PROJECT DESCRIPTION AND BACKGROUND: This is a request for a minor
modification to the 25-foot front and side yard setback standards established for the “E-
1” Estate district. The purpose is to allow a small portion of a proposed addition to
encroach into the front a side yard setbacks.
REVIEW: Staff may grant minor modifications up to a maximum of ten percent (10%)
from yard and building setback requirements, provided that the Staff finds that such
modification advances the goals and purposes of this Code and either results in less visual

impact or more effective environmental or open space preservation, or relieves practical
difficulties in developing a site.
Staff has granted this minor modification request based on the following:
1. The neighbor to the north, where the encroachment is proposed, has written a letter of
support.
2. The Windcliff Architectural Control Committee has written a letter of support.
3. The proposed location would have the least visual impact on the site. An existing
wall encroaches into the setback; the proposed addition would be screened from the
road by this existing wall.
4. The front yard setback encroachment would contain approximately 6 square feet; the
side yard encroachment would contain approximately 38 square feet.
5. The lot is sub-sized for the “E-1” district and the associated 25-foot setback. If the lot
was zoned “E”, which has a minimum lot size of ½ acre, the proposal would meet the
required setbacks.
The following conditions of approval apply:
1. New construction shall be consistent in style, materials, and color of existing cabin.
This should be addressed with the building permit submittal.
2. Prior to pouring foundation, submittal of a setback certificate prepared by a registered
land surveyor.
3. Compliance with the submitted site plan.
4. Exterior lighting shall be shielded and downcast.
5. Failure to apply for a building permit and commence construction within one (1) year
of receiving approval (approval date is January 29, 2004) of the minor modification
shall automatically render the minor modification null and void.
