0n this date the First Baptist Church of Estes Park filed a
petition for a variance requesting relief from section
17.72.070 of the Estes Park Municipal Code which limits
height of a building to thirty (30) feet. We are asking for
a variance of eight (8) feet and four (4) inches from the
height limit of thirty (30) feet in order to allow a church
cross to be placed on the face of the chimney. The church
structure itself does not require a variance of its height,
as its height is within that allowed by the Municipal Code.
As stated in the petition for a variance, architecturally the
cross on a church is common as the symbol of the Christian
faith. Such cross identifies and sets apart a church from
schools and commercial structures. The cross needs to be
above the building height in order to be clearly seen. The
cross will be located at the lowest (downgrade) corner of
the structure. It will not be a solid mass and will not ob-
struct the view of neighbors. It is also significant to note
that the horizontal distance (or width) of the church cross is
only one and one-half percent of the total exterior horizontal
measurement of the building.

Address all communications to the Building Inspector, Post Office Box 1200, Estes Park,
Colorado 80517.
This is a petition for a variance of the Zoning Ordinance. It must be on file at the office
of the Building Inspector, Town of Estes Park; 10 days before any meeting of the Board of
Adjustment.
A $25.00 (twenty-five dollar) fee to cover costs of processing appeals and requests for
variances shall be paid to the Town Clerk prior to any hearing. Previously paid.
The Petitioner or Representative should be present at the meeting.
All variances granted by the Board of Adjustment shall become null and void if a building
permit has not been issued and paid for and work thereunder commenced within four months
from the date the variance was granted.

Specific Variance Desired: Relief from section 17.72.070 of the E.P. Municipal Code
which limits height of a building to thirty (30) feet. We are asking for a variance of eight (8)
feet and four (4) inches from the height limit of thirty (30) feet to the top of our church crosE
which we wish to place on the face of the Chimney. These averages based upon definition of
building height as set forth in section 17.08.060 of the EP Municipal Code. See enclosed prints
for elevations and schedule B for detailed calculations.

INTERPRETATION OF CONFLICTING PROVISIONS OF THE SIGN CODE:
Mr. David Solder, representing Park Renaissance Development
Corporation, appeared before the Board to request an interpretation
of the Sign Code, Section 17.66.190 (B15) concerning off premises
signs, which conflicts with Section 17.66.250 (1B) concerning
construction signs. Town Administrator Hill stated that the staff
worked with the Town Attorney add that Section 17.66.070 which
states when "Respective provisions differ, the provisions containing
the more restrictive requirements will apply". Member Sager moved
that the more restrictive portion of the Sign Code (Section 17.66.250
(1B) be applied. Member Wood seconded the motion and it passed
unanimoulsy. Member Al Sager then moved that the conflict in the
Sign Code be resolved by the Board of Trustees. Member Margaret
Houston seconded the motion and it passed unanimously.
OLSON - SIGN VARIANCES (2) - EIKER'S MOTEL:
Mr. Aldon Olson presented his requests for two sign variances on
his property located at 175 Spruce Drive. The first request Mr.
Olson presented was a variance to allow for a "side yard" sign to
be located by his pool- The sign would be nonconforming because
the Municipal Code allows free-standing signs in the front yard
only. A lengthy discussion followed. Member Al Sager moved that
the sign be allowed in the "side yard", a minimum of 8 feet and
a maximum of 15 feet from the front property line between the pool
fence and driveway. Member Jerry Lamson seconded the motion and
it passed unanimously. Mr. Olson then requested a 15 foot variance
for a free-standing sign. Mr. Olson contended that Eiker's Motel
does not have adequate visibility from West Elkhorn Avenue and he
feels he needs the additional height so that his sign can be seen.
Mr. Phil Ramsey spoke in opposition to the 15 foot height variance.
Member Jerry Lamson moved that the 15 foot variance be granted.
Member Margaret Houston seconded the motion. Those voting "Yes"
Members Lamson and Houston. Those voting "No" Members Sager, War,fler,

The Board c: considered a recuest from the First Baptist
Church of Estes Park to allow an additional height variance of
feet 4 inches from the height limit of 30 feet, in order to allow
a church cross to be placed on the face of the chimney. Yr. John
Montgomery, representing the First Baptist Church, explained the
crass needs to be above the building height in order to be clearly
seen. Correspondence was received from Werner Diebel in opposition
to the variance. Member Richard Wood moved that the variance be
granted. Member Al Sager seconded the motion and it passed
unanimously.
