Matzke-7129» Date: April 10,2001 Re: Prospect Mountain Cross Year Round Lighting Proposal BACKGROUND: The Light and Power Department has received an offer from a group of customers to pay the annual cost to light and maintain the cross on Prospect Mountain. The Department has traditionally (beginning in 1967) lit the cross for the Christmas holiday season and Easter weekend. We have received much correspondence along with many letters to the newspapers on the subject. In addition, Town staff have received numerous phone calls. I am aware of one person in addition to the group that made the original proposal who has expressed support for year round lighting ofthe cross. BUDGET/COST: The customer group has offered to pay all costs associated with the proposal so in theory there would be no budget impact. Our preliminary estimate of the annual cost is $4700. However this would create an ongoing maintenance commitment that would divert personnel and equipment from our core mission ofproviding timely and reliable electric service. RECOMMENDATION: The Light and Power Depanment is not in favor ofthis proposal. We believe this activity would detract from the job we should be doing. There seems to be a consensus of opposition to this proposal, including the owner ofthe propeny where the cross is located. The Light and Power Department requests that the Town consider thanking the proponents for their offer, but respectfully decline. REM 1-1 Memo Date: April 10, 2001 TO: Light and Power Committee From: Gregory A. White A-·0- 4 I RE: CROSS ON PROSPECT MOUNTAIN Background: I have been requested to render a legal opinion with regard to the legality of the Town participating in the display of the cross that is located on Prospect Mountain and currently lit during the Christmas and Easter seasons. My opinion is based upon the following factual information: • The Prospect Mountain cross is property of the Town. • The cross is located on private property. The Town has no lease for the use of the property but has received permission for use of the property. • The Town maintains the cross and provides the supply of power for lighting of the cross. • Town funds are used for maintenance of the cross and the supplying of the power. • The cross has historically been lit from the Friday after Thanksgiving through the New Years weekend and over the Easter weekend. • At the time of writing this legal opinion, I have no information on the installation of the cross including date and who installed the cross. • The Town has received a request to consider the lighting of the cross during the entire year with private funds paying for the necessary power. Legal Perspective: The United States Constitution (Amendment 1) and the Colorado Constitution (Article 2, Section 4), prohibit the government, including the Town of Estes Park, from preferring one religious domination over another or preferring religion over non-religion or vice versa. The 1-2 free exercise and enjoyment of religious profession and worship, without discrimination, is guaranteed to all citizens including the forbidding of official actions that signify official endorsement or exclusion based on religious beliefs. The Courts have historically wrestled with what type of government action or inaction violates the United States Constitution and the corresponding Colorado Constitutional provisions. Recently, in the case of the State of Colorado v. The Freedom from Religion Foundation, Inc. 898 P2d. 1013 (Colo. 1995), the Colorado Supreme Court issued a lengthy opinion summarizing both Colorado cases and United States Supreme Court cases involving government display of religious symbols as they relate to the aforementioned constitutional provisions. This case involved a monument in Civic Center in downtown Denver which contained the Ten Commandments. The monument was a small monument located inconspicuously amongst other larger monuments and contained not only the Ten Commandments but also Jewish, Christian and secular symbols on the monument. The monument was a gift to the State of Colorado from a non-profit secular organization. In this Colorado Supreme Court case, the Court did state that the proper method of reviewing these matters is as follows: "The primary way in which Courts have determined the effect of the government action is by focusing on the content of the display and the context in which the questionable object appears. For example, in Allegheny County, (Allegheny County v. American Civil Liberations Union, 492 U.S. 573 (1989)), the Court examined two displays of public property in downtown Pittsburgh, one of a creche standing alone in a courthouse staircase and one of a menorah displayed as part of a larger winter holiday exhibit in the front of the City/County building. The crache used words in its portrayal of the nativity scene·-the angel in the cr*che said "Glory to God in the Highest!" By contrast, the menorah was part of a winter holiday exhibit which included a sign with the words, "Salute to Liberty" placed below a Christmas tree. The Court found that the crache display violated the Establishment Clause and the menorah display did not. In evaluating both the content and context of the crache display, the Supreme Court noted that the crache sets an unmistakable religious message, praising God in Christian terms... The Court also noted the physical setting and location of the crache, concluding that it "stands alone;": It is the single element of the display on the grand staircase...The menorah display, on the other hand was a part of a holiday season display which saluted liberty; the Court found that the context of the entire display neutralized the religious dimensions of the display...; the Court also noted, however, that the menorah is a symbol of a holiday that like Christmas, has both religious and secular dimensions. The Court held that since the menorah stood next to a Christmas tree and a sign saluting liberty, it created an overall holiday setting." The Colorado Supreme Court ruled that the monument, because of the content and context of the display did not violate the above cited constitutional provisions. 