The BOARD OF ADJUSTMENT meets at 8:00 a.m. on the first Tuesday of each month
(as needed), in the Board Room (Room 103) of the Municipal Building.
This is a petition for a variance of the zoning ordinance. It must be on
file at the Office of the Building Official, Town of Estes Park, twenty-one
(21) days prior to the Board of Adjustment meeting. A $50 fee to cover cost
of processing appeals and requests for variances shall accompany the
application. Checks should be made payable to TOWN OF ESTES PARK.
All variances granted by the Board of Adjustment shall become null and void
if a Building Permit has not been issued and paid for, and work thereunder
commenced with four (4) months from the date the variance is granted. It is
understood that only those points specifically mentioned are affected by
action taken on this appeal. The Petitioner or Representative should be
present at the Board of Adjustment meeting.
Your Application must include a site plan, drawn at a scale of 1" = 20' and
include the following: Property lines with dimensions, all structures,
trees, rock outcroppings on the lot, topography, edge of street traveled way,
adjacent structures within 100' of the lot boundaries, and any other
pertinent information.

MEMORANDUM
August 28, 1997

SUBJECT: Variance Request Stanley Village Safeway
When Stanley Village was approved by the Estes Park Urban Renewal Authority, building
envelopes were established for each building area. These envelopes also established
building setbacks.
The building envelope for the Safeway building was approved with a 10' setback from the
Highway 34 by-pass R-O-W line. This 10' setback also met the then applicable zoning
setback requirements.
It is staffs opinion that the approved 10' setback is the controlling requirement in this case,
as that reflects an approved building envelope.
This request is to extend a portion of a new enclosed warehouse area into this 10' setback.
The encroachment is in a triangular configuration, with a setback of 3.2' at the narrowest
point (north) and extending approximately 36' to the south, where the 10' setback is again
met. The encroachment into the 10' setback represents about 130 sq. ft. of building area.
STAFF RECOMMENDATION
It is staffs opinion that the encroachment is minor in nature, and that the benefits of
enclosing the storage area outweigh the setback encroachment, in this case.
A cross-section drawing has been provided by the Applicant.
Any roof equipment must be screened, and be non -reflective. Finished floor elevation and
building height should also be indicated on the Site Plan.

This Memorandum will summarize the conclusions of our meeting on July 1, 1997.
1. Safeway is proposing a 10,500 sq. ft. expansion.
2. Stanley Village Cinemas is proposing a 1,526 sq. ft. expansion.
3. Stanley Village has one undeveloped building envelope, east of the fountain.
4. Park National Bank has two undeveloped building envelopes totaling 14,000 sq. ft.
(one envelope of 2,000 sq. ft. east of the Bank, and 12,000 sq. ft. west of the bank).
EXISTING CONDITIONS
1. Stanley Village was originally approved by EPURA for construction of a gross floor
area of 160,000 sq. ft.
2. Approved parking ratio was 3.75 spaces per 1,000 sq. ft. (600 spaces). Built
parking, according to the developer is 721 spaces.

3. 136,624 sq. ft. has been built.
4. The remaining allowable square footage for Stanley Village is as follows:
160,000 - Approved
136,624 - Built
23,376 - Not Built
14,000 - Less Park National Bank
9,376 - Net Remaining for Stanley Village
5. Stanley Village Subdivision is 15.26 acres, or 664,725 sq.ft.
• Lot 1: 1.34 acres
• Lot 2: 13.92 acres
6. The Town's Zoning Ordinance provides:
• Gross Floor Area (GFA) shall not exceed 25% of lot area.
• GFA, for coverage purposes, does not include areas that are more than 50%
below grade.
• For parking purposes, however, parking requirements are 1 space per 200 sq.
ft. GFA, including both above grade and below grade floor areas.
ASSUMPTIONS
1. Of the 136,624 sq ft that has been built, 23,000 sq. ft. has some portion below grade.
Assume 50%, or 11,500 sq. ft., and less 1,440 sq. ft. on the bank lot, for a net of
10,060 sq. ft.
2. Development Calculation for Stanley Village Lot (excluding PNB Lot). Park
National Bank has been excluded from the following calculation because it is now
under separate ownership.
9,376 - remaining
+10,100 - Credit for assumed floor area >50% below grade
19,476 - Available with assumed credit
-10,500 - Proposed Safeway expansion
- 1,526 - Proposed Stanley Village Cinemas expansion
7,430 - Net available for remaining Stanley Village envelope east
of fountain area
This floor area calculation is based on the assumption that the developer can provide the
required parking, as set forth below. Also, there is no implied waiver of setback requirements.

3. Parking Calculation and Requirements
1. 1 space/200 sq. ft., retail/office.
2. 1 space/2.5 seats seating capacity, restaurants and theaters.
3. Shared parking may be allowed for mixed uses with staggered hours. This
may be applicable for the theater.
4. The developer needs to provide seating capacity information for the
restaurant (including outdoor seating) and theater uses.
OTHER
1. The building height of new Safeway expansion should not exceed current building
height.

RE: Safeway variance request

Stanley Commercial Development and Safeway are trying to alleviate some of
the current congestion and frustration associated with the current store by
adding 11,000 sq. ft., or about one third of the present size, to the existing retail
area. Part of the problem is with the service and stocking area. The sales
volume of the present store is such that the current service area can not hold
one day's stock. Presently, trucks and outside storage are being used, which
cause separate problems. After the store is expanded, the stocking problem will
amplify, which is why we are requesting to enlarge this portion of the store. This
is the only location which can accommodate this function and the requested
dimensions are minimal.
The intent of the regulation is being met as there is still 40 feet of landscaping
and walkway between the building and the traveled way. Stanley Commercial is
the only owner in the Urban Renewal District that has been required to beautify
and maintain the public R.O.W.
