Notice is hereby given, based on observations during site inspections on January 27, 2010 that a condition at 900
Moraine Avenue is in violation of the Estes Park Municipal Code. Staff has spoken to Scott and advised him that
this Notice of Violation would be forthcoming.
It is a violation of Estes Park Municipal Code Section 8.04.010 to store, keep or deposit the Other Side Restaurant
sign, its concrete encased wood post and the rusty conduit at the perimeter of the lower south parking lot.
It is your responsibility to correct all violations on your property. In accordance with the agreement reached by
phone between Scott Webermeire and Inspector Traufield you are afforded a period of fifteen (15) days from the
date of the receipt of the notice in which to correct the alleged violation before further enforcement action shall be
taken.
Section 8.04.010 and a photo have been included for your review.
Notice is hereby given that any person having legal interest in the subject property may appeal any Notice, Order,
decision, determination or other action made by the Code Compliance Officer. Said appeal shall be to the Board
of Adjustment, in writing, and filed with the Director of Community Development, within 30 days from the date
of service of such Notice. Failure to appeal shall constitute a waiver of all rights to an administrative hearing and
determination of this matter. Your cooperation in resolving this matter is greatly appreciated. Staff is available to

8.04.010 Keeping of waste material
prohibited.
(a) It is unlawful to deposit, accumulate, store, keep, abandon or to allow the deposit, accumulation,
storage, keeping or abandonment of waste material, including but not limited to, garbage, rubbish, trash,
waste metal, waste paper products, waste lumber, discarded building materials, discarded furniture or
furnishings, abandoned or inoperable vehicles, abandoned or discarded machinery or machinery parts,
feces or debris on private or public property within the Town; provided, however, that this provision
shall not apply if the same is stored or collected in conjunction with a business enterprise lawfully
situated and licensed for such storage or collection.
(b) The deposit, accumulation, storage, keeping, abandonment of any of the types of waste material or
debris described in Subsection (a) above, or the allowance or granting of permission to do the same, on
public or private property within the Town is declared to be a nuisance and to be detrimental to the health,
safety, convenience an.d general welfare of the citizens. (c) Any law enforcement, community service or
code enforcement officer is authorized to investigate any matter at any place within the Town which
reasonably appears to be in violation of the provisions of this chapter. (Ord. 15- 97, 1997)