1-3 In reviewing the legal question of the Town's participation in the display of the cross it is necessary to review the content and the context of the display. My review is as follows: Content of the Display: 1. The cross is a lighted Christian symbol which is located on Prospect Mountain by itself. It is not a part of a larger overall holiday display. I note that the Town does have religious symbols as part of its overall Christmas lighting program. However, these Christian symbols are located amidst other secular symbols in the Town's overall Christmas holiday setting. 2. The cross is a Christian symbol and not an overall religious symbol. Context of the Display 1. The lighting of the cross at Easter is used primarily to endorse a particular religious holiday. As discussed in the other cases, a reasonable observer might fairly understand that the primary message of the lighting of the cross on Easter is an endorsement of the Christian Easter holiday and therefore, the lighted cross does convey primarily a religious message. 2. The lighting of the cross at Christmas is a part of the Town's Christmas holiday display program. However, the location of the cross on Prospect Mountain away from other secular displays emphasizes the religious nature of the cross rather than being a part of an overall holiday display. Summary: Based upon the above quoted Colorado case and the content and context of the display of the cross, it is my opinion that participation of the Town in the lighting of the cross on Prospect Mountain, is a violation of the Colorado and United States Constitutions, namely Amendment 1 of the United States Constitution, and Article 2, Section 4 of the Colorado Constitution. This opinion includes Town participation in the display of the cross during the Christmas season, the Easter weekend and during any other part of the year. 1-4 TOWN OF ESTES PARK Office Memorandum To: The Honorable Mayor Baudek and Board of Trustees From: Richard E. Matzke-*,Za- Date: April 11, 2001 Re: Stanley Village Streetscape Award Trenching Contract BACKGROUND: The Estes Park Urban Renewal Authority (EPURA) has agreed to fund streetscape improvements on the west side of Stanley Village Shopping Center, including nine decorative street lights and outlets for Christmas lighting in the trees along the existing sidewalk. The Light and Power Department has received a proposal to install conduits, junction boxes, and to furnish and install street light bases for this project from Duell Excavating at an estimated cost of $4850. BUDGET/COST: EPURA has agreed to fund the cost of installing the trench for this project. RECOMMENDATION: The Light and Power Department recommends that the trenching contract for the Stanley Village Streetscape project be awarded to Duell Excavating. Matzke 72 6/2,- Date: April 11, 2001 Re: Rocky Mountain National Park Underground Tuxedo Park Award Trenching Contract BACKGROUND: The Town has an ongoing program with the National Park Service to rebuild the electric system in Rocky Mountain National Park. The subject project is to replace approximately 1300' of aged three-phase overhead primary with underground in Tuxedo Park The Light and Power Department received quotes from three contractors to install one 4" conduit the length ofthe project. The low bid was for $15,250 from A-1 Excavating. BUDGET/COST: The total estimated cost of this project including Light and Power Department material, labor, and equipment is $30,000. All costs will be reimbursed by the National Park Service. This project is not specifically funded in the 2001 budget, so budget amendment may be required later this year if all capital projects come in close to budget. .RECOMMENDATION: The Light and Power Department recommends that the Tuxedo Park trenching project be awarded to A-1 Excavating at an estimated cost of $15,250. Matzke 72.Ze- Date: April 11, 2001 Re: Fall River Hydro Plant Award Contract for Site Development Design BACKGROUND: The Light and Power Department has received a scope of work from Mundus Bishop Design to complete construction documentation for the Fall River Hydro Museum site and landscape areas and to provide construction administration services. The preliminary construction package prepared by Mundus Bishop Design and dated December 15, 1999 are estimated to be 80 to 85% complete. BUDGET/COST: The estimated cost by Mundus Bishop Design to complete the scope ofwork is $5,840. The 2001 budget includes $140,000 for the Fall River Hydro Restoration project. We do not anticipate using any State Historical Grant funding for this portion ofthe project. RECOMMENDATION: The Light and Power Department recommends that the contract for the completion ofthe Fall River Hydro landscape design and construction administration be awarded to Mundus Bishop Design at an estimated cost of $5,840. Customer concerned about a power Mike Mangelsen has contacted the customer several line that runs diagonally across their times and is continuing to work with them to resolve property. She has written the Town and the issue satisfactorily. has yet to receive a reply.
