As there were no persons speaking on behalf of the above-mentioned plat, Mayor Dekker declared the public hearing closed. 8. Amended Plat of Lot 1, Prosser Subdivision, 1421 S. St. Vrain Ave., Anthony Paglia/Applicant - Continue to April 13,1999. Trustee Baudek drew the Special Transit item under the Senior Center from the Consent Calendar for further discussion. Trustee Barker reported that Steve Blackshire/Special Transit attended a public information meeting at the Senior Center February 24th and subsequent appearance at the Community Development Committee. Mr. Blackshire is proposing a transit service to the community at 2 days/week. The well-maintained vehicles are ADA accessible; Special Transit receives a federally-funded grant of $14,500; the Town is being requested to match Special Transit's funding of $7,250; Special Transit intends to provide limited rides this year at their expense; and the Community Development Committee supported the concept and is recommending the Town Board allocate $7,250.00 in Year 2000. The Senior Center has given their overwhelming support to this service. It was moved and seconded (Hix/Doylen) the consent calendar, as amended, be approved, and it passed unanimously. - It was moved and seconded (HiWMarshall) the Town Board amend the Year 2000 Budget to fund a Town match of $7,250 for Special Transit, and it passed unanimously. Town Administrator Widmer noted that the Conference Center HVAC issue was tabled to allow staff an opportunity to explore another option. 2. ACTION ITEMS: ' p i Board of Trustees - March 9 1999 - Page 3 1. Amended Plat and Development Agreement for Lots 32 - 35 and .. Portions of Lots 1,31 and 37, White Meadow View Place Addition, JANCO Properties of Estes Park/Applicants (employee housing and hiqhwav intersection). Mayor Dekker announced that the Amended Plat would be continued to March 23, 1999; however, the proposed Development Agreement would be reviewed. Town Administrator Widmer summarized the primary points of the Development Agreement: • The Town will have an option to purchase the right-of-way on the north side of Stanley Ave. at Hwy. 7 for $85,000, with $10,000 to be paid on or before April 1, 1999. The remainder is due on or before January 10, 2001. When the Town exercises this option, the owners would have six months to remove the structures. If the Town does not exercise the option, the $10,000 would be forfeited. If the Town exercises the option, the Town would deed the right-of- way on the south side of the street to the owners. • The owners can construct replacements for the structures to be removed, subject to the Board of Adjustment approval dated February 9, 1999. • If the option is exercised, the Town would be responsible for widening Stanley Ave. before January 10, 2002. All widening costs would be borne by the Town. • All dwelling units on the property are required to be low-income rents at the 50% level for at least ten years. The owner has requested a financial subsidy of $25,000/yr. for five years to upgrade the properties for year-round usage. The payment is made after a report on occOpancy and upgrades for the previous year and a budget for the upgrading for the coming year is submitted. The requested subsidy is much lower than that given to Marys Lake Lodge in 1993, especially when the year-round usage is considered. The agreement includes a provision that if the property is sold after five years, the Town's subsidy would be repaid, with interest, at a prorated percentage. Town Administrator Widmer noted that the JANCO principles (Kinnie and Hanks) were in attendance and available to answer questions. Town Attorney White further clarified all four points described above. Trustee Baudek requested clarification between affordable and employee housing rental rates. Town Administrator Widmer referred to the pro-posed rental schedule, adding that according to HUD Guidelines, rents for this project are not as high as they could be. Staff also assured the Board that the vast majority of units will be utilized for employee housing. 1 0 , , 1 Board of Trustees - March 9 1999 - Page 4 Lon Kinney stated JANCO intends to rent units on a first come-first served basis, and the Report of Occupancy required in the Development Agreement will identify renters for Town-monitoring purposes. Trustee Doylen noted that due to fair housing guidelines, renters cannot be discriminated against; however, this proposal does lend itself to employee housing situations. Mr. Kinney confirmed JANCO's desire is to provide affordable housing, particularly for employees. Mr. Kinney confirmed that where possible, employer contracts will be executed. In response to Trustee Baudek, Town Administrator Widmer advised that the $25,000 budget amount was not project specific, however, the Board's intent was to "assist in a housing project." In response to various Trustee questions, Mr. Kinnie reported that (l) JANCO will require damage deposits to maintain the interior; (2) Bill Hanks will be the managing director; (3) JANCO will be responsible for exterior maintenance and landscaping; and (4) JANCO will attempt to ensure vehicles are licensed to the renter. Mr. Kinnie questioned whether conditional approval could be granted in lieu of continuing the plat until March 23rd. Town Attorney White confirmed, and Community Development Director Stamey agreed, that due to continuing lienholder negotiations, it is premature for the-Town - Board to proceed at this time. Mayor Dekker stated that the Town is fortunate to receive this type of proposal; ncluded in the proposal is much-needed intersection improvements; the land purchase price is reasonable; an opportunity has been presented that facilitates Town assistance in housing; and the Development Agreement protects the Town and assists owners. Due to Mr. Kinnie's concern with delaying approval at this time, Mayor Dekker assured him that with the