RE: BP 8470 Della Terra
Pam,
I have attached the IBC commentary regarding Accessible Entrances (1105) and Accessible
Means of Egress (1007). Your concern as I understand it is the exits located at the north of
the building to be considered for the required 50% of entrances. Are the exits to the north
intended to be entrances for guests or will they be used for egress exit purposes? I believe
the codes intent is for 50% of entrances to be accessible. Please note for the 2 means of
egress from each space be accessible. Hope this helps.

RE: BP 8470 Della Terra
Pam,
In looking at the Suite 3, fully accessible unit, Detail 1/A-28 we have the following comments:
1. In the water closet area there is a wall shown cutting off part of the 56”x60” clear floor
space.
2. The bathtub would need to comply with ANSI 117.1 607. A clear floor space per 604.2
and grab bars per 607.4.2 if not providing a seat. There are no exemptions for a fully
accessible unit.
3. The seat in the shower as shown does not meet the intent of transferability. Basically a
space next to the seat is required in order for a side transfer. You might take a look at
608.4 for alternate roll-in-type showers and 610.3 shower compartment seats.
4. The location of the hand shower does not comply with 608.5. Look at 608.3.1 the control
wall is opposite the seat.
5. The control wall where the controls and hand shower is located require a horizontal and
vertical grab bar. See 608.3.1.
Steve might want to sketch up a few options to fax to us for review before any changes to the
plans are made. It’s a difficult configuration to get to comply. If you have any ideas, we are
more than willing to review them.

Pam,
Will B. and I would be willing to meet with your Architect and you to review the issue of
continuity. I have not completed my re-review of the submitted drawings, but since you had a
question on the rated wall assembly in-between the sleeping units and mechanical area, I
wanted to clarify the Town’s interpretation of IBC 711 Horizontal Assemblies. The plans
submitted stop the rated horizontal assembly (floor/ceiling) located at the sleeping units. This
in not in compliance with IBC 711.4 which requires horizontal assemblies to be continuous
except as permitted by shaft enclosures (707.2), penetrations (712.4) or joints (713). To stop
the rated horizontal assembly at non-rated rooms would require the walls to be built as shaft
enclosures. Fireblocking does not meet this requirement. Shaft Enclosures per 707 are to be
continuous from the top of the floor/ceiling below to the underside of the floor or deck above.
The floor joists would have to be hangered off the shaft walls in order not to penetrate the
assembly.
Regarding your question on the sleeping unit/mechanical room walls, the sleeping unit walls
could be rated as detailed on IBC Table 720.1, 14.1.3 and be continuous to the floor/ceiling
deck to create a shaft wall. This would allow the mechanical room walls to have penetrations
and be fire blocked, but only protect the membrane or through penetrations into the shaft
walls and other rated assemblies. Please see attached.

Sheet A-8 question: Was this sheet changed? Arc of 10’? We did not receive a revised
sheet.
Sheet A-25 questions:
1. Detail 7/A-25 calls for WP-1407 listing for a 2x6 exterior walls rated one hour. Unable to
locate. Provide copy of listing.
2. Will WP-1407 be the listing for the exterior walls at the north exit Basement and 1st Floor
that are required to be one hour rated? If not, provide listing.
3. Detail 10, 12, and 13/A-25 shows shaft enclosure with 7/16” OSB on the inside of shaft
walls. Provide listing with this assembly for a one hour wall. Or, which listing on A-25 are
these walls to be constructed as?
Sheet A-30 questions:
1. Storage areas under stair are noted as one hour construction. Are walls to be constructed
as listing noted on A-25? There does not seem to be a ceiling listing that would work at
this condition on A-25. One layer of 5/8” type ‘x’ is not sufficient for a one hour rating.
Provide instruction or listing.
Sheet A-21 question: Detail added for floor/wall tile installation. IBC 1210.1 requires the floor
surface material to extend up the wall a minimum of 6”. The 90 degree corner shown does
not comply. A grout line at the floor/wall is not compliant with the intent of 1210.1. Justify or
revise.

Pam,
In looking at the stair enclosure from the basement to the reception (Detail on A-30) we have
the following questions:
1. The stair is a required mean of egress; it is required to be enclosed per 1019.1. It is to be
constructed as a one hour shaft enclosure IBC 707.
2. One layer 5/8” type ‘x’ gypsum board is shown on the ceiling. Provide listing that shows a
one hour rating for the assembly shown. Per 707.12 a shaft enclosure is allowed not to
extend to the underside of the roof deck if the shaft is enclosed at the top with same fire-
resistance-rating of the shaft. Justify.
3. Are these one hour walls to be constructed per the listing on A-25, detail 3/A-25? Provide
note.
4. Provide headroom as required by IBC 1009.2. Detail on sheet A-16 shows 6’ -8 ½”
horizontal from edge of nosing to ceiling/floor above. Code requires 6’-8” “measured
vertically from a line connecting the edge of the nosing”. Please verify required headroom.

