INTER-OFFICE MEMORANDUM MARCH 30,1999 TO: RICHARD MATZICE / LIGHT & POWER COMMITTEE FROM: DAVE MAHANY SUBJECT: REPLACEMENT OF PICKUP (933.17) BACKGROUND: Presently this 1987 Chevrolet pickup with 93,000 miles is being used by The Light and Power Department for field work. This pickup is scheduled for replace due to age and mileage. This vehicle qualifies for replacement in accordance with the Town's Vehicle Replacement Policy. We would like to replace it with a more versatile vehicle, a Jeep Cherokee that can be used for line locating personnel (able to keep locating equipment inside out of the weather) and also can be used for training trips. COSTS: Bids were requested from three Jeep Dealers. RAINS MOTOR COMPANY: $ 20,912.00 - $ 3.200.00 933.17 TRADE-IN $ 17,712.00 TOTAL COST FOOTHILL AUTO PLAZA: NO RESPONSE POLLARD MOTORS: NO RESPONSE The 1999 Light & Power Department budget includes $24,000.00 for pickup replacement. RECOMMENDATION: Staff is requesting and recommending approval to purchase a new Jeep Cherokee (Replacing the 1987 pickup) from Rains Motor Company at a cost of $17,712.00. 1-1

Matzke -jt 2-91- Date: April 7, 1999 Re: Big Thompson Three Phase Conversion (Long Range Plan) Approve Engineering Scope of Services BACKGROUND: The Big Thompson Three Phase Conversion project was recommended in the Long Range Plan prepared by Electrical Systems Consultants (ESC). The project was recommended in two phases. Attached are excerpts from the Long Range Plan detailing the justification for the project. The total project involves replacing approximately 3 miles of single phase overhead copper with three phase 1/0 awg tree cable beginning at Mall Road and continuing east generally along Highway 34. BUDGET/COST: The Light and Power Department requested $200,333 in the 1999 budget for construction of phase one which consists of 1.5 miles beginning at Mall Road. ESC has prepared a proposal to perform the engineering and line design for both phases at an estimated cost of $50,250. The preliminary engineering estimates are $277,500 to complete phase one and $225,000 to complete phase two. After the line design is complete, a determination can be made regarding what portion of the total project will be feasible to complete in 1999. RECOMMENDATION: The Light and Power Department recommends that ESC be hired to perform the engineering and line design for both phases ofthe Big Thompson Three Phase Conversion project at an estimated cost of $50,250. Big Thompson Three Phase Conversion Project Phase One (Years One through Five) For the most part, the Big Thompson Circuit should be able to provide adequate service during the projected peak load of 2.6 MW with two notable exceptions. These exceptions include the heavily loaded single phase lines which serve the Big Thompson Canyon and the Retreat area near Glen Haven. Both lines currently serve over 150 consumers. An ampere meter was connected to the Big Thompson Canyon tap during a portion of January 1996. The weather during this period was cold but not extreme. The meter measured a peak load of 49 amps. The voltage drop calculations show that the peak load will be over 50 amps with a the total voltage drop of 9.0 volts. Since both of these conditions violate the system design criteria, it is recommended that the 1.3 miles of single phase #6 Copper line between node numbers BT116 and BT122 be rebuilt using three phase 1/0 ACSR construction. This improvement reduces the total voltage drop to the acceptable level of 5.0 volts. Construction of this line will be difficult due to the narrow confines of the canyon, the high density of development and angular nature of the right-of-way. It is, therefore, estimated that the cost per mile of this line conversion project will be $100,000 which corresponds to a total project cost of $130,000. Phase Two (Years Six through Ten) Both of the distribution line improvement projects are located on the Big Thompson Circuit. The first improvement is located in the Big Thompson Canyon. It is an extension of a line improvement project from the Five Year Transition. The single-phase #6 Copper line between node numbers BT122 and BT124 (1.3 miles) is to be replaced with a three-phase 1/0 ACSR overhead line. The intent of this project is to reduce voltage drop and excessive single-phase loading by converting this line section to three-phase. The computer circuit calculations indicate that 7.3 volts drop will occur at the extremity of this tap if action is not taken. As with the line improvement located immediately upline, this improvement will be costly due to the narrow confines of the canyon, the high density of development and angular nature of the right of way. The same cost per mile estimate will, therefore, be used. This cost estimate is $100,000 per mile which corresponds to a total project cost of $130,000. 2-2