discussion held during the meeting, it appears the Town Board favors the proposal as presented. Planning Commission Chairman Sager questioned why the conditional approval of the amended plat by the Planning Commission was not reviewed. Town Attorney White advised that the amended plat is being continued to March 23rd, the public hearing would be conducted at that time. Discussion during this meeting was being limited to the Development Agreement proposal. George Hockman questioned why the rent guarantee was limited to ten years, and Attorney White replied the 10-year periods are contained in the Municipal Code; however, staff is reviewing the 10-yr. time periods in the new Development Code. No further action was taken on this item. 2. Pedersen Addition Annexation, 798 Concord Ln., Dean & Glenda Pedersen/Applicants. Mayor Dekker opened the public hearing, and Community Development Director Stamey stated that the request is to annex a 2.1 acre site located at 798 Concord Ln. The primary purpose of the annexation is to provide for Town water service to a 1 . 1 L Board of Trustees - March 9 1999 - Page 6 $16,414.00 for the ADA Restroom Facility be awarded to M.J. Aldrich Builders, and it passed unanimously.. B. Electrical Work - Update. To facilitate Use of the first floor of Stanley HaIJ this sumnier, electric work previously approved, will restart. Recessed lighting for. the assembly hall will be ·installed as well as a fire alarm·system. The underground service to the building will be activated and the transformer placed behind the building. This work will be completed by the end of May. Contracts with Estes Valley Electric and Walt Steige and Associates have been previously approved. C. The Marketing Bill has passed in the Senate, and State Representative Kaufman is sponsoring the Bill in the House. Town Administrator Widmer noted the excellent assistance provided the State legislators and CML. Following completion of all agenda items, Mayor Dekker adjourned · the meeting at 7:50 p.m. Robert L. The Planning Commission- recommended approval with E-Estate zoning, and the Planning Commission recommendation for modifications to the plat have been incorporated. Town Attorney White read Annexation Resolution #6-99, Annexation Ordinance #1-99, and Zoning Ordinance #2-99. As there were no public comments, Mayor Dekker closed the public hearing. It was moved and seconded (Hix/Doylen) the Annexation Resolution #6-99 be approved, and it passed unanimously. Estes Park Planning Commission - Resignation. Mayor Dekker announced the resignation of Mark Brown from the Estes Park Planning Commission; the resignation is effective immediately. It was moved and seconded (HiWJeffrey) the Board of Trustees accept Mr. Brown's resignation, and it passed unanimously. Planning Commission Chairman Sager stated that Mr. Brown replaced Margaret Houston as a Planning Commissioner in April, 1984. During the past fifteen years, Mr. Brown has been a dedicated,- thoughtful " " and fair Commissioner, and with the exception of the past three years, his attendance has been most envious. For the record and on behalf of all the Planning Commissioners Mr. Brown has worked with, the Planning Commission appreciates all his efforts and they regret Mr. Brown's resignation - he'll be missed. 3. TOWN ADMINISTRATOR'S REPORT: 1. Stanley Hall Renovation Project: A. Contract Award for ADA Restroom Facility, M.J. Aldrich Builders, $16,414.00. In a memorandum dated March 3, 1999, EPURA Director Anderson reported that under the Colorado Historical Society grant, a unisex ADA restroom will. be installed bn the first floor. The existing men's restroom will be gutted and new walls constructed, new ADA fixtures installed, and the historic nature of the room retained. Replicated woodwork details and the existing doors will be refurbished and reused. The contract amount Of $16,414.00 is below the estimate submitted on the grant application. The area has been inspected by the Town's Building Official, and Director Anderson negotiated a . contract with Aldrich. Stanley Associates havE requested use of the building as a backup facility -for outside events. Staff confirmed that Town functions receive scheduling precedence. RECORD OF PROCEEDINGS Light and Power Committee March 11,1999 Committee: Chairman Hix, Trustees Barker and Jeffrey Attending: All Also Attending: Town Administrator Widmer, Light and Power Director Matzke, Assistant to the Light and Power Director Mpngelsen, Deputy Clerk van Deutekom Chairman Hix called the meeting to order at 8:00 a.m. Electric Utilitv Deposit Policy for Short Term Rental Properties - Approval Request Director Matzke reported that the Town Board reaffirmed the definition of Commercial Electric Customers as "any dwelling or accommodation unit or units which are rented for a period of less than thirty days during any portion of a calendar.year." The Board concluded that short-term rental properties are included in this definition and thus must be billed at commercial electric rates. A question was raised during the February Light and Power Committee meeting concerning the Town's deposit policy and how it would be applied to long-term renters of a commercial short-term property who place the electric account in their own name. The Committee directed staff to further review the Town's deposit policy. Director Matzke presented the amended policycontaining a new paragraph entitled short-term rental deposits. Under the proposed policy, short-term rental properties would be subject to the standard commercial deposit, however, individuals who rent these properties for periods exceeding thirty days and place the account in their own name, would be charged the applicable residential deposit. The Committee recommends the short-term rental deposit policy be adopted and included in the Light and Power Policy and Procedure Manual as presented. Light and Power Revenue Bond