EASEMENT AGREEMENT
This Agreement,entered into this l7thday of March,1984,between
John E.Ownby and Patricia T.Ownby,joint tenants,as Grantors,and C.0.T.
Development Co.,a Colorado corporation,as Grantee,in consideration of the
mutual promises herein set forth and for good and valuable other consideration,
is as follows:
1.Grantors hereby grant and convey unto Grantee,its successors and
assigns,a permanent,nonexclusive ingress and egress driveway road easement
as described upon Exhibit A which is attached hereto and incorporated herein
by this reference.
2.Grantors reserve the right to use the land across which this easement
is granted so long as such use does not interfere with the rights herein granted.
3.The parties,their successors in title and assigns,agree that the
maintenance of said road (driveway)shall be an equal,joint expense.
4.Grantee hereby acknowledges and agrees that this easement shall be
limited to serve that certain property owned by it,which is more specifically
described upon Exhibit B which is attached hereto and incorporated herein by
this reference.
5.Grantee may assign its interest in the easement to its successors in
title to the land described upon Exhibit B hereto,subject to the terms and
limitations of this agreement.
6.This Agreement shall be binding upon the parties hereto,their personal
representatives,heirs,devisees,successors-in—title and assigns,and shall
run with the lands described upon Exhibit B and upon Exhibit C which are attached
hereto and incorporated herein by this reference.
In Witness Whereof,the parties hereto have executed this agreement the day

Dear Ann:
I have reviewed the Bowling Center Special Review Request and
have the following comments:
1.This request is a result of comments made at
the January 17,1984 Planning Commission
Meeting stating
Mr.John Ownby,Jr.explainedthatuntiltheownerhadplansfortheproperty,he didnotwishtoremovetheexistingstructures,the site plan wasintendedasa‘partial site plan’for the bowling alley only.Public works Director widmer stated that the site plan shows bothpiecesofpropertyandonecompletiondatefortheproject.
Menber Richard Wood stated that the public hearing on Special
Review Request No.41 was conducted based on the site plansubmitted,and he bad a problem with modifying the plan withoutpublicinput.Chairman Sager stated that without another Special
Review Request and public hearing,the Planning Ccminission would
be in error by modifying the plan.Member Duane Blair moved thePlanningConenissionrecommenddenialofthisrequesttothetownBoard.Member John Carmack seconded the motion and it pas.edun.niaoualy.
2.Although I was not on staff at the time,May
1983 correspondence does not speak directly
to the house removal issue.

have reviewed Special Review Request No.45.I havethefollowingcomments:
1.The revised Special Review Site Plan excludes theeasterlyportionofthepropertythatwasincludedintheothersiteplanpreviouslyfiledandacceptedforthebowlingcenter.It is necessary that the owners andlienholdersofthatportionofthepropertyexcluded fromthissiteplanalsosigntheagreementonthesiteplan.This is necessary since their property was formerly a partofanothersiteplanthatisbeingremovedfromthissiteplan.
2.Appropriate easements must be obtained from theownersofsaideasterlyportionofthepropertyforthethirtyfoot(30’)wide driveway easement and the drainageeasementasshownonthesiteplan.Also,recording of theseeasementsshouldberequiredtoinsurethattheyremainwiththeproperty.

I noticed in a recent “notice”that there is a specialreviewplannedregardingthequestionofmini—storage inEstesPark.As I will be unable to attend the PlanningCommissionmeetingonthe17thofthismonth,I wanted tovoicemyopinionpursuanttothequestionofmini—storage.
Knowing that a large number of my customers at EagleViewandEaglesLandinghaverequestedin—town storagefacilities,I would think that additional mini—storage unitswouldservetheinterestsofpresentandfuturecitizensofEstesPark,as long as the facilities were constructed insuchamannerastonotbeingaestheticallydetrimental.Sofarinthiscommunitywehavehadgoodluckwithmini-storage;and I would encourage a positive vote with regardstoallowingthisadditionalmini-storage to be built.
