Matzke-72.2/2- Date: January 9, 2001 Re: Fall River Hydro Plant Historic Restoration Contract Change Order Request No. 10 and 11 BACKGROUND: The Town negotiated a contract amount of $388,688 with R.C. Heath Construction Company for the historic restoration of the Fall River Hydro Plant, operator's residence, and visitor's center. The contract was awarded in June of 2000. In December 2000, change order requests were approved amending the total contract amount to $420,422. We have received the following change order requests from R.C. Heath: NO. 10 Trim corner ofPlant addition, grout slab seam, $1,375 construct bases for ETS heaters 11 Delete slab for stack, delete paint & install (6,200) Stack, delete paint cottage roof The work deleted on request No 11 is anticipated to be included in a future negotiated contract with R.C. Heath to be performed when the weather improves. BUDGET/COST: The total estimated project cost is $568,815, which includes a construction estimate of $410,000. These change order requests reduce the contract amount to $415,597. -RECOMMENDATION: The Light and Power Department recommends that these change order requests resulting in a $4,825 reduction be approved. Matzke --71 259- Date: January 9, 2001 Re: Fall River Hydro Plant Interpretive Exhibit Contract BACKGROUND: The Light and Power Department has received a revised contract proposal from Chad DeVore, of the Resource Connection to design and furnish the interpretive exhibits for the Fall River Hydro Power Plant Museum for a cost of $119,194. The original contract for $110,000 was approved in August 2000. The Town has been invoiced for $8,789.33 on the original contract. This invoice has been paid and is credited toward the new contract total amount. We stopped work on the original contract at the request of the State Historical Commission to comply with their grant funding requirements. The new contract includes an additional $9,194 for a kiosk and other work not included in the original scope. BUDGET/COST: The total cost ofthe Fall River Project, including interpretation is $568,815. The anticipated budget for interpretation was $125,000. The 2001 budget includes $140,000 for the Fall River Hydro project. RECOMMENDATION: The Light and Power Department recommends that the revised interpretive exhibit contract be awarded to The Resource Connection for an estimated cost of $119,174. REM 2-1

4 ./ FOR IMMEDIATE RELEASE MEDIA CONTACT: Jim Van Someren January 10, 2001 303/452- 6111 CRAIG STATION OWNERS, SIERRA CLUB REACH SETTLEMENT AGREEMENT The five utilities that own Craig Station - the largest coal-fired electric generation facility in Colorado - and the Sierra Club announced today the two sides have reached a settlement agreement in a case originally filed against the utilities in 1996. Under the agreement, certain upgrades will be made to Units 1 and 2 at the power plant over the next four years and the pending lawsuit will be dismissed. "We've reached what we think is a 'forward-looking' solution," said Frank Knutson, executive vice president and general manager of Tri-State Generation and Transmission Association, 24 percent owner of the two units and operating agent of the power plant. "Craig Station has been, and will continue to be, a vital generation resource in this region. Even though we have never received a notice of [emissions] violation from either the State of Colorado or from the Environmental Protection Agency, we feel these investments and enhancements will further solidify the plant's long-term value as a " reliable source ofelectric power as well as resolve a number of environmental concerns. Parties to the agreement have described it as a "global settlement," as it addresses several separate, yet related issues, including opacity affected by the release of particulate matter, and visibility impairment and acid deposition in the Mt. Zirkel Wilderness Area. Over the next four years, both units will be retrofitted with baghouse technology, which acts like a giant vacuum cleaner in removing palticulate matter from the emissions. Also, upgrades will be made to the units' existing boiler systems and scrubber equipment to further reduce oxides of nitrogen (NOx) and sulfur dioxide (SOD from the flue gases. Initial engineering/design estimates indicate the capital cost for the project to be approximately $100 million, which will be divided among the five participant utilities according to their respective ownership shares. -more-
4.- In its suit, the Sierra Club had claimed a number of alleged opacity violations occurred between 1991 and 1996. However, no notice of violation or penalty for exceedances had ever been levied against the utilities by any regulatory agency. "Tri-State and our partners at Craig Station feel we've always acted in good faith to meet the requirements spelled out in the various permits under which we operate," Knutson said. "That's not to say we're not always looking to improve our performance and efficiencies. Our goal is to continually produce the most reliable and economical power in the most responsible way possible." The Craig Station owners and the Colorado Department ofPublic Health and Environment (Air Pollution Control Division) also have developed and entered into a separate voluntary emissions reduction agreement, which is supported by the U. S. Environmental Protection Agency, the U. S. Forest Service and the National Park Service. Although they were not active participants in the lawsuit nor party to the settlement agreement, these agencies have endorsed the "global settlement" arrangement and the numerous issues addressed in it. Along with Tri-State (24%), the owner-participants of Craig Station Units 1 and 2 are Salt River Project of Phoenix, Ariz., (29%), PacifiCorp of Portland, Ore., (19.3%), Platte River Power Authority of Fort Collins, Colo,, (18°/0) and Xcel Energy (Public Service Co. of Colorado) ofDenver (9.7%). Original construction of Craig Station Units 1 and 2 - both of which generate 428 megawatts of electricity - began in 1974, and came on line in 1980 and 1979, respectively. ###