1. Details for accessible ramps are not showing handrail extensions. IBC 1010.8 requires
handrails complying with 1009.11 if rise greater than 6”. 1009.11.5 Requires ramps and

1. Sheet P2.2--Reviewer could not locate kitchen area gas service details. The gas line
system was sized on the assumption the kitchen area would be serviced from the
1.25” line upstream from the 1” line that tees into to the West. See Sheet P3.1.
Please comment.
2. Sheet P2.3—General Notes references Solar Panels. Provide detail on panels;
Location, specifications, etc.
3. Sheet P3.1--The total gas demand should be revised to include all kitchen
equipment, including appliances under the type 1 hood. To allow for future
demands, staff recommends the service demand should be a minimum 7,000MBH.
Please comment.
4. Sheet 3.1--Specifications for kitchen equipment under the type 1 hood have not
been provided. The gas line system was sized on the assumption all kitchen
equipment will not exceed 400,000 BTU of demand. Provide specs on type 1 hood,
grease duct, appliances, make-up air, fire suppression system, etc. ASAP. The
Town of Estes Park, Department of Building Safety requires type 1 hoods and
grease duct details to be stamped by a Colorado Design Professional. Design build
details will not be accepted for review, unless wet-stamped.
5. Sheet P5.1, Flag Note 2-- Reference to 4” gas line drops to the Potable Water
Heaters is not consistent with the 2’ drops shown on the schematic on Sheet P6.1.
Please comment.
6. Sheet5.1--The gas system design does not comply with the sizing requirements of
2003 IFGC, Table 402.4(1), which limits the pressure drop to 0.3 inch water
column. The system design does comply with Table 402.4(2) which allows a
pressure drop of 0.5 inch water column. The Engineer’s stamp on the plans has
been interpreted as his approval to use Table 402.4(2). If this is not accurate, please
comment.

2nd Review Original question numbers referenced. Commentary in blue +/or

changes made by Civil. I have included an email from Scott Zurn and Dave Shirk
for items they are still waiting on.
1. Application
a. It is the Department of Building Safety policy to require a fire-stop specialty
contractor when fire-resistive construction is involved. A fire-stop contractor
will be required. Submittal of Fire stop system listings for review and approval
is required prior to release of the permit. Owner is to specify if providing a fire-
stop contractor or fire-stop inspector and provide credentials of professionals for
review and approval. Submit all fire-stop systems for review and approval prior
to release of full permit.
7. Building Code Analysis – Fire Resistive Requirements
a. Per IBC 711.3 (exception) Horizontal floor assemblies separating dwelling
units or sleeping units shall be a minimum of ½ hour fire-resistance rated
construction for a fully sprinklered VB type of construction. Justify or revise. As
discussed with Pam, the horizontal floor/ceiling assemblies are required by IBC
711.4 to be continuous. Revise or justify termination and/or penetration of the
horizontal assembly as shown on A-25.
b. Corridors in R occupancy are required to have a ½ hour fire-resistance rating
per IBC Table 1016.1. Justify or revise. It is agreed that the Basement is the
only corridor per 1016. The basement corridor is required to be rated per Table
1016.1 (R occupancies greater than 10 occupant load) for .5 hours. The corridor
walls and ceiling are to be constructed as fire barriers. The reference to
exception #2 is for corridors within a sleeping unit. Justify or revise.
10. Building Code Analysis – Fire-Resistance Rated Construction
a. Provide copies of listings for all fire-resistance-rated assemblies, per IBC
703.2. (Concealed areas without sprinklers- per NFPA 13; Elevator shaft per
IBC, 707.14 and 707.4; Machine room per IBC 3006.4; Stair enclosures per
IBC, 1019.1.5; etc.)
• Listing provided on 2/A25 for the floor/ceiling assembly (L518) requires (2)
layers ½” gypsum board. Plan calls for 5/8” type ‘x’ gypsum board. Per
UL requirements (UL does not know what the effect of a modification may
have on the safety of the product or the continued validity of the UL
certification mark unless the field modifications have been specifically
investigated by UL. Unless UL investigates a modified product, UL cannot
indicate that the product continues to meet UL's safety requirements.)
Justify or provide alternative listing for horizontal floor/ceiling assemblies
that include insulation and resilient channel.

