Larry,
We completed the review for the variance. While there is a good case for a variance, we ran across
plat restrictions that prohibit any construction into the setback area. The attached plat established
a building envelope for numerous lots, including Lot 2. The attached letter goes into more detail.
At this point the only two options appear to be to redesign the site plan or amend the plat of
record.
I would like to refund the fee you paid in full. May I shred the check you provided?
I do recognize that this is not the answer you hoped to receive, but as staff we have no legal
flexibility given the plat restrictions.
