooms are equipped with lockers, benches, mirrors, showers,
toilets, hair dryers, sinks and changing closets. Generally 45 lockers are
placed in each dressing room. This is consistent with a maximum of 45
ticket riders' going down the slide per hour and enough lockers for
convenient turnover of people finishing and peope waiting to begin their ten
rides on the slide.
HIGHWAY TRAFFIC
Existing curb cuts will be used. It is estimated that the change in
usage from the Gypsy Baron restaurant to the HYDROTUBE slide will not
change the occupancy load.
TRAFFIC THROUGH THE SLIDE
At maximum usage, the capacity of a single tube can be up to 450
rides (45 ticket holders) per hour. The supervisor at the top of the slide
regulates riders on the slide at an interval of roughly eight seconds. An
average ride down the slide is thirty seconds. Thus, one person is entering
the splash pool, one person is in the tube, and one person is preparing to
enter the tube during maximum usage. However, data from other summer
slides indicates maximum usage is seldom achieved for more than a few
minutes at a time and average usage is between 200-300 rides (20-30 riders)
per hour.
The water flow from the tube into the splash pool is designed to wash
riders well into the middle of the pool and to thereby completely avoid the
potential collisions of other slide -pool designs. This design, with the time
interval regulated at the top of the slide between slide riders ensures no
problems occur in the tube and pool traffic flow.
TRAFFIC THROUGH THE BUILDING
Because a ticket allows the user ten rides, a rider can expect to
actually be in the slide for approximately five minutes. For sites with a
concession stand and several video games, experience at other slides has
indicated riders are on the slide site for less than 45 minutes. Thus, total
turnover of slide riders occurs at least every hour.

PARKING
While maximum usage is unusual, parking estimates are made
assuming full usage. Assuming the slide is at the maximum 45 riders per
hour usage and that all the remaining 45 lockers are in use by riders just
finishing and riders waiting to start their rides, 90 riders would be on site.
The slide has 38 available parking spaces. If the slide staff uses four
parking spaces, the remaining slide user to parking space ratio is 90/34 or
2.6.
Assuming the 100% usage described above, and staff parking needs of
three spaces, if every four riders are accompanied by one non -rider, the
site user to parking space ratio becomes 113/34 or 3.3.
With the same assumptions as above, a non -rider with every three
riders gives a ratio of 3.5.
In addition to the parking spaces on site, adjoining property is
availabe for any unexpected, if unlikely, parking overflow needs.
NOISE
The entrance to the slide will be on the inside of the building. The
entire slide is tubular and enclosed. The splash pool will be partially
covered. Thus, noise should be very minimal as all activity will be
localized in the building and inside the slide.

INSURANCE
A five million dollar liability policy will be put into effect. Signs are
placed to warn individuals who are pregnant or have had heart problems not
to ride the slide. Customers who are too young or too small must wear a
life vest (provided at the site) and must be accompanied by an adult.
OPERATING HOURS/OPERATING SEASON
Operating hours for the Estes Park HYDROTUBE would be consistent
with the hours of other Estes Park amusements and neighborhood
businesses.
The Estes Park HYDROTUBE would be a summer slide. Full-time
operation of the slide would coincide roughly with the period between
Memorial and Labor Day holidays.
BENEFITS TO ESTES PARK
The HYDROTUBE offers a state-of-the-art waterslide free from the
problems of open -flume slides. The water slide is a clean, quality fun
center, providing good, safe, wholesome family activities. The slide will
give visitors reason to stay longer and come back sooner to Estes Park.
In addition, the water slide should produce appreciable sales tax
revenue for the city.

B. Steel Components and Structures
1. All steel supports for the HYDROTUBE are fastened to the
flume flanges for maximum strength.
2. All steel is sandblasted and primed or hot dipped galvanized.
3. The ongrade leg structure consists of a bi-pod using adjustable
pipes for the legs.
C. Pool and Pumping Components
1. Recommended splash down pool size is 12 feet x 27 feet and
4 feet deep under the tube to a 2i foot exit depth.
2. The large circulation system - 40 hp. turbine pumps are used
with an intake sump. There is one pump for each flume, and
the plumbing from the pump to the top of the slide would be
in 12 inch PVC to reduce the velocity of the water.
3. Required turn -over in the pool for Health Department regulations
would generally be one hour.
4. Water heaters for the pool would range from 500,000 BTUs
to 1,200 BTUs, and the chlorinating system would be such
to meet local Health Department standards. 9
D. General Building Specifications
1. Drainage - all stairs and landings should drain down to the
ground through a designed in drainage line. All decks and
flat surfaces should drain also into a drainage system.

