Matzke'~2-Zoz- Date: October 7, 1998 Re: Light and Power Department Policy and Procedure Manual Proposed Additions BACKGROUND: The Town has traditionally accepted a third party responsibility form in lieu of a residential deposit. The previous form provided no limit of liability for the party accepting responsibility for an electric account or limit ofterm. The proposed form limits the responsible party's liability to twice the normally required residential deposit for that electric account. The new form also has space for the responsible party to set an expiration date for the agreement. Residential electric customers with a good payment history for the past two years are not required to pay a deposit when requesting a new residential service. The Light and Power Department would like to extend this practice to commercial customers. The attached Policy Guidelines for Waiving A Commercial Electric Service Deposit outline the proposed conditions for waiving a commercial deposit. Finally, the Light and Power Department would make the residential budget billing plan available to commercial customers. Also, the Light and Power Department recommends changing the calculation ofthe monthly billing amount from one tenth ofthe past twelve months total bills to the monthly average ofthe past twelve months bills plus five per cent. BUDGET/COST: The Light and Power Department does not anticipate any impact on the annual budget. RECOMMENDATION: The Light and Power Department recommends that the proposed additions to the Policy and Procedure Manual be adopted. REM 1-1 RESIDENTIAL ACCOUNTS RESPONSIBILITY FORMS An established utility customer with a good pay history can assume responsibility for payment of another residential customer's account. This is usually done to assist the second party avoid the utility deposit required ofnew customers to the system and those who have had service in their name before but have been inactive for a period of six months or more. The Town ofEstes Park offers this as a service to our customers that do not have an established credit record with the utility. The responsible party will need to be a customer of the Town for at least two years with an established good pay history. The person that signs the responsibility form assumes a liability for unpaid electric bills in the amount of two times (2X) the original amount of deposit required; $370 for an electrically heated home, $150 for a non-electric heated home. The responsible party can designate a time period that they are assuming the responsibility for, however, upon the expiration date ifthe utility deposit requirements are met, no deposit will be required. Ifthe expiration date is less than 2 years, a deposit will be required. If the customer moves to another address, the responsibility form becomes null and void and a new form will need to be completed for the new address or a cash deposit will be required. During the period of time that the responsibility form is in effect, normal billing collection and discontinuance policies apply. The only time the party that signs the responsibility form should be affected would be when the billing party would no longer have the account in their name and have an outstanding balance. Customer 1-2 POLICY GUIDELINES FOR WAIVING A COMMERCIAL ELECTRIC SERVICE DEPOSIT Under the following circumstances the Light and Power Department has the authority to waive the deposit requirement for a new commercial account: 1. The responsible party must have at least five (5) years ofgood pay history for other commercial accounts. A good pay history is defined as 2 or less disconnect notices and/or 2 or less returned checks during this time period. 2. The responsible billing party's name must be the same as the account referred to in item number one listed above. 3. The waiver of commercial deposits will only be allowed for accounts that would require a deposit of $1,000 or less. 4. Restaurants and lodging accounts will be excluded from this deposit waiver policy and be required to submit a deposit. 5. Such discretionary audit may be called fur at any time and for any reason from the effective date of this Contract until three (3) years after the date final payment for this Project is received by the Contractor provided that the audit is performed at 3 unie convenient to the Contractor and during regular business hours. 10. PARTIES RELATIONSHIP: THE CONTRACTOR IS A GRANTEE AND NOT AN EMPLOYEEOR AGENT OF rHE STATE. REPORTS: The Contractorshall deliver to the State .98/9 Financial Reports (Attachment I) documenting che progress of the Project, and the Project Summary Report (Attachment 2), as described in the List of Product Submitials (Exhibit B). The Contractor further agrees that reports are to be Completed on State provided forms (Attachments 1-3). Failure to meet the report deadlines may result in termination of the Contract. 16. MATCHING FUNDS: The Contractor agrees to make available the necessary funds rn complete the Project and provide matching funds. i f applicable, in accordance with rhe Project Budget as set forth in Exhibit C. In the event that said matching funds become unavailable, the stute may, in its sole discretion, reduce its total funding commitment to the Project in proportion to the reduction in matching funds. PUBLIC ACKNOWLEDGEMENT OF FUNDING SOURCE: When issuing press releases, official statements, or documents that describe the project funded by the State Historical F und grants program, and iii all publications and materials produced in other media funded under this Contract, a credit line must be included that reads: "Thig project is/was paid for in part by a State Historical Fund grant from tile Colorado Historical Society." In addirion, the Society reserves the right to require that the following sentence be included iii any produc[ funded through this program: "The contents and opinions contained herein do not necessarily retled the views or policies ofthe Colorado Historical Society". In that event, all finished or unfinished documents, data. studies. surveys, drawings, maps. models, phocographs, products and reports or other material prepared by the Contractor under this Contract shall, at the uprion of the State. become its propcrly, and lhc Contractor shall be entitled to receive just and equitable coinpensation for any smisfactory work compleled on such documents and other materials. If this Contract is terminated due to the fault of the Contractor, Paragraph 21 hereof relative to termination shall apply. 23 CHANGES.
