At that time, the Board of Adjustment voted unanimous (4-0, one absent) CONDITIONAL APPROVAL. The conditions of approval are: a. Shall obtain sign permits. This includes compliance with all other applicable standards of the sign code. b. Shall comply with memo from Public Works to Dave Shirk dated May 26, 2006. c. Sign content shall be limited to "300 Riverside", "Crag's Lodge", "The View Restaurant" (or "Golden Eagle Resort"), and a directional arrow. d. Sign size shall not exceed existing sign size. e. Shall obtain approval from the Public Works Director no later than October 31, 2006. If written approval has not been obtained from the Public Works Director by October 31, 2006, the sign shall be removed immediately. Special circumstances exist. 3. The property may continue to be used for its historic use. 4. The Applicant's predicament could be mitigated through some method other than a variance. 5. The character of the neighborhood would not change. 6. The Board should use their best judgment if the requested variance is substantial. 7. The Board should use their judgment if the requested variance represents the least deviation that would afford relief 8. The applicant has owned the property since before the adoption of the EVDC. 9. This request has been submitted to all applicable reviewing agency staff for consideration and comment. No significant issues or concerns were expressed by reviewing staff relative to code compliance or the provision of public services. 10. The variance would not adversely affect the delivery of public services such as water and sewer. 11. The submitted conditions or circumstances affecting the property are not of so general or recurrent a nature as to make reasonably practicable the formulation of a general regulation for such conditions or situations. 12. Approval of this variance would not result in an increase in the number of lots beyond the number otherwise permitted for the total subdivision, pursuant to the applicable zone district regulations. 13. Approval of this variance would not allow a use not permitted, or a use expressly or by implication prohibited under the terms of this Code for the zone district containing the property for which the variance is sought; Therefore, Staff recommends APPROVAL of the requested variance to allow an off -premise sign CONDITIONAL TO: a.