Dear Ann:
I have reviewed the site plan and supplemental information
furnished for the above referenced special review request
and have the following comments:
1. The proposed parking appears adequate; however,
the Code requires C-1 property parking to be
paved (17.32.020 2c). I would suggest that if
the parking is not paved, utilization of the
spaces shown will not occur. If the parking
is required to be paved, a drainage study
should be submitted and detention should be
provided to detain the difference between
historic and developed runoff from the site.

Dear Kim:

Here are our answers to your questions about the roof to your splash
pool enclosure and about the possible colors for your tube in Estes Park.
The roof to your splash pool enclosure can be constructed out of a
variety of different materials. However, you rust provide for adequate
ventilation through the roof to allow you to cope with the steam from the
heated water in the pool. Without adequate ventilation in the roof, condensation
can be a real problem, especially in the enclosed walkway and even inside
the building. We have had greatest success with sliding panels in the
roof over the splash pool.
We have two colors for the tubes - a blue and a blue-green. While
it is true that we have discussed other potential colors, you rust understand
that these two colors are the only ones we have experience with. These
colors aren't just combinations we mix together. Ultraviolet light causes
fiberglass to yellow, which, in turn, can cause the color of a fiberglass
structure like a tube to age differently in different spots. This can
cause a tube to have a blotched appearance after only a year in same cases.
The two colors we use are designed to provide the following:
1. Prevent ultraviolet "yellowing."
2. Be aesthetically pleasing to the eye.
3. Have a light value to allow translucence.
While we don't have experience yet in other colors, we could try a
very light value "earth tone." However, the cost would be significantly
more to you and we would be unable to supply a warranty covering the color.

Dear Connie:
At your request I am setting forth my professional appraisal analysis of the develop-
ment of the above property in the proposed use as a Hydro -Tube Amusement Center.
A number of things have happened in the past few years which indicate that the south
side of Moraine from Fun City to the Beaver Point Junction may well develop into a
better defined commercial development. These happenings as I see them are as follows.
1 - The recent annexation of this area by the Town of Estes Park and that area
south of Moraine to Fall River being designated C-1. I am enclosing a copy of these
regulations for your information.
2 - The commercial development at Beaver Point that was done by John Webermeier
has had a very positive effect on development in this area. It has caused other com-
mercial establishments to improve the exterior of their establishments to raise the
visual impact in the area.
3 - The announcement by Larimer County Officials that the life of the Larimer
County Land Fill is not expected to be over a year. The removal of this from this area
will have a positive effect on future development.
The proposed use of this property into an amusement complex seems to me to fill a need
in the community and appears to be compatable with the tourist oriented nature of the
establishments in this area.
Those of us who are older cannot understand why people coming to such a place of beauty
cannot be content to hike in the Park or set on the porch enjoying the peace and
quiet.
I am afraid we have not kept up with the hyper nature of the youth of this generation
who "must have something going all the time". I feel for those parents who come
here wanting to relax with children who have to be on the go. We must recognize this
changing nature of this generation who must be entertained all the time.
My conclusion is that there is a void in the market for this type of activity and that

owners at the Miners Kettle. tie think the slide would be of a great
benefit to the town of Estes Park for the following reasons.
tide have managed theatres for some 20 years, both indoor and outdoor.
We were also half owners of the Denver School of Gymnastics for girls
in Denver. With this background we feel we know at first hand the
difference in good clean fun and just fun. The children of Estes
Park need a place in their own town where they can have this type of
entertainment. We would far rather our own children be on that slide
getting physical exercise than standing in front of a video game,
going to a movie, or standing on a street corner. We feel as a touris
attraction its.great. Lets face it we are in a physical fitness craze
in th?s country. If thats what the people want, then let Estes Park
be the one to give it to them.
We favor the location, quite frankly because its next door to the
Miners Kettle. We feel it will be a great asset to our business and
to others around us. We are all there to make a liking and anything
that attracts traffic the way this slide will can't do anything but
benefit us all.
We hope you will look favorably on both the Slide and the location,
Estes Park needs it, we need it, our children need it and I'm sure
the tourists will want it.