Matzke-72 Z:o- Date: April 7, 1999 Re: Adopt 1999 National Electrical Code Schedule for Adoption BACKGROUND: The Town has traditionally adopted by reference the updated National Electric Code (NEC) published by the National Fire Protection Association every three years, as it becomes available. In this manner, the NEC becomes the standard for residential, commercial, and industrial electrical installations within the city limits. The proposed ordinance for adoption is on the following page. BUDGET/COST: The anticipated budget impact is the cost of publishing the notices of the public hearing RECOMMENDATION: The Light and Power Department recommends that the 1999 edition of the NEC be adopted by the Town Board, The Light and Power Department requests that the proposed ordinance be introduced at the April 13, 1999 meeting of the Town Board at that a public hearing be set for the May 11 Town Board meeting to consider adoption ofthe ordinance. . ORDINANCE NO. AN ORDINANCE ADOPTING, BY REFERENCE, THE NATIONAL ELECTRIC CODE, 1999 EDITION WHEREAS, the Board of Trustees of the Town of Estes Park, Colorado has determined that it is in the best interest of the Town to adopt the National Electric Code, 1999 Edition. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: Section 1. Section 14.20 of the Municipal Code is hereby adopted as follows: 14.20.010 National Electric Code, 1999, Adopted. The National Electric Code, 1999 Edition, issued by the National Fire Protection Association, Inc., Batterymarch Park, Quincy, MA 02269, is enacted and adopted by reference as a primary code and incorporated in this chapter. 14.20.015 National Electric Code, 1999-Violation. A. It is unlawful for any person to violate any of the provisions stated or adopted in the National Electric Code, 1999 Edition. B. Every person convicted of a violation of any provision stated or adopted in the National Electric Code, 1999 Edition, shall be punished as set forth in Section 1.20.020 of the Municipal Code. 14.20.017 Damages. Neither the Town's Building Inspector, Town Engineer, Light and Power Director, nor any other employee or agent of the Town of Estes Park, nor any volunteer acting on behalf of the Town, shall be liable for any damages for any act and/or omission by such person, pursuant to the duties and enforcement of the provisions of the National Electric Code, 1999 Edition. 14.20.020 License-Required. It is unlawful for any person to engage in the business of installation, altering or repairing electrical wiring in the Town without first having procured a license therefore from the State. The requirement for a license shall not apply to the owner of any property doing work in or about his own residence, provided that he first obtains the necessary permit therefor. The requirement for a license shall not apply to a joumeyman electridan or helper who is working under the control and supervision of an electrician licensed by the State. 14.20.040 Permit-Application-Issuance. Application for permit shall be made to the Colorado State Electrical Board. Such permit shall be posted on the site of the work, and kept there until the work is completed. 3-2
14.20.060 Certificate of approval required. It is unlawful for any person to make any electrical connection to any building until the State Electrical Inspector has issued a certificate approving the electrical wiring. 14.20.070 Permit-Temporarv. Where, from good and suffident cause, it is necessary to have electricity on any installation before the final certificate can be issued, the State Electrical Inspector may issue a temporary permit; provided, that all parts to which current is applied are in a safe and satisfactory condition. 14.20.080 Electrical construction requirements. All new structures and existing structures that are altered, added to or repaired in excess of fifty percent (50%), and which contain, in whole or in part, commerdal uses, shall be entirely wired in rigid or steel tube conduits or approved metal raceways. Unless it is otherwise required by applicable provisions of the National Electric Code, 1999 Edition, the requirements of this section do not apply to a freestanding commerdal structure served by one electric meter located in the Town's commercial outlying (CO) zone. Section 2. The adoption of this Ordinance shall take effect and be enforced thirty (30) days after its adoption and publication. Monte L Vavra, Finance Officer RE: Commercial waiver of Eledric Service Deposit History: On October 08, 1998 the Light & Power approved a policy change to allow a waiver of the electric service deposit if the following five guidelines are met: 1) The Responsible party must have at least five (5) years of good pay history for other commercial accounts. A good pay history is defined as two of less disconned notices and/or two of less returned checks during this time period. 2) The responsible billing party's name must be the same as the account referred to in Item 1 listed above. 3) The waiver of commercial deposits will only be allowed for accounts that would require a deposit of $1,000 or less. 4) Restaurants and lodging accounts will be exduded from this deposit waiver policy and be required to submit a deposit. 5) If two or more notices of discontinuance and/or returned checks are received on this account in any twelve month period, the Town has the option to require a cash deposit At the time the policy was adopted the Light & Power Committed requested additional information on why item #4 was included. The thought at the time was to protect the L&P Department from any possible losses from the restaurant and lodging business in the event of non-payment. Upon review this dause does appear as being overkill considering the other four criteria is not fair to the possible restaurant and lodging businesses. Recomrnendation: The L&P Committe amend the waiver of commercial electric service deposit policy by striking Mem #4. 4-1

