17.56.040 Review of request by planning commission. The
planning commission shall review the request in relation to
the date or dates for completion of all improvements, charac-
ter of the surrounding neighborhood, the desirability and need
for such a use in the specific area of the community, adverse
environmental influences that might result from its location,
and, in general, compliance with the intent of this title.

17.56.050 Planning commission's recommendation to board
of trustees. The planning commission shall make a recommenda-
tion to the board of trustees, including such safeguards and
revisions considered necessary to protect the health, safety
and welfare of the community, and the date or dates which all
improvements on the property are to be completed. (Ord. 20-
71 §4 (part) , 1971: prior code §12.12-1 (2) (A) (4) : Ord. 185
§4(part), 1958).
17.56.060 Action by board of trustees. The board of
trustees shall then consider the request and the planning
commission's recommendation and shall make a final decision

whether or not to grant the application, and if the applica-
tion is granted, the board of trustees shall set the date or
dates within which all improvements shall be completed. (Ord.
20-71 §4(part), 1971: prior code §12.12-1 (2) (A) (5) : Ord.
185 §4(part), 1958).
17.56.070 Hearing by planning commission --Notice. Be-
fore reviewing any request filed as provided in this chapter,
the planning commission shall have a notice published once,
at least seven days before the hearing on the application by
the planning commission, in the manner as is required for
amendments to ordinances, and the planning commission shall
have a notice posted on the property to which the request
pertains at least seven days prior to the date the request
will be considered by the commission. The notice shall con-
tain the following information: the use to be permitted by
special review; the date and place the request will be con-
sidered by the planning commission; and the location where
additional information may be obtained. (Ord. 20-71 §4(part),
1971: prior code §12. 12-1 (2) (A) (6) : Ord. 185 §4 (part) ,
1958) .
17.56.080 Filing fee. All persons filing requests as
herein provided shall be charged a fee of twenty-five dollars
to cover the cost of advertising and processing. (Ord. 20-71
§4(part) , 1971: prior code §12.12-1 (2) (A) (7) : Ord. 185 §4
(part), 1958).
17.56.090 Attorney's letter of certification. Before
the planning commission or board of trustees will consider any
special review application for final approval, there must be
filed, with such commission and board, a letter certifying
that all of the persons or corporations having any record
interest in the real property described in such application,
and the site plan pertaining thereto, have signed the same.
Such letters must be signed on the day the planning commission
and board of trustees will consider the application and site
plan for final approval. Such letters must be signed by an
attorney duly licensed to practice law in the state. (Ord.
1-76 §1, 1976).

Dear Dale,
Having examined the site plan for Special Review Request #11,
I have found that the requirements of Title 17 of the Munici-
pal Code are met. All lien holders, if any, must sign both
the application and site plan prior to Town Board approval.
The code does not specify parking requirements for a use
such as a bowling alley. The normal commercial ratio of
one space per 200 square feet of building is probably more
than a bowling alley would normally require, but I feel that
it would be wise to have that amount provided for in case
the building might be used for another use in the future.

Dear Chairman Petrocine:
Mr. and Mrs. Wayne Pociecha and Mrs. and Mrs. Fred DeHaan have re-
quested a letter from the Estes Park Chamber of Commerce regarding
the construction of a new bowling alley in Estes Park.
First, 1 have personally reviewed the results of the coupon ques-
tionnaire in the Trail -Gazette, and find the return very favorable.
Total returned survey coupons were 239, with 664 local persons re-
sponding to the positive that, in fact, they would bowl and support
a bowling league. This, in itself, certainly shows a great degree
of positivism by the community and indicates a successful winter
season for the property.
Secondly, a public bowling alley, particularly in the area chosen by
both parties, should lend itself to recreational bowling for the
young people in Estes Park. I am confident the facility could be
utilized by both the school district and the recreation, district
during off season months.
Third, the facility would be another "year around" recreational fa-
cility badly needed in Estes Park. Emphasis on year around business
is certainly in all our minds, and this facility would certainly
lend itself to assisting us in our year around promotion.
Obviously, the bowling alley would be another recreational facility
available to the summer visitor as well, and there would be very
little problem, with proper management, for the alley to be success-
ful year around.
Therefore, if all other pertinent matters have been attended to, I
would strongly recommend a positive decision by the Planning Com-
mission in re -zoning this property during your January 18 meeting.