I think that it is timely with the attitudinal change in Estes Park at
this time, that a progressive idea such as yours be attempted. I think that
it is important for your plan to incorporate the following:
1) A COMPLETELY enclosed pool at the end of the slide to eliminate
a majority of the noise coming out of the tube.
2) ADequate traffic control ingress/egress during the peak season.
We have seen danger at the entrance to Trout Haven, due to the
view of traffic being blocked by parking at the road's edge of
The Miner's Kettle, to obscure oncoming cars from each direction.
3) That the site plan demonstrate adequq.te screening for the Timberlane
Motel, with plantings being shown to be of sufficient height now,
not in future years alone, by growth.

Since I will be in Texas running the Estes Park Accom-
modations Asso, booth for the Dallas travel show on Tues.,
March 22, I would like to send my opinion by letter.
I am opposed to the construction of a water slide at
the Gypsy Baron. There are already two amusement parks or
activities areas in town ( three counting Stanley Park) and
I do not wish to see Highway 36 west turned into one lso.
It will detract from the beauty of the area and literally
cost the lodging establishments money because tourists will
continue driving to find more remote & quieter facilities;
away from the carnival atmosphere which will be created.
I moved to Estes because it appeared to be a beautiful
& reasonably peaceful mountain village. I believe the majority
of our tourists come here for the same reasons. These tourists,
which provide my livlihood, have the right to peace & quiet.
Activities are necessary also. But the two should be kept
seperate as much as possible.
Highway 36 west has long been predominantly a lodging
& restaurant area. It would be unfair to those of us who
bought property with this in mind to now have to watch
this area turn into an amusement park.

RE: Hydro Slide
I would like to go on record in favor of the Hydro Slide for the following reasons
#I ---Would Provide entertaining healthfull recreation for our local children.
#2---Would be an attraction to bring and keep tourists in Estes Park for the benefit
of everyone in town because of the additional tax revenue it would raise directly
as a Hydro Slide and as a money raising tax revenue from the people who stayed
longer in town and spent their money because the Hydro Slide is here.
#3---I believe the proposed location for the Hydro Slide is ideal as it is located
near Rocky Mountain park and will be an attraction to bring some of the campers
out of the park to spend money in Estes Park. Contrary to what many people
believe about poor people camp. the camping industry has done exaustive
study and has found the average camping family has an income nearly 50 above
the national average of about $30,000. I can tell you from experience as the
former owner of the Blue Arrow Campground that these people have money to spend
and are looking for places to spend it. Many many campers left town much earlier
than they expected togas there was not enough family entertainment in town to
keep their children busy. The Hydro Slide, The Fish Pond, and the miniture
golf course will attract many families to stay and spend money in Estes Park
by being in close proximity. The motel owners who are close by will find that
they will have a huge demand from people wanting to stay there so their children
will be able to walk to the entertainment. They will find it will lengthen
their peak season being close by, and they will find they can command the highest
room rates in town because entertainment within walking distance is the biggest
draw they can have.
Lets let this 3,000,000 visitors to rocky mountain national park have something
to stop and do in Estes Park so that they will come into town and spend their
money.
Any other location in town would not have the attraction to lure people out of
the park into Estes Park to spend their money as this location offers.
The EVIA position of driving out the poor people and bringing in the rich is not beneficia
to the people of Estes Park. 'If this position was held up it would drive most of the
people out of town as only the rich could afford to live in Estes Park then. Look
at what has happened in Vail to see how the poor people and middle income people cannot
afford to live in the town itself. Our retired people would find they were unwelelcome
in town as they are not rich enough. 0ur young people just starting out with young
families would not be rich enough and would be unwelcome. Lets keep estes park the great
place it is to live, but lets attact the people passing through town to stop and spend
some money and help the local economy. The Hydro Slide in this location would be an
ideal attraction to accomplish this.

Dear Members of the Town Board:
My wife and I own the Timberlane Motorlodge which
adjoins the location of the proposed Estes Park Hydrotube.
I would like to again voice my opposition to the proposed
location of the Hydrotube.
I am concerned about the location for the following
reasons:
1. We believe that the Hydrotube will have a detrimental
visual impact in our property. Since it appears that most of the
tube itself will be extending out the side and rear of the building,
our guests will have clear sight of the tube from most areas of
our property.
2. The parking lot on the river will be lighted and
the headlights from cars using that parking will shine over on
our property, disturbing our guests. This disturbance might
be decreased if Mr. Sessions constructs a fence or plants high
shrubs or other landscaping around the south and east sides of
his property to cut down on the noise and light problems.
3. We are concerned about the parking which will spill
out from the proposed parking areas on the Hydrotube location and
tube users will park on Highway 36 and in my driveway. My
request is that a "no parking - tow away zone" sign be installed
on the shoulders and near my driveway to avoid problems which
the overflow parking may cause.
4. Since my property will be more affected by the
Hydrotube than any of the others nearby, our suggestion is that
the hours of operation for the Hydrotube be limited to 8:00 A.M.
through 8:00 P.M. Since it will take some time for the building
to empty and for the tube employees to clean up the building,
I believe 8:00 P.M. will be a better closing time than would
any later time. My suggestion is also that no more tube users
be allowed to use the tube after 8:00 P.M. rather than having
the business close its doors at 8:00 P.M., allowing the remainder
of its customers to use up their rides in the tube after that hour.