Matzke 72 23»· Date: April 7, 1999 Re: Light and Power Department Policy and Procedure Manual Residential Deposit Polcy-Utility Letter of Credit BACKGROUND: It has been standard practice for many electric utilities to accept a letter of credit from other electric utilities in lieu of deposit for residential customers with good payment history. The Town has furnished letters of credit to other utilities for customers leaving our area but has never accepted letters of credit from other utilities, although we have had many new customers request this service. Attached is a proposed change to our Policy and Procedure Manual, which would include Utility Letters of Credit as an acceptable form of deposit for residential customers. (Sec. 1) BUDGET/COST: There should be no budget impact since electric deposits are refunded with good payment history. RECOMMENDATION: This deposit policy change would bring our deposit policy more in line with industry practice and make application for new electric service more customer friendly. The Light and Power Department recommends that the deposit policy be changed as discussed. REM 4-2
(d) Interest Accrued on Deposits: All cash deposits retained by the Town will accrue interest at the rate set by the Colorado Public Utilities Commission (PUC). The rate will be adjusted as of January 1st of each year to comply with the current PUC rate. Accrued interest will be disbursed when the deposit is refunded to the customer. (e) Refund of Deposits: Electric utility deposits will be refunded along with accrued interest at the end of the deposit term if the customer has demonstrated a good payment history. A good payment history is defined as no more than two Notices of Discontinuation of Selvice mailed out in the twelve preceding months. This applies for both residential and commercial customer accounts. If a deposit is not refunded at the end of the two or three- year period because the customer did not establish a good payment history, then the accounts will be periodically reviewed by the department and a refund will be made once the refund criteria are met. (f) Deposits will also be refunded to the customer at the time that service is taken out of their name. The amount of the deposit plus interest accrued will be applied to any unpaid balance on the account at the time the account is finalized, with the remaining amount refunded to the customer. (g) Re-deposit: Customers who have had their deposits refunded for a good payment history could be required to submit another deposit in the event that they receive two or more Notices of Discontinuance of Service within any twelve-month period. The amount of deposit would coincide with the requirements in effect at that particular time. (h) Transfer of Deposits: A deposit can be transferred when a customer moves from one location to another. If the deposit for the second location is a different amount from the first location, the customer will be obligated to pay the difference or the Town will refund the difference to the customer. (i) Deposits Not Applied to Regular Bill Payments: The deposit amount will not be applied to the regular monthly bills. Deposits will be held for face value until customers meet the required time period or the deposit has been used to clear final balances if the customer closes their account. 0) Subject to Disconnection for Non-Payment of Monthly Billing: All accounts are subject to disconnection if payment is not received by the utility. If a deposit is held by the Town, it will not be applied to the account unless the account is being taken out of the customer's name. 00 Subject to Disconnection for Non-Payment of Deposit: An account will be disconnected if the deposit is not paid to the Town within the time requested. (1) Acceptable Forms of Deposit: For residential accounts - cash, check, an approved Residential Accounts Responsibility Form (see page 9.1), or a credit reference letter from another U.S. electric utility will be accepted. The credit reference must meet or exceed the Town's requirements for refund of a residential deposit. For commercial accounts - cash, check, or an Irrevocable Letter of Credit issued by a financial institution will be accepted. The Town does not accept credit reference letters issued from other utilities in lieu of a deposit for commercial accounts. 4-3

Matzk€778/7- Date: April 7, 1999 Re: WindcliffUnderground Rehabilitation Authorization to Execute Trenching Contract BACKGROUND: Windcliff Subdivision is in the process of upgrading their private water system which has presented the Light and Power Department with the opportunity to install conduits in a common trench and install some additional trench and conduit at reduced cost. We have received a proposal from Lyons Excavating to install 1400' of 4" PVC conduit at a cost of $3.00 per foot. Lyons Excavating has also proposed to install an additional 750' of 4" conduit at a cost of $14.48 per foot. This conduit will allows us to install a loop feed in Windcliff which is presently fed from radial underground lines, most ofwhich are direct buried. BUDGET/COST: The total cost of the contract is $15,060, however we have committed to $4,200 for the joint trench portion. The 1999 Light and Power budget includes $17,500 for small underground projects, which would be used to fund this contract. RECOMMENDATION: The Light and Power Department recommends that the proposal from Lyons Excavating be accepted for a cost not to exceed $15,060. REM 5-1

Colo.-Residents of Estes Park, Fort Collins, Longmont, and Loveland can meet finalists who are under consideration for the position of general manager of Platte River Power Authority at an open house Thursday evening, April 8. The gathering will be at Platte River's headquarters at Timberline and Horsetooth Rds. in southeast Fort Collins between 4:30 and 7 p.m. The fi ve finalists are Burnett Adams. president of Energy Dynamics, Inc., of Middleton, Wisconsin; Mike Dahl. division manager of power system operations at Platte River; Brian Moeck, Loveland city manager; Roy Rohia. plant manager at Platte River: and Kevin Wailes, general manager of electric operations in Tallahassee, Florida. They will be interviewed by the Platte River Board of Directors on Friday, April 9. A decision is expected early the following week. Platte River Power Authority is a public power utility with facilities primarily located along the Front Range of northern Colorado. Platte River provides wholesale electricity and support services to its owner cities of Estes Park, Fort Collins, Longmont, and Loveland, and to other utilities and businesses in the western United States. -30- -,1
