RE: Minor Modification Request, 1074 Char Del Lane, Reduced Side Yard Setback
Dear Mr. Cooper:
I have reviewed your request for a “Minor Modification,” specifically, your request for building permit authorization from
this Department to construct an addition to an attached garage, at your single-family dwelling located at a property
addressed as 1074 Char Del Lane, Estes Park and legally described as Lot 33 of the Amended Plat of Fall River Estates
Subdivision, and identified as Larimer County Tax Parcel No. 3522213033. The property is within an E-1, Estate Zoning
District.
Per the Estes Valley Development Code (EVDC) Section 4.3, Table 4 – 2, a dwelling in the E-1 Zoning requires a side
setback to be a minimum of 25 feet. You propose building the garage addition with a side setback of 23 feet, per the letter
of request and site plan submitted on June 28, 2019.
Section 3.7.A.2.a. of the EVDC provides staff the authority to grant a Minor Modification to a General Development and
Zone District Standard, “up to a maximum of ten percent (10%).”
Staff hereby grants this Minor Modification as described above, and finds the Modification is eight percent (8%) of the
setback standard, will not create significant adverse impacts, and is consistent with the standards and requirements of the
EVDC, Section 3.7.A.2.a.
This approval shall not constitute an exemption from building permits, zoning, or other applicable regulations.

This letter is in reference to a Staff Level Minor Modification for the residential garage addition for my
home at 1074 Char Del Lane.
This request is for a side yard setback of 23 feet in lieu of the minimum required 25 feet for El Zoning.
This addition does not require an extension or addition of any utilities.This addition also will not
interfere with any sight visibility on any roads or driveways.
The $150.00 application fee has been included with this letter,