5. In the heat of the day in the summer, windows in
the Gypsy Baron building will no doubt be open. This will allow
noise of the Hydrotube users as well as the electronic game and
concession stand noises to filter out of the windows toward my
property. My suggestion here is that either air conditioning or
fans be required in the building. This would, of course, alleviate
the need to open any windows.
6. If the Hydrotube closes for business in other than
the off-season, the tube itself should be taken down immediately
rather than waiting for Mr. Session to possibly sell the business
or go through possible bankruptcy proceedings.
7. My last objection pertains to the fact the the
Town is willing to move forward with the approval of this tube
without requiring the proper studies to be done and information
to be provided. Along this line, I would suggest the following:
(a) Mr. Sessions should provide a model of the
building and tube showing exactly what the tube will look like.
Color chips showing the exact color of the tube should also be
provided rather merely relying on a "earthtone" restriction on
the color of the tube.
(b) A drainage study should be done to determine
any possible drainage problems caused by the paving of the parking
lot areas.
(c) A definite lighting and landscaping plan
should be provided by Mr. Sessions since, to my knowlege, no
such plan has been provided.
(d) A parking and traffic study should be done
to determine if the tube dustomer traffic will cause serious
traffic and parking problems.
(e) A study should determine whether or not
this business will adversely affect adjacent property values.
It appears to me that if the Town is going to try to clean up
its "Coney Island" image and at the same time protect the beauty
of our surroundings, a further study, as indicated above, should
be initiated by the Town before final approval is given to the
Hydrotube. Certainly, I endorse all the restrictions which were
placed on the installation of the tube at the recent Planning
Members of the Town Board of Estes Park

Commission meeting, but I think some of the above questions should
be considered and answered before the question of final approval
comes before the Board.

Dear Members of the Board,
I believe the film viewing the Portland Hvdrotube is
invalid, and should not be allowed to be shown unless it is
shown in it's entirety. I, as well as several other business
owners, who attended a preliminary meeting at which the video
was shown, noted at the Planning Hearing last Tuesday, that the
noisiest section of the film seemed to be missing.
I also believe that a shopping center is not a valid
comparison to our area with accomodations. Never have I
seen the management of a shopping center out actively trying
to keep it's patrons quiet because of it's guests trying to
sleep, or having been asked "not to be disturbed
Perhaps a small scale model of the Hvdrotube would be
better suited to answer the question, "What will the Hvdrotube
look like?"
An 8' fence around the property, both sides and back of
this intense amusement site would be appreciated by accomodations
in the surrounding area.

Dear Members of the Town Board:
My wife and I own the Tiny Town Cottages, near the
proposed location of the Estes Park Hydrotube on Highway 36.
I would again like to voice my opposition to the location of the
Hydrotube. Some of our objections are unique due to the location
of our property.
First, our office and most of our cottages either face
or are within sight of the tube. Because we anticipate the in-
stallation of the tube will cause visual problems and additional
traffic and parking at nearby Trout Haven, we will have to install
a fence around part of our property to act as a sound, sight
and dust barrier. I believe that a six-foot fence is the highest
barrier we can install but I may in the future need to ask for
a variance to allow me to install a higher fence.
Secondly, there is a recreational vehicle park across
the river from my property and it appears to us that children
from the RV park will be running across our property in order
to get to the tube.
Thirdly, we are concerned that the installation of the
tube will cause a decrease in our property values.
We are also afraid that there will be unforeseen
problems which will arise by virtue of the heavy use of the
tube during the busy season.
I might add that if the tube installation is going to
be permitted, then I certainly endorse the restrictions which
were suggested by the Planning Commission at its meeting on
March 15, 1983. I agree that the brown or tan colored tube
should be required and that other restrictions as to hours
of operation and parking should be approved by the Town Board.