• Listings provided on 1/A25 and 3/A25 for interior one hour rated walls does
not include insulation or resilient channel as shown on 6/A25. These listing
are from the IBC Table 720.1 for prescriptive fire resistance. Per IBC 720.1
where materials that change the capacity for heat dissipation are
incorporated into a fire-resistance-rating assembly, fire test results or other
substantiating data shall be made available to the building official to shown
that the required fire-resistance-rating time period is not reduced. Justify
or provide listing that includes all components.
• Listing provided on 7/A25 for the exterior 1 hour rated wall 720.1 16-1.2
calls for mineral wool insulation. Per IBC 720.1 if the Owner is going to
use fiberglass insulation batts, submit fire test results or other substantiating
data to show that the required fire-resistance-rating time period is not
reduced. (Check the 2006 tables, I believe they added fiberglass and we can
accept the 2006 table as alternative method) Justify or revise.
• Will the shaft enclosure walls (Mechanical chases, Elevator and Elevator
Mechanical room be constructed per the listings on 3/A25 and 7/A25?
• Provide a listed assembly for the Roof/Ceiling of shaft enclosures
(Mechanical chases, Elevator and Elevator Mechanical room)
b. Note: Shaft enclosures are constructed as fire barriers Section 706. Shaft
enclosure walls extend from the top of the floor/ceiling assembly below to the
underside of the floor or roof deck above and are continuous through concealed
spaces per IBC 707.5. The wall is continuous deck to deck. Rated wall or
floor/ceiling assemblies can not be penetrated by non rated walls or non rated
floor/ceilings. Details shown on A10 and A25 do not extend to the underside of
the floor or roof deck above and the roof detail does not extend to the bottom of
the roof deck. Justify or revise.
c. Shaft enclosures for vertical fireplace flues with a fire-resistance rating of 1
hour penetrate the sleeping units floor/ceiling assemblies which have a ½ hour
fire-resistance rating, therefore IBC 712.4.3.1 (refers to non fire-resistance-
rated assemblies) does not apply. Justify or revise. Details and listed
assemblies for compliant construction are required. Fireplace Flues will not be
a shaft enclosure. Fireplace B Vents to be provided with a listed fire-stop
system at the ceiling and at the floor penetration. Submit listed assemblies to be
used. The fireplace enclosure walls are not to penetrate the floor/ceiling
assembly. If they do, equal protection for the walls and supporting construction
will be required.
d. Shaft enclosures are required for stairways that do not meet the exceptions of
IBC 707.2. The stairway from the basement to the main floor lobby area (This
stair is a vertical exit enclosure per IBC 1019 constructed as a fire barrier.
Detail on A16 does not show the fire barrier wall extending to the roof deck.
Justify or revise for compliance with IBC 706.4 Continuity of fire barrier walls),
the stairway from the kitchen to the basement exit access hallway (Agreed that
the Kitchen and main lobby stairs from the basement to the 1st floor are not shaft
enclosures, but both penetrate the horizontal assembly separating the Basement
from the 1st floor. The walls of the stairways to be constructed the same as

horizontal assemble penetrated. Justify or revise), and the accessible ramp to
the Wedding Room (The Basement level has a rated corridor that is continuous
through the ramp. Either provide a separation from the rated corridor or
construct the ramp as the corridor fire barrier. IBC 707.2 #7 Justify or revise)
are all required to be enclosed by a shaft enclosure, constructed as a fire
barrier to separate the basement from the 1st Story. Justify or revise. Details,
listed assemblies and opening protectives per Section 715 are required for
compliant construction.
e. Shaft enclosures with a fire-resistance rating of 1 hour are required for the
elevator shaft and mechanical chase. Details and listed assemblies are
required for compliant construction. Elevator shaft, Elevator mechanical room
and Mechanical Chases are to be constructed as Fire barriers IBC 707. Details
shown on A10, A11 and A25 do not extend to the underside of the floor/ceiling
deck above or terminate at the roof deck per IBC 707.12. Justify or revise.
f. Note: Per Fire Partition Continuity IBC 708.4, fire partitions are to extend
from the top of the floor assembly below to the underside of the floor or roof
deck above or to a fire-resistance-rated floor/ceiling or roof/ceiling assembly.
Rated wall or floor ceiling assemblies can not be penetrated by non rated walls
or floor/ceilings. Details shown on A25 and A29 have walls penetrating the
rated horizontal assembly. Any wall that penetrates a rated assembly is to
afford the same rating as the assembly penetrated. IBC 708.4. Justify or revise.
g. Walls separating sleeping units per IBC 708.3 (2) Fire Partitions are required
to have a ½ hour fire-resistive construction for fully sprinklered VB type of
construction. These walls per IBC 708.4 Continuity, are to extend from the top
of the floor assembly below to the underside of the floor or roof deck above or
to a fire-resistance-rated floor/ceiling or roof/ceiling assembly. Provide details
and listed assemblies for compliant construction. See above questions on
assemblies and compliant construction. Justify or revise.
h. Corridors in R occupancy are to be constructed as Fire Partitions IBC 708.1
(4) and have a fire-resistance rating of ½ hour per Table 1016.1. Provide
details for compliant construction. Provide detail if the corridor ceiling is
constructed as the walls 708.4 (3) or if they will be continuous per 708.4.
Provide detail on opening protectives Section 715 and penetrations Section
712. See 7b above. Justify or revise.
i. Horizontal Assemblies per IBC 711 should read floor/ceiling. Corrected.
j. Horizontal Floor/Ceiling IBC 711.3 assemblies are required to have a
minimum ½ hour fire-resistance rated construction separating dwelling units or
sleeping units for fully sprinklered VB type of construction. Continuity of
Horizontal Assemblies IBC 711.4 requires supporting construction to be
protected to afford the required fire-resistance rating of the horizontal assembly
supported and can not be penetrated by non rated walls. Provide detail and
listed assemblies for compliant construction. See above questions on assemblies
and compliant construction. Justify or revise.
k. Penetrations per IBC 712 should include walls (712.3) and floor/ceiling
penetrations (712.4). Noted on drawings.

