APPLICATION FOR SPECIAL REVIEW REQUEST NO.,Continued
FOOTNOTES AND GENERAL INSTRUCTIONS
1.The original and a signed copy of the application must be
filed with the Town Clerk,together with a fee of $25.00.
2.The application must be filed at least twenty (20)days
prior to the regular Planning Commission Meeting at which
it is to be considered.
3.Insert the complete legal description of the real property
as shown on the deed to the above owner(s),and the street
address thereof.
4.Insert the use permitted by Special Review which is desired
as provided by Chapter 17 of the Municipal Code of Estes
Park,Colorado,for the zoning district in which the property
is located.
5.Insert the name of the zoning district in which the property
is located,as provided by Chapter 17 of the Municipal Code
of Estes Park,Colorado.
6.All owners and lien holders,or the duly authorized represent
ative thereof,must sign the application as their names appear
on their deed.Only property owners and lien holders,or
the duly authorized representative thereof,and subscribed
and sworn to before a notary public or other authorized officer.
If the application and site plan are signed by a duly author
ized representative,two duly executed and acknowledged Powers
of Attorney must be filed with the application.
7.If additional space is needed for the description of the
property or signatures of applicants,use an additional page
and attach it to the application.
8.An original site plan drawn in black waterproof ink on a tracing
cloth,drafting film or Mylar of good quality,a Mylar reproduc
ible copy and two copies thereof,prepared by a professional
engineer,or a surveyor,who is duly registered and licensed
by the state as a professional engineer ora landsurveyor,are requir
The site plan shall show the location of all buildings and
other improvements to be placedon the real property;off—street
parking areas;location and course of all ways for ingress and
egress to all buildings or structures;and all off—street
loading areas,service and refuse areas,major screening
proposals,signs,outdoor lighting and pedestrian areas,if
any.The site plan shall also show thereon the date or dates
that such phase of the development included in the site plan
will be completed.There shall also be filed with the site
four written copies of all proposed landscaping,if any.The
landscaping may be shown on the site plan in lieu of the fore
going written proposal.The owners and lien holders of the
real property described in the application for special review
and shown on the site plan shall sign the following agreement
to be placed on the site plan:
“The undersigned agree that the real property described in
the application for special review filed herewith,and as
shown on this site plan,shall be subject to the provisions
of Title 17 of the Municipal Code of the Town of Estes Park,
Colorado,and any other ordinances of the Town of Estes Park
pertaining thereto.

9.A public hearing will be held by the Estes Park Planning
Commission on this special review.The Planning Commission
will make a recommendation and final consideration will be
by the Board of Trustees.
10.Before the Board of Trustees will consider any special
review application for final approval,there must be filed,
with the Town Administrator or Town Clerk,a letter certify
ing that all of the persons or corporations having any record
interest in the real property described in such application,
and the site plan pertaining thereto,have signed the same.
Said letter must be dated the day upon which the Board of
Trustees is to consider the application and site plan for
final approval.Such letter must be signed by an attorney
duly licensed to practice law in the State of Colorado.
9.

The real property hereinafter described is subject to the require
ments and provisions of the Application for Special Review No.

I have reviewed the site plan for the above referencedspecialreviewrequestandhavethefollowingcomments:
1.The previous site plan for this property(special review #36)had completion dates of
June 1983 for landscaping and July 1983 forpaving.Neither date has been met.Thelandscapingincludedgroundcoveronallsouthslopesandfour5to6’ponderosa pines along
Lone Pine Drive that are not shown on this siteplan.This site plan also does not show theplantingareasattheeastendsofthe20’x80’
and 30’x80’buildings.The completion dateshouldbeshownforthepaving.
2.As I understand the plans for the fence,it is asixfootchainlinkwithaone—foot barbed wireextensionontop.Due to a misunderstanding,
most of the chain link fence has already beeninstalled.The gate at the northwest cornershouldbeshown.

This is a formal request for correction of the following problems relative to the above address which is
within the Estes Park City limits and currently owned by Mr.Dick Statham.a local resident.
1.There is,of this date,outside storage ofvehicles.old sofas,overstuffed chairs,junk washers and
dryers from a laundramat.refrigerators,automobile hatteries.junk wheels,broken down fencing.
damaged chain link fencing,old car and truck pans,boat trailers inbetween the storage units.The
buildings are partially painted.
Health Problem:There is evidence of a small animal infestation and their
feces.We are increasingly concerned in view of the many diseases carried by
small rodents.
Legal fUse Problem:According to the site plan submitted to the Town of
Estes Park,CO on or about April 9,1982 (Published notice date in Trail
Gazette)pursuant to Ch 17.56 of Code 17,Town of Estes Park,CO,Special
review nwnber 36,there were several items included in their permit,

Fenèing:The storage unit complex was to be partially fenced.
Plantings:There were to be plantings at the ends of each of the additional
buildingsapplied for inthe special review.
Paving:The original paving was to be augmented resulting in an entirely
paved area between storage units.This area is dirt and covered with infested trash.
Dates of completion:Under “Notes”on the recorded plat,Item #4,Completion
Dates were to be as follows:
*Proposed 40’x 60’building June 1982 Complete
*Landscaping July 1982 Incomplete
*Pavig August 1982 Complete
*Future 24’x 100’Building Jan 1983 Complete
LONE PINE ACRES RESIDENTS :
*Lciscaping June 1983 Not done
*Paving July 1983 Not done
Drainage Pond:Note also the drainage (detention)pond or “catch basin”
for runoff”approximately 18’x 110’south of the 24’x 100’fhture storage,southeast
corner of the property.”This pond (currently a small weed filled dent in the ground)
has been breeched and does not serve its intended purpose.
2.Even though it has been 12 years (1983-1995)since the 111mg of the site plan,the items
agreed to on this plan have not been completed.The result is that this property is a health
hazard to our neighborhood,a violation of its permit and a visual atrocity to its business and
residential neighbors.
We will be glad to accompany you on a site inspection of the above described property.Please
contact us if you have any questions.Additionally,please respond to this request,informing us
of your actions taken to bring this property into compliance with current Health Codes as well
as the property’s Permit.
Mayor Dannels,would you please coordinate this effort and reply to us within 10 days (August
14,1995).