Dear Board Members,
In my absence, I respectfully request the following to be read and entered
as part of the record of the Estes Park Town Board hearing to consider the
proposed use of the former Gypsy Baron Restaurant property as a "hydrotube". I
urge the board to postpone approval of this use until more detailed and accurate
information can be obtained.
Let me recall a few Board decisions to set the background for my remarks. In
1978, a proposed go-cart project at the intersection of Moraine and West Riverside
was not approved because of the anticipated impact to the area. (Noise/congestion)
More recently, the adoption of a sign code banning neon was interpreted to include
design lighting at the Park Theatre, as incompatible. Currently, the Estes Park
Redevelopment Plan, iniciated and supported by board members, is attempting to
encourage development that will both enhance and be compatible with our unique
surroundings. Therefore, my first concern is for the lack of compatibility the
"hydrotube" use shows, in it's proposed form, for the surrounding area.
However, my most serious reservations deal with the lack of detail in the
proposed site plan and the vague explanation of the extent of operation and
expansion of the hydrotube. Therefore, I request that the Board reserve approval
until more definitive information can be obtained concerning the following:
1. The nature and extent experience that qualify Mr. Sessions and
the project engineer to design, install and operate a "hydrotube"
should be determined.
2. Impact on property values and business climate should be assessed
by an impartial and reliable source.
3. The extent of impact to drainage in this area needs definitive

At the Planning Hearing concerning the Hydrotube, the subject of Tiny Town
Miniature Golf was frequently mentioned. It was stated that our Miniature Golf
and Trout Haven are located in the same area, therefore, a hydrotube should be
located in our area also.
Our golf course projects an image of quiet, relaxing entertainment which
attracts as many adults as it does children. We believe our golf course should
not be used in comparison with the Hydrotube when studing the effects of
amusements upon the neighboring accomodations. The following comparisons will
point out the many differences between our miniature golf and the proposed
Hydrotube.
1. Tiny Town Cottages own, operate, and control Tiny Town Miniature
Golf Course. Tiny Town Cottages, Timberlane, Brookside, and
Brynwood DO NOT own, operate, and control the Hydrotube.
2. Our golf course is surrounded by our own property, and there are no
accomodations other than our own, in the immediate vicinity. The
Hydrotube, on the other hand, will be centrally located among five
different accomodations.
3. Our parking in front of the golf course is isolated from the river
and accomodations; however, the Hydrotube parking will be adjacent
to the Big Thompson River and within 20' of a neighboring accomoda-
tion's property.
We believe that if Tiny Town Miniature Golf was not owned, operated, and
controlled by Tiny Town Cottages, it could possibly become a serious liability
to the cottage business. Also, since our golf course has never received a single
complaint in the last 27 years, we can only assume that it is compatible to the
surrounding businesses and accomodations.

water tube facility to be located on the former Gypsy Baron Restaurant
property.
I have reviewed the site plan of the water tube facility and feel that it
is a thorough and well planned proposal. This type of recreation is
appropriate for this location as there are similar facilities in this
neighborhood such as a public fishing pond and miniature golf course. These
types of recreation provide wholesome family recreation which are primarily
daytime/early evening entertainment.
I believe that this is a preferable use to many of the uses permitted by
right in this zone and that it will not be injurious to me or other adjacent
property owners.

other about your proposed water slide, and throughout our discussions
my opinion has remained the same: "A WATER SLIDE IN ESTES PARK IS ANOTHER
ATTRACTION TO REMAIN THE VISITORS AND ENTERTAIN THEM WHILE THEY ARE HERE.
THE SITE YOU HAVE PROPOSED IS OF LITTLE ADVANTAGE OR DETRIMENT TO ME AS
THE -LESSEE OF ADJACENT PROPERTY. HOWEVER, SHOULD THE SLIDE BE APPROVED FOR
AN ESTES PARK SITE, THEN I WOULD PREFER TO HAVE IT AT YOUR SITE, RATHER
THAN ELSEWHERE INTOWN."
I think that it is timely with the attitudinal change in Estes Park at
this time, that a progressive idea such as yours be attempted. I think that
it is important for your plan to incorporate the following:
1) A COMPLETELY enclosed pool at the end of the slide to eliminate
a majority of the noise coming out of the tube.
2) ADequate traffic control ingress/egress during the peak season.
We have seen danger at the entrance to Trout Haven, due to the
view of traffic being blocked by parking at the road's edge of
The Miner's Kettle, to obscure oncoming cars from each direction.
3) That the site plan demonstrate adequ .te screening for the Timberlane
Motel, with plantings being shown to be of sufficient height now,
not in future years alone, by growth.

