Colorado 80517.
This is a petition for a variance of the Zoning Ordinance. It must be on file at the office
of the Building Inspector, Town of Estes Park; 10 days before any meeting of the Board of
Adjustment.
A $25.00 (twenty-five dollar) fee to cover costs of processing appeals and requests for
variances shall be paid to the Town Clerk prior to any hearing.
The Petitioner or Representative should be present at the meeting.
All variances granted by the Board of Adjustment shall become null and void if a building
permit has not been issued and paid for and work thereunder commenced within four months
from the date the variance was granted.

Statementof why it is not_:Practicableto =comply xv1 th the' `ordinance:
I have been notified .that I -must remove the cedar fence -that I erec-:
ted on the property 'at #343 Virginia Drive, Estes Park, Colorado,...
because it intrudes fifteen.feet - into the Street Right of Way (ROW).
I was unknowingly -in error when I built the fence into the ROW,- but
I now request a,variance of the.Zoning Ordinance -on the following `.,
grounds:
The_yard -at #343:V7irginia Dr. extends from the -house, north ,to the
pavement edge Of theroadway. -The yard terminates' at that point
with" a rock retaining wall approximately.3i feet high. -The:yard'is
"`level With the top of. the retaining wall. The fence in question ex
-tends to that retaining wall.-
The yard and retaining wall halve been as,is !for• th,enty years
that I have resided in Estes Park. Both are certainly an: intrusion:
into the ROW, yet neither seem to have caused -a problem to date.
The same could be said" for the property on thelS E corner of"Vir-
ginia Dr. and Pig Horn Dr. The barbed wire fence and small shed
along the Virginia Dr. frontage-bothappear to me'to' 'be in the ROW:
. Both the fence and the shed have likewise'been,in"pl'ace-for. at least
20 years. -
I'm sure that"even'had I looked at my property survey plat Prior. to
`building the -fence, -and had noticed the location of. the ROW, that -
-` it still"would.have appeared. reasonable and prudent to build' the'
fence -to the.retaining wall, based.. on the historical longe•
vity of.

Additionally; 'I think` the reasons that, I .built: the
tant*factors. in' -my request for a variance
Since purchasing-: Tract A and 'B, of :the-: N.W..portion of Lot 5, Block
10, I have gone to great time and expense in trying,to improve the
condition and appearance of those properties. The fence in question
is partof-that attempt to enhance the appearance of my property
and of the neighborhood: I; feel",that"if I :take_ :community Pride-.in.my
property, that others in the immediate area might follow suit. If
that were done, the neighborhood might become more than the "Hippie
Hill" or "Dog Haven" that it now seems to be.
