The BOARD OF ADJUSTMENT meets at 8:00 A.M. on the first TUESDAY of each month
(as needed), in the Board Room (Room 103) of the Municipal Building.
This is a petition for a variance of the zoning ordinance. It must be on file
at the office of the Building Official, Town of Estes Park, twenty-one (21) days
prior to the Board of Adjustment meeting. A $50 fee to cover cost of processing
appeals and requests for variances shall accompany the application. Checks
should be made payable to TOWN OF ESTES PARR.
All variances granted by the Board of Adjustment shall become null and void if
a building permit has not been issued and paid for, and work thereunder
commenced within four months from the date the variance is granted.
It is understood that only those points specifically mentioned are affected by

Specific Variance Desired: 17.20.040.2a Setback requirement of 25' is requested to be reduced
to 5' to allow the existing shed to remain, and to allow construction of a building
addition within 20' of the property line.

SUBJECT: Rains Ford Variance Request

This application is for two separate requests and should be
considered and acted upon separately.
1. The first request is to allow for a new building
addition of 5,250 sq. ft., with a setback of 20',
compared to the required 25'. The 20' setback
would match the setback of the existing main
building.
2. The second request is to maintain a "shed" which
has a setback of approximately 6' from the south
property line. The addition is approximately 620
sq. ft., and is used for auto service/detailing.
There are also above ground used oil tanks on both
the west and east ends of this addition.
It is my understanding that the Town's previous
building inspector advised the owner of the permit
and setback requirements when this addition was first
being built. This addition was built without a
building permit, with no plan examination, with no
record of the builder and with no inspections by the

Town's Building Inspector. A Certificate of
Occupancy has not been issued for this addition.
The addition also encroaches into a public utility
easement.
According to the applicant, this addition has not
caused any problems. However, there are potential
hazards to the public health, safety and welfare.
For example, Building Inspector Allman has noted
the exterior walls of the building do not meet
Building Code fire resistance requirements.
This building addition was built with disregard for
the Town's Building Code and Zoning Ordinance. In
my opinion the variance for this addition should be
denied.