It has been brought to my attention that a proposal has been presented
to the Town of Estes Park for special review of the feasibility of a
hydro tube water slide to be placed at the former Gypsy Baron site.
I have been in business in Estes Park for approximately 14 years at the
Kentucky Fried Chicken establishment which is in the adjacent area. This
area is definitely an area which caters to the needs of the tourist.
It is my personal opinion that an attraction of this type would enhance
the need in Estes Park for things for families to do while they are
visiting here.
I have been informed of the proposed structure and feel that it is
being done in a very professional way and would not be a detriment
to the area.
I strongly support the granting of this variance by the Town of Estes

RE: 'Hydro Slide
I would like to go on record in favor of the Hydro Slide for the following reasons
#1---Would Provide entertaining healthfull recreation for our local children.
#2---Would be an attraction to bring and keep tourists in Estes Park for the benefit
of everyone in town because of the additional tax revenue it would raise directly
as a Hydro Slide and as a money raising tax revenue from the people who stayed
longer in town and spent their money because the Hydro Slide is here.
#3---1 believe the proposed location for the Hydro Slide is ideal as it is located
near Rocky Mountain park and will be an attraction to bring some of the campers
out of the park to spend money in Estes Park. Contrary to what many people
believe about poor people camp-. the camping industry has done exaustive
study and has found the average camping family has an income nearly 50% above
the national average of about $30,000. I can tell you from experience as the
former owner of the Blue Arrow Campground that these people have money to spend
and are looking for places to spend it. Many many campers left town much earlier
than they expected to,as there was not enough family entertainment in town to
keep their children busy. The Hydro Slide, The Fish Pond, and the miniture
golf course will attract many families to stay and spend money in Estes Park
by being in close proximity. The motel owners who are close by will find that
they will have a huge demand from people wanting to stay there so their children
will be able to walk to the entertainment. They will find it will lengthen
their peak season being close by, and they will find they can command the highest
room rates in town because entertainment within walking distance is the biggest
draw they can have.
Lets let this 3,000,000 visitors to rocky mountain national park have something
to stop and do in Estes Park so that they will come into town and spend their
money.
Any other location in town would not have the attraction to lure people out of
the park into Estes Park to spend their money as this location offers.
The-EVIA position of driving out the poor people and bringing in the rich is not beneficia
to the people of Estes Park. 'If this position was held up it would drive most of the
people out of town as only the rich could afford to live in Estes Park then. Look
at what has happened in Vail to see how the poor people and middle income people cannot
afford to live in the town itself. Our retired people would find they were unwelelcome
in town as they are not rich enough. Our young people just starting out with young
families would not be rich enough and would be unwelcome. Lets keep estes park the great
place it is to live, but lets attact the people passing through town to stop and spend
some money and help the local economy. The Hydro Slide in this location would be an
ideal attraction to accomplish this.

owners at the Miners Kettle. e think the slide would be of a great
benefit to the town of Estes Park for the following reasons.
We have managed theatres for some 20 years, both indoor and outdoor.
We were also half owners of the Denver School of Gymnastics for girl.
in Denver. With this background we feel we know at first hand the
difference in good clean fun and just fun. The children of Estes
Park need a place in their own town where they can have this type of
entertainment. We would far rather our own children be on that slide
getting physical exercise than standing in front of a video game,
going to a movie, or standing on a street corner. We feel as a touri:
attraction its.great. Lets face it we are in a physical fitness craze
in th?s country. If thats what the people want, then let Estes Park
be the one to give it to them.
We favor the location, quite frankly because its next door to the
Miners Kettle. We feel it will be a great asset to our business and
to others around us. We are all there to make a liLing and anything
that attracts traffic the way this slide will can't do anything but
benefit us all.
We hope you will look favorably on both the Slide and the location,