l. Provide detail for Opening Protectives Section 715. Opening protectives has
specific requirements for door assemblies in rated assemblies. Submit a door
schedule that addresses all door requirements, including rated door
requirements and door operations per IBC 1008.1.8. Provided door schedule
on A29. Please refer to IBC 715 Opening Protectives and 1008.1.8 Door
Operations. Rated doors are required to be labeled, have rated frame and
hardware.
11. Building Code Analysis – Means of Egress
a. Corridors are listed as not required to be fire rated for group A. Nonseparated
uses per IBC 302.3.1 require all other code requirements to apply to each
portion of the building based on the use of the area, except that the most
restrictive applicable provisions of Chapter 9 shall apply to the nonseparated
uses. Means of Egress and all other code requirements except Chapter 9 is
calculated by the occupancy of the use area. Justify or revise. See above notes
on Basement Corridor.
b. Vertical Exit Enclosures IBC 1019, constructed as fire barriers with a fire-
resistance rating of 1 hour are required for stair from basement to reception
entry. Details for compliant construction including penetrations (1019.2),
ventilation (1019.1.3) and opening protectives (715.3.4 & Table 715.3) are
required. See above notes on stair from Basement to Reception Area.
c. Justify Accessible Ramp from basement to Wedding Room not constructed as a
Shaft Enclosure IBC 707.2? The ramp connects the basement to the Main Level
which is open to the Upper Level. See above notes on continuation of the rated

d. Justify Exterior Exit Access stair from basement to north exit at grade
compliance with IBC 1022.6 (3). Separation from the interior of the building is
not required unless required by 1019.1. Per 1019.1 the basement is required to
be separated from the 2 stories above. Therefore, the exterior stairs have to be
separated as the interior stairs, or provide separation from the interior portions
of the building per IBC 1019.1.4. Justify or revise. A rated fire door was added
to the interior north exit access door. This does not comply in our opinion with
the protection requirements of 1022.6. I have attached a copy of the
commentary for your review. The exterior walls for a distance of 10’, both
horizontally and vertically, surrounding the exit access stair is required to have a
one hour fire-resistance-rating. All window and door openings that fall within
the 10’ distance from the stair edge as well as all window and door openings 10’
above the topmost landing must be protected with a minimum of ¾ hour fire-
resistive-rated opening protectives. Justify or revise.
e. Provide locations and detail for Accessible Means of Egress required per IBC
1007. Where more than one means of egress is required from any accessible

