This is a petition for a variance of the zoning ordinance. It must be on file at the
office of the Building Inspector, Town of Estes Park, 10 days before any meeting of the
Board of Adjustment.
A $7.50 (seven dollars and 50 cents) fee to cover costs of processing appeals and requests
'for variances shall be paid to the Town Clerk prior to any hearing.

SUBJECT: Nelson Petition for Variance from Sign Code
I have reviewed the letter dated June 14, 1984 from Greg
White regarding freestanding signs on the Timberline
property. In order to process the variance request, the
following information needs to be included on the appli-
cation:
1. Sign area of existing freestanding sign.
2. Sign area of proposed freestanding sign.
When this has been provided, a hearing date may be scheduled.

This memo is written pursuant to your request that
I review the situation regarding the request filed by
businesses on the Timberline property for a joint identi-
fication sign. This opinion is based on the following:
a. The Timberline Restaurant is located on two lots,
being Lots 1 and 31 of Whiteview Addition.
b. The premises has (1) street frontage of less than
500 feet.
c. The Timberline has an existing freestanding sign
for the restaurant.
d. The request filed with the Town is for an additional
joint identification freestanding sign.
Section 17.66.300 (7)(b) provides that where a free-
standing joint identification sign is used to identify tenants
in a single building or a business or industrial complex, there
shall be no other freestanding signs permitted on the premises.
This Section prohibits the erection of a freestanding joint
identification sign where a freestanding sign is already in
existence on the premises. The Section allows another joint
identification freestanding sign if the street frontage is over
five hundred feet which is not the case in this matter. It is
my opinion that the request for a joint identification free-
standing sign by those businesses in the Timerline complex
cannot be permitted under this Section of the Code.

Section 17.66.290 CD) provides that the total allowable
sign area of all signs on any lot cannot exceed one hundred
fifty square feet. Section 17.66.340 (f) provides that the
Board of Adjustment cannot grant a variance for maximum sign
area on a lot. Therefore, it is my opinion that the Board
of Adjustment has the power to grant a variance for an
additional freestanding joint identification sign on Timberline
property but does not have the power to grant said variance if
the total sign area of both the present freestanding sign and
the proposed joint identification sign exceeds one hundred fifty
square feet.