Dear Board Members,
In my absence, I respectfully request the following to be read and entered
as part of the record of the Estes Park Town Board hearing to consider the
proposed use of the former Gypsy Baron Restaurant property as a "hydrotube". I
urge the board to postpone approval of this use until more detailed and accurate
information can be obtained.
Let me recall a few Board decisions to set the background for my remarks. In
1978, a proposed go-cart project at the intersection of Moraine and West Riverside
was not approved because of the anticipated impact to the area. (Noise/congestion)
More recently, the adoption of a sign code banning neon was interpreted to include
design lighting at the Park Theatre, as incompatible. Currently, the Estes Park
Redevelopment Plan, initiated and supported by board members, is attempting to
encourage development that will both enhance and be compatible with our unique
surroundings. Therefore, my first concern is for the lack of compatibility the
"hydrotube" use shows, in it's proposed form, for the surrounding area.
However, my most serious reservations deal with the lack of detail in the
proposed site plan and the vague explanation of the extent of operation and
expansion of the hydrotube. Therefore, I request that the Board reserve approval
until more definitive information can be obtained concerning the following:
1. The nature and extent experience that qualify Mr. Sessions and
the project engineer to design, install and operate a "hydrotube"
should be determined.
2. Impact on property values and business climate should be assessed
by an impartial and reliable source.
3. The extent of impact to drainage in this area needs definitive
evaluation. (Ref: Ed Peterson comments about Landfill Drainage
Hazards)
4. Specifications of this high profile structure should be assessed
for a high wind area. (Ref: 1980 Slides at Fun City)
5. The question of Liability needs to be resolved. The intersection
of Elm and highway 36 west is most congested at peak traffic and
the introduction of 300-500 children per day will add to the hazard.

6. The term "enclosed" should be specified as to extent and type of
materials.
7. A project model would help to clarify the proposed use, especially
the type, color, and extent of materials to be used. (Required by
Steamboat Springs for their hydrotube project)
8. A more detailed explanation of intended daily operation will help
to forecast impact on the area.
9. A plan to address problems as they arise should be formulated.
I appreciate the board's willingness to entertain all perspectives in this
matter. However, I hope that the future of this project will be based on verifiable
information and not the vague conjecture of any point of view.

Dear Board Members,
At the Planning Hearing concerning the Hydrotube, the subject of Tiny Town
Miniature Golf was frequently mentioned. It was stated that our Miniature Golf
and Trout Haven are located in the same area, therefore, a hydrotube should be
located in our area also.
Our golf course projects an image of quiet, relaxing entertainment which
attracts as many adults as it does children. We believe our golf course should
not be used in comparison with the Hydrotube when studing the effects of
amusements upon the neighboring accomodations. The following comparisons will
point out the many differences between our miniature golf and the proposed
Hydrotube.
1. Tiny Town Cottages own, operate, and control Tiny Town Miniature
Golf Course. Tiny Town Cottages, Timberlane, Brookside, and
Brynwood D0 NOT own, operate, and control the Hydrotube.
2. Our golf course is surrounded by our own property, and there are no
accomodations other than our own, in the immediate vicinity. The
Hydrotube, on the other hand, will be centrally located among five
different accomodations.
3. Our parking in front of the golf course is isolated from the river
and accomodations; however, the Hydrotube parking will be adjacent

We believe that if Tiny Town Miniature Golf was not owned, operated, and
controlled by Tiny Town Cottages, it could possibly become a serious liability
to the cottage business. Also, since our golf course has never received a single
complaint in the last 27 years, we can only assume that it is compatible to the
surrounding businesses and accomodations.

Dear Members of the Board,
I believe the film viewing the Portland Hydrotube is
invalid, and should not be allowed to be shown unless it is
shown in it's entirety. 1, as well as several other business
owners, who attended a preliminary meeting at which the video
was shown, noted at the Planning Hearing last Tuesday, that the
noisiest section of the film seemed to be missing.
I also believe that a shopping center is not a valid
comparison to our area with accomodations. Never have I
seen the management of a shopping center out actively trying
to keep it's patrons quiet because of it's guests trying to
sleep, or having been asked "not to be disturbed
Perhaps a small scale model of the Hydrotube would be
better suited to answer the question, "What will the Hydrotube
look like?"
An 8' fence around the property, both sides and back of
this intense amusement site would be appreciated by accomodations
in the surrounding area.
I would appreciate your logical consideration in this matter,
and in your final decision making.

