Matzk e~~66.- Date: January 8,2002 Re: Light and Power Policy and Procedure Manual Line Extension Policy Five Year Contract Changes BACKGROUND: The Light and Power Department has traditionally made available a five year line extension contract for residential services where the cost per service connection will exceed $500. The contract provides a credit of 20% of the customer's annual electric cost for each year o f the contract up to the contract amount. The contract also provides for a prorated refund of a portion of the contract amount if a portion of the extension is used to serve other customers during the contract period. The Light and Power Department would like to make a five year contract available for commercial extensions under the following conditions: 1. Extension cost must exceed $1000 per connection 2. Instead of prorated refund, new connections would be included in the 20% annual credit. 3. Total credit will not exceed original contract amount. The Light and Power Department would like to make a five year contract available for service upgrades under the same conditions except that the 20% credit would be determined by subtracting the base electrical cost from the electric cost each year of the contract. The base electric cost would be the total electric costs on the existing service the twelve months immediately preceding the contract date. On the following pages are the revisions to the Light and Power Department Policy and Procedure Manual reflecting the proposed changes. BUDGET/COST: There have been a total of 31 commercial line extensions exceeding $1,000 since January 1997. This would have been an average impact to electric revenues of $27,175 per year during that period. RECOMMENDATION: The Light and Power Department requests consideration of the Five Year Contract Plan in the Policy and Procedure Manual as proposed. REM 1-1 Service Extension; Five Year Contract (a) The Five Year Contract Plan is a construction deposit, applicable to all line extensions for residential services where the cost of the construction per service connection will exceed five hundred dollars ($500.00), where service capacity is available for extensions of the Department's established electric distribution system. where the use of energy is indeterminate or seasonal. The five vear contract plan is also available to line extensions for commercial service where the cost of construction per service connection will exceed $1000. (b) The applicant will agree: (1) To use the electric service requested and to pay the Town for service in accordance with the schedule of rates under the applicable rules and regulations; (2) To pay the Town at the time of executing the extension contract a cash fund to be known as an "advance in aid of construction" iii an amount equal to one hundred percent (100%) of the extension cost, including meters, transformers and protective equipment allocated to the applicant; (3) To advise the Town in writing of any proposed assignment of the extension contract, giving the name and address of the assignee, and to obtain the Town's approval before assignment is made; (4) To waive all right to further rebate of the construction deposit balance which may remain unrefunded after the extension is declared "closed" by the Town; and (5) To execute the Town's right-of-way agreement granting, free of charge to the Town, such rights-of-way across the applicant's premises as may be required for poles, anchors and other construction work necessary for rendering the service requested. (c) The Town will agree: (1) Upon acceptance of the extension contract by an authorized agent of the Town, to construct the required electric line facilities with reasonable promptness, to furnish the necessary meters, transformers and protective equipment, and to take title to the entire investment; (2) To notify the applicant when service is available and supply the service requested under the rate schedule applicable. (d) Disposition of the construction deposit shall be as follows: 1-2 (1) Refund of a portion or all of the applicant's construction deposit will be made for a period not exceeding five (5) years from date of service, on the following basis: twenty percent (20%) of the amount paid annually by the applicant for electric service from . the extension will be set up as a credit to the applicanfs account following each subsequent anniversary dabe of the contract and (2) The total credit to the applicant shall not exceed the total amount of the construction deposit (e) Service to New Customers from Original Extension (1) In the event the Town furnishes electric service to new residential customers utilizing any porti „................................ on of a residential extension, during the term of the contract the Town will reimburse the customer a prorated amount of the original contract amount for the portion of this extension utilized to service additional customers. The original contract amount will be reduced by the amount of the reimbursement (2) In the event the Town furnishes electric service to new customers utilizing any portion of a commercial extension during the term of the contract the Town will include the billing for the new account with the billing for the existing account(s) when determining the 20% annual credit For commercial accounts, the Town would not reimburse a prorated amount of the original contract. 00 Service Upgrades When an existing customer performs a service upgrade that requires construction that meets the criteria for the Five Year Contract Plan, then that construction cost may be placed on a five year contract For service upgrades the 20% credit would be determined by subtracting the base electrical cost from the electric cost each year of the contract The base electric cost would be the total electric costs on the existing service the twelve months immediately preceding the contract date. 1-3 TOWN OF ESTES PARK Office Memorandum To: The Honorable Mayor Baudek and Board of Trustees From: Richard E. Matzke-*25,4/ Date: January 9,2002 Re: Black Canyon Loop Subdivision Trenching Contract Approve Change Order Request BACKGROUND: The Black Canyon Subdivision Loop Trenching contract was awarded to Duell Excavating in November 2001 for an estimated cost of $15,261. The original contract included 1700' of trenching and conduit installation. The actual length of the project as built was 1815'. The Town has received a change order request of $1,015.45 from Duell Excavating to cover the cost ofthe additional trench at the unit cost included in the original contract (115' @ $8.83 per foot) BUDGET/COST: The 2001 budget included $85,000 for the Black Canyon Loop project. Finance Officer Pete Brandjord has recommended that this change order be charged to 2001 business. RECOMMENDATION: The additional trenching was required to complete the project and the work was performed at the Department's request.