In order to expedite any revisions that may be required I wanted to fax questions for
each sheet as soon as I have them. I have included copies from the 2003 ANSI 117.1
for clarification of what the code requires.
A review will be done on the submitted responses to the questions for this review.
Additional plan review fees will be assessed for items requested at 1st review.
1. Civil Sheet 1 of 1– Exterior Accessibility Dated 02/11/2008
a. Details provided are insufficient:
1. Accessible route (ANSI 117.1 2003, 402) location, dimensions, slope
a. Provide width of accessible route sidewalk shown east side of
building in front of (3) accessible parking spaces. 2.0% slope is
shown at south end. Is the entire sidewalk and porch entry not to
exceed the 2% slope?
b. An accessible route is required from the accessible parking space
shown at the east parking group to the building entrance. Slope on
driveway is shown at 5.16%. This exceeds the allowed 1:20 or 5%
maximum for an accessible route. Justify. The elevation listed at
driveway next to Entry Porch is 305.00. Are you going to need a
curb ramp to get from the driveway to the Porch? If a curb ramp is
going to be provided as noted in Architectural, details including
slope, cross slope, dimensions, and landings are required. See
Attached.
c. Provide elevation of Entry Porch and Entry Vestibule. Architectural
plans show step. These both are required to be on an accessible
route. Threshold maximum is ½”. Will both slabs be at 305.33?
Clarify.
d. Accessible route at Wedding Chapel shows the Wedding Chapel slab
to be at 305.33 and the sidewalk to be at 305? Provide maximum
slope and cross slope if greater than 1:48(2%) around Wedding
Chapel exits. Provide elevation at exits, a landing is required with a
maximum slope and cross slope of 1:48.

A Pre-construction meeting is required prior to permit issuance. The Permit
Applicant or General Contractor is responsible to schedule the Pre-construction meeting.
Town Staff will provide the location and facilitate the meeting. (Claude Traufield 970-
577-3722).
It is recommended all contractors attend; including, but not limited to:
General, Excavating, Infrastructure, Concrete/Masonry, Plumbing, Framing, Mechanical,
Fuel Gas, Electrical, Exterior Flashing/Veneer, Fire Alarm, Sprinkler, Roofing,
Insulation, Drywall, and Fire Stop Systems.
Project Designers and owners are welcome and strongly encouraged to attend.
All parties involved in the project will be accountable for information discussed at the
Pre-construction meeting, whether or not they attend.
Plan Review Comments and Department Policies will be discussed at the Pre-
construction Meeting. The Pre-construction meeting notes identify some important
information on the plans and Town policies. They require no designer/owner response.
However, the Code Review and Plan Review Comments require Designer response and
Town approval prior to permit issuance.
While it is recognized and understood that the final authority for interpretation and
enforcement of the provisions of the building codes rest with the Chief Building Official,
open discussion of differing interpretations is encouraged and welcomed.

contractor when fire-resistive construction is involved. A fire-stop contractor

The site plan sheet 1 of 2, November 14, 2007 by Shear Engineering shows
the Lower Level Slab at 8303.33. The grade around the building is shown at
8305. This is a difference of 1.67 feet. The finished floor surface above the
lower level is shown at 8314.09, which makes it 9.09 feet above the finished
ground level for more than 50% of the building (502 Basement #2). The
grade plane (average grade 6 feet away from the exterior walls) looks to be
the same as 8305 finished ground level, so again the floor above the lower
level would exceed the 6 feet above grade plane (502 Basement #1)
The Architectural Elevations show top of foundation at 3’-0” (2.5’ with 6“to
finished grade). The finished floor surface above the lower level at 9’-6
5/8” would put finished grade at 7’-0 5/8” below that floor. (502 Basement
#2) I would need more contours labeled on the civil to do an accurate grade
plane calculation (502 Basement #1). It looks to me like the plan is to have
the finished grade consistent all around the building.
b. Type VB maximum stories with increase for sprinkler system is 2. Justify

Owner is to submit enlarged floor plan for Kitchen layout. What needs to be
clarified by submitting the enlarged floor plan is the requirement for clearances
to combustibles (stud wall and wood floor/ceiling).
• The Type 1 Hood grease duct enclosure is required to have an 18” clearance
from the duct to the interior surface of enclosures of combustible
construction per IMC 506.3.10. M5.1 Grease Duct /Fan Detail refer to a
shaft enclosure on A-25, which I believe is wood stud construction and
would not be considered noncombustible construction. Also noted is 3’
minimum to 12” Max air gap. This would not comply with the requirement
of IMC 506.3.10. Justify or revise.
• The Type 1 Hood is required to have an 18” clearance from the hood to any
combustible interior surface per IMC 507.9. All surfaces within 18” of the
cooking surface and exhaust hood opening must be smooth, readily
cleanable, noncombustible and nonabsorbent. The note on page M5.1 calls
for a noncombustible wall with stainless steel. Metal studs with gypsum
board meet the exception of IMC 507.9 for the wall if the construction
continues for 18” in all directions from the hood. Provide location of detail
on Architectural plans that show non-combustible construction. This
exception is not applicable to grease ducts IMC 506.3.10. The 18”
clearance is still required for the floor/ceiling combustible construction.
Justify.