Re: Estes Park Hydrotube
Dear Members of the Town Board:
My wife and I own the Timberlane Motorlodge which
adjoins the location of the proposed Estes Park Hydrotube.
I would like to again voice my opposition to the proposed
location of the Hydrotube.
I am concerned about the location for the following
reasons:
1. We believe that the Hydrotube will have a detrimental
visual impact in our property. Since it appears that most of the
tube itself will be extending out the side and rear of the building,
our guests will have clear sight of the tube from most areas of
our property.
2. The parking lot on the river will be lighted and
the headlights from cars using that parking will shine over on
our property., disturbing our guests. This disturbance might
be decreased if Mr. Sessions constructs a fence or plants high
shrubs or other landscaping around the south and east sides of
his property to cut down on the noise and light problems.
3. We are concerned about the parking which will spill
out from the proposed parking areas on the Hydrotube location and
tube users will park on Highway 36 and in my driveway. My
request is that a "no parking - tow away zone" sign be installed
on the shoulders and near my driveway to avoid problems which
the overflow parking may cause.
4. Since my property will be more affected by the
Hydrotube than any of the others nearby, our suggestion is that
the hours of operation for the Hydrotube be limited to 8:00 A.M.
through 8:00 P.M. Since it will take some time for the building
to empty and for the tube employees to clean up the building,
I believe 8:00 P.M. will be a better closing time than would
any later time. My suggestion is also that no more tube users
be allowed to use the tube after 8:00 P.M. rather than having
the business close its doors at 8:00 P.M., allowing the remainder
of its customers to use up their rides in the tube after that hour.

5. In the heat of the day in the summer, windows in
the Gypsy Baron building will no doubt be open. This will allow
noise of the Hydrotube users as well as the electronic game and
concession stand noises to filter out of the windows toward my
property. My suggestion here is that either air conditioning or
fans be required in the building. This would, of course, alleviate
the need to open any windows.
6. If the Hydrotube closes for business in other than
the off-season, the tube itself should be taken down immediately
rather than waiting for Mr. Session to possibly sell the business
or go through possible bankruptcy proceedings.
7. My last objection pertains to the fact the the
Town is willing to move forward with the approval of this tube
without requiring the prokper studies to be done and information
to be provided. Along this line, I would suggest the following:
(a) Mr. Sessions should provide a model of the
building and tube showing exactly what the tube will look like.
Color chips showing the exact color of the tube should also be
provided rather merely relying on a "earthtone" restriction on
the color of the tube.
(b) A drainage study should be done to determine
any possible drainage problems caused by the paving of the parking
lot areas.
(c) A definite lighting and landscaping plan
should be provided by Mr. Sessions since, to my knowlege, no
such plan has been provided.
(d) A parking and traffic study should be done
to determine if the tube dustomer traffic will cause serious
traffic and parking problems.
(e) A study should determine whether or not
this business will adversely affect adjacent property values.
It appears to me that if the Town is going to try to clean up
its "Coney Island" image and at the same time protect the beauty
of our surroundings, a further study, as indicated above, should
be initiated by the Town before final approval is given to the
Hydrotube. Certainly, I endorse all the restrictions which were
placed on the installation of the tube at the recent Planning

Commission meeting, but I think some of the above questions should
be considered and answered before the question of final approval
comes before the Board.

Dear Members of the Town Board:
My wife and I own the Tiny Town Cottages, near the
proposed location of the Estes Park Hydrotube on Highway 36.
I would again like to voice my opposition to the location of the
Hydrotube. Some of our objections are unique due to the location
of our property.
First, our office and most of our cottages either face
or are within sight of the tube. Because we anticipate the in-
stallation of the tube will cause visual problems and additional
traffic and parking at nearby Trout Haven, we will have to install
a fence around part of our property to act as a sound, sight
and dust barrier. I believe that a six-foot fence is the highest
barrier we can install but I may in the future need to ask for
a variance to allow me to install a higher fence.
Secondly, there is a recreational vehicle park across
the river from my property and it appears to us that children
from the RV park will be running across our property in order
to get to the tube.
Thirdly, we are concerned that the installation of the
tube will cause a decrease in our property values.
We are also afraid that there will be unforeseen
problems which will arise by virtue of the heavy use of the
tube during the busy season.
I might add that if the tube installation is going to
be permitted, then I certainly endorse the restrictions which
were suggested by the Planning Commission at its meeting on
March 15, 1983. I agree that the brown or tan colored tube
should be required and that other restrictions as to hours
of operation and parking should be approved by the Town Board.

Please be advised that we have reviewed the title to the real property described
on the above Site Plan submitted for your review, and updated the search to this date,
and render the following opinion as to title and encumbrances.
As of this date title is vested in John Dobler and Katherine Dobler as joint
tenants. The following constitute the only lien holders holding deeds of trust
secured by the property:
1. Deed of Trust in favor of The Estes Park Bank, made by John Dobler and
Katherine Dobler and recorded March 21, 1980 in Book 2032 at Page 904, Larimer County,
Colorado records.
2. Deed of Trust in favor of The Estes Park Bank, made by John Dobler and
