HomeMy WebLinkAboutVARIANCE Horse 2300 S Saint Vrain Ave 1993-04-07BOARD OF ADJUSTMJMNT The BOARD OF ADJUSTMENT meets at 9:00 A.M. on the first Wednesday of each month (as needed), in the Board Room (Room 103) of the Municipal Building. This is a petition for a variance of the zoning ordinance. It must be on file at the office of the Building Official, Town of Estes Park, twenty- one (21) days prior to the Board of Adjustment meeting. A Fifty Dollar ($50.00) fee to cover cost of processing appeals and requests for variances shall accompany the application. Checks should be made payable to TOWN OF ESTES PARK. All variances granted by the Board of Adjustment shall become null and void if a building permit has not been issued and paid for, and work thereunder commenced within four months from the date the variance is granted. It is understood that only those points specifically mentioned are affected by action taken on this appeal. The Petitioner or Representative should be present at the Board of Adjustment meeting. Reason for varience request - Estate zoning requires 5 acres for the keeping of horses on property. Subject lot has 4.833 acres. Reasons for varience to be granted- (1) Acreage very close to requirement. (2) Neighborhood warrants this type use. Horses are or have been kept on surrounding properties. (3) Said property currently has structure and fencing to house horses and has been used for keeping horses in the not to distant past. Leonard - Variance Request Title 7 of the Municipal Code provides that in the the E-Estate District, a landowner may maintain horses provided the minimum lot area is five acres and the number of horses does not exceed four. If the Board of Adjustment were to grant a variance, I would suggest conditions be added as follows: 1. Variance granted to the petitioner and not extended to future purchasers. 2. Number of horses limited to one. All other requirements for location of fencing, corral/stable, etc. be met. SLS:cj BRADFORD PUBLISHING CO. RECORD OF PROCEEDINGS Board of Adjustment April 7, 1993 Board: Chairman Habecker, Members Dekker, Newsom, and Sager Attending: Chairman Habecker, Members Dekker, Newsom, and Sager Also Attending: Building Official Allman, Deputy Clerk Kuehl Absent: None Chairman Habecker called the meeting to order at 9:00 a.m. APPROVAL OF MINUTES Minutes of the meeting held January 6, 1993, were approved as submitted. ARAPAHO MEADOWS ADDITION, TRACT 3, ANN L. LEONARD/PETITIONER - VARIANCE REQUEST TO MAINTAIN A HORSE ON LESS THAN 5 ACRES Applicant is requesting variance from Section 7.08.070(1), pertaining to minimum lot size to maintain a horse. The Municipal Code states that in the E-Estate District, a landowner may maintain horses provided the minimum lot area is five acres and the number of horses does not exceed four. Building Official Allman noted that subject lot size is 4.833 acres and the property is located in an area where there are other horses. Letters were sent to all adjacent property owners and no responses were received. Applicant Leonard stated she presently owns only one horse and will own only one horse in the future. She further explained her intentions for changes on the property which included building a half acre corral and removing the fence surrounding the property. It was moved and seconded (Sager -Dekker) that the variance be granted with the following stipulations, and it passed unanimously: 1. Variance granted to the petitioner and not extended to future purchasers. 2. Number of horses limited to one. 3. All other requirements for location of fencing, corral/stable, etc., be met.
