PROJECT DESCRIPTION AND BACKGROUND: The applicant requests a variance to
Section 17.66.190(c) Time Displayed to allow a temporary banner to remain in place
longer than the 28 consecutive days typically allowed. Specifically, the applicant wishes
to display an “OPEN 7AM to 9PM” banner on the side of the restaurant that fronts Park
Lane (see photo next page).
The purpose of this request is to offset the Bond Park construction activity. This activity
includes partial closure of Park Lane, which directly impacts the restaurant.
REVIEW CRITERIA: In accordance with Section 17.66.220(2) of the Estes Park
Municipal Code, in granting any variance, the Review Board shall find that all of the
following conditions exist.
(a) There are special circumstances or conditions, such as the existence of buildings,
topography, vegetation, sign structures or other matters on adjacent lots or within
the adjacent public right-of-way, which would substantially restrict the
effectiveness of the sign in question; provided, however, that such special
circumstances or conditions must be particular to the particular business or
enterprise to which the applicant desires to draw attention and do not apply
generally to all businesses or enterprises.
Staff Comment: Planning Division Staff recommends special circumstances exist.
Specifically, the construction activity associated with Bond Park includes disruption
of the street system in the area, and may lead the public to mistakenly believe the
restaurant is either closed or not accessible.

(b) The variance is in general harmony with the purposes of this Chapter, and
specifically is not injurious to the neighborhood in which the business or enterprise
is located.
Staff Comment: Planning Division Staff suggests the requested variance is not
injurious to the neighborhood.
Specifically, the banner would be removed after construction activity has been
completed.
(c) The variance is the minimum one necessary to permit the applicant to reasonably
draw attention to the business or enterprise.
Staff Comment: The Board should use their best judgment if the variance is the
least amount necessary to alleviate the special circumstances associated with this
property.
PUBLIC COMMENT AND OTHER ISSUES. Staff has not received any public input
regarding this proposal.
FINDINGS:
1. There are special circumstances or conditions which would substantially restrict the
effectiveness of the sign in question, and such conditions are particular to the
particular business or enterprise to which the applicant desires to draw attention
and do not apply generally to all businesses or enterprises.
2. The variance is in general harmony with the purposes of this Chapter, and
specifically is not injurious to the neighborhood in which the business or enterprise
is located.
3. The variance is the minimum one necessary to permit the applicant to reasonably
draw attention to the business or enterprise.
RECOMMENDATION: Approval conditional to:
1. The banner shall be removed within 48 hours of completion of construction activity
associated with the Bond Park Master Plan, Phases I and III.
2. The banner display period shall not be counted toward future banner displays for the
calendar year 2011.
SUGGESTED MOTION: I move APPROVAL of the requested variance with
the findings and conditions recommended by staff.
