DISCUSSION: In December 1985, the Larimer County Board of County
Commissioners entered into an agreement with Mr. Frank Williams. Mr. Williams
had been issued a building permit for the construction of a storage building with a
front yard setback of 73-feet from the centerline of Highway 66. At that time, the
setback was 100-feet, thus the permit was issued in error. Mr. Williams
subsequently converted the storage building into four dwellings, without a building
permit.
The agreement established that the portion of the building located within the
required setback be used only for storage, whereas that portion of the building that
met the structure could contain a manager’s quarters; this document runs with the
land.
The current owner wishes to sever this agreement in order to convert the existing
building into a four-plex unit. The property is now zoned “A” Accommodations,
and has a setback requirement of 25-feet from the property line. The proposed land
use, density, and existing building location meet the requirements of the EVDC.
STAFF RECOMMENDATION: Approval of this request to vacate the existing
agreement between Mr. Frank Williams and the Larimer County Board of County
Commissioners.
