ACTION (For Planning Commission Staff Use Only) Planning Commission: Approval: Disapproval: Remarks: Town Board: Approval: Disapproval: Remarks: STATEMENT OF INTENT PINK CANOPY RESTAURANT July 29, 1991 In accordance with Section 17.36.030 Special Review Procedures of the Town of Estes Park Zoning Regulations, a Special Review applicant must develop a written statement of design or use intent. As the Pink Canopy is roposing outside seating, Thorp Associates, P.C., Architects and Planners and Estes Park Surveyors will show through this Letter of Intent, that the proposal's benefits to the Town will far outweigh any adverse affects. Item #1 of Section 17.36.030F questions the suitability of the proposed location for this use, taking into consideration the nearby land uses and whether they would be supported or damaged by the proposed use. This item questions also the adequacy of street, water, sewer, anddrainagefacilities serving the location, the environmental characteristics of the site and the consequences of the development for public safety and the natural environment. First of all, the site, which overlooks the proposed future rejuvenated Town park, and is between a bank and a retail business, is separated from residential areas by an alley and a large elevation differential, is certainly suitable for a new restaurant location with outside seating overlooking the new park and the present terraced garden area in front of the bank. As the property is in downtown Estes Park, the adequacy of streets, water, and drainage facilities are easyto document. It is the understanding of the applicant that some upgrading oftheexisting sewer line may be necessary to accomplish the remodeling. As the sewer lines are potentially original with the building, an upgrade of this sort would be an advantage to both the Town and the provider of sewage services. The environmental characteristics of this site and related areas are largely commercial and will be upgraded by this development, including the installation of handicapped and safer access, as well as upgrades in the landscaping around the existing structure. Item #2 Of Section 17.36.030F in the Town's Zoning Regulations requests a building and site design where visual, noise or other intrusions into adjacent premises will maintain the established character of the vicinity. The question of avoiding unnecessary damage to the natural environment through adaptations to the particularities of the site also needs to be addressed. On this item the existing building and its addition is not in the view corridor of any buildings in the area and the use of the restaurant will create no additional noise or other intrusions upon adjacent properties. The established character of the vicinity will be maintained, as the addition will be designed to continue the existing structural character now in place. Revisions to the site design will help maintain the natural environment, and avoid any damage due to drainage on the site. Also, additional landscaping of the property will enhance its natural character, making the outside dining area a pleasant, natural experience. Item #3 of Section 17.36.030F requests a consideration of the social, economic or community needs which are served by the proposal. The applicants of the new Pink Canopy location are longtime supporters of the "year -around" economy of the community. Relocating the restaurant to this site and providing handicapped access and fewer steps than their present location, means a safer restaurant service will be provided to the community throughout the year, providing economic and social benefit to the area. Item #4 of Section 17.36.030F questions consistency with District objectives which include the furtherance of public health, safety and general welfare, in compliance with the Town's Comprehensive Plan. The Pink Canopy project will not create additional public health hazards, but will actually increase public safety in the area as it provides handicapped access to the site. It addresses other public concerns, such as drainage, site utilities, and additional landscaping. The Comprehensive Plan presently shows this area as commercial usage, which is in compliance with its use as a restaurant facility. Item #5 of Section 17.36.030F questions the suitability of this specific proposal relative the historic resources involved. First of all, the existing building, which is an historic structure in downtown, is planned to be maintained with its entire exterior character in tact. Furthermore, the addition to the facility will recreate the general character of the existing building, to maintain the historical significance on the site. We hope that the above information is helpful in the consideration of allowing the Pink Canopy Restaurant usage on this site. AMENDMENT Further investigation by the applicant has led to the conclusion, that it is more economical to remove the existing structure and construct a new building. Major site changes include: 1. The pedestrian access to the property from the sidewalk is moved to the western property line. 2. Three large evergreen trees in front of the building will be removed as a result of moving the existing structure. STAFF RECOMMENDATION Due to removal of the three large trees and alteration of the retaining wall (new stairway and closure of existing stairway), the following should be incorporated in the amended development plan: 1. The existing retaining wall be removed and replaced to the north (approximately 3 1/2 feet) to allow for an 8 ft. wide sidewalk. This will continue sidewalk transition from the First National Bank property. 2. The cold patch on street pavements placed due to the sewer trench will be replaced with hot patch. Mr. Thorp advised me of the following: a Minna Riz had some questions on cost of the sidewalk/retaining wall. o However, Thorp said the 8 ft. sidewalk was not a problem and that a dry laid stone retaining wall wouldn't be too expensive. They are proposing to do both. o Thorp did not indicate any opposition or alternate proposal. Frank Hix advised me of the following: o He is concerned that Minno might tell him if he has to rebuild the wall and sidewalk, that they will just take the building down and not let Hix move it. o That perhaps EPURA should rebuild the sidewalk. o The trees are in poor condition.