Issue Included in the 2000 budget under the Light and Power Fund was the sale of $3 million in revenue bonds to cover relocation and other associated project costs to relocate the Estes Park 4. i ,., Substation, Platte River Power Authority (PRPA) is participating in this endeavor, fronting much of the cost by contracting with vendors and other contractors. At completion in early 2000, Piatte River will turn the project over to the Town, along with approximately $3 million in related costs; $2 millioh from Platte River and $1 from the Town. The Town will issue bonds to cover these expenses. Director Matzke reported that Jim Manire of James Capital Advisors (financial advisor) and Diane Barrett of Holme Roberts & Owen (bond attorney) have previously worked with the Town and can assist in the bond process. Town Attorney White reviewed the agreement from James Capital Advisors for $6,000 (plus any travel and other out-of-pocket expenses) and also recommended retaining Holme, Roberts and Owen for a fee range of $25,000 to $35,000, both of which will be paid from the bond proceeds. The Committee recommends approval of the agreements with James Capital Advisors and Holme Roberts & Owen as presented. 1998-1999 Christmas Decorations installation Contract Change Order - Request Approval Director Matzke reported that in September 1998, the Light and Power Department awarded the 1998-1999 Christmas Decorations Installation Contract to Rocky Mountain Lawn Care. At the department's request, the contractor installed additional twinkle lights on trees along Elkhorn Avenue, repaired electrical outlets, and performed other miscellaneous repairs. The Light and Power Department received a change order request in the amount of $7,492.16 for the additional work performed. The Committee recommends approval of the change order as stated. RECORD OF PROCEEDINGS Light and Power Committee, March 11,1999 - Page 2 REPORTS Platte River Power Authority (PRPA) Report: Director Matzke presented the 1998 Audit for PRPA noting three significaht items: the Rawhide outage in 1998 significantly increased energy purchase and maintenance costs, a Y2K compliance statement was included in the audit, and PRPA sold their gas assets in 1998. Other items discussed include the wind energy program in Ft. Collins. The current surcharge for wind energy is 2.4 cents per kW hour, which represehts an increase of approximately 38% in the base residential rate. The deadline for participation in the wind energy program is March 31,1999. Director Matzke reported that only one Estes Park customer indicated an interest in participation in the program. Chairman Hix directed staff to compile a waiting list of interested customers and determine the viability of program participation at a future date. The PRPA General Manager executive search continues. Candidate interviews are scheduled for April 9111 with a recommendation for a new General Manager shortly thereafter. Financial Report: The February income statement was reviewed. The Platte River bill was not included in the statement, thus an additional $300K will be added to the total expenses for the period. Director Matzke noted that the Town peaked during the same period as Platte River * and the monthly growth for February was 2.5% above the same period in 1998. Project Updates: The Park Lane project has been completed, including the removal of all the poles. The Moraine Parking Lot Project, which provides a loop feed to the businesses on the south end of Elkhorn, has been completed and connects the line from Riverside Drive west to the end of the downtown area. Meetings continue between the Town, the Bureau of Reclamation, and Platte River concerning the new Estes Park Substation and a tentative agreement has been reached on the site. Director Matzke explained that bids for the switchgear have been requested and project specs are near completion. .. Assistant to the Light and Power Director Mangelsen reported that the financial report, historic 3. ': structures, and conservation reports have been submitted to the State Historical Society (SHS) as part of their grant application for the Fall River Hydro project. The deadline for the SHS grant application is April 1,1999. The Museum will have an open house on March 1 911 featuring an exhibit and skit on the Fall River Hydro Plant. A tour of the Plant is also scheduled for April 3rd and is open to the public. Other discussion included continuation of committee meetings, the diesel generator, and progress of Richard Smart in establishing a lab at the hydro site. Director Matzke reported that Y2K meetings continue and have been well received by the public. Channel 8 TV has agreed to record the meetings and will rebroadcast the initial meeting for those that were unable to attend. This next Y2K meeting is scheduled for April 8th in Room 130 of the Municipal Building and will include representatives from the Town, Platte River Power Authority, and Western Area Power Authority to address questions previously raised regarding the national electricity grid. The meeting will be broadcast live and phone lines will be available for the public to call in with their questions. Mahany, Clerk O'Connor Absent None Chairman Baudek called the meeting to order at 3:30 p.m. HIGHWAY 7/COUNTRY CLUB DRIVE - CITIZEN REQUEST FOR BUS STOP SIGN. Linda Moudry, 1631 Avalon, has requested that CDOT, Park R-3 School District and the Town install a beacon sign at the Intersection of Highway 7 and Country Club Dr. Ms. Moudry stated she desires a sign cautioning motorists of school children on Hwy. 7, not necessarily a beacon, and she commented on her observations on vehicle congestion, traffic speeds, and abrupt stops by the school bus. Due to the aforementioned, combined with the lack of sidewalks, curb lines, wildlife crossings, etc., Mr. Moudry expressed concern for the public safety of young school-aged children. Tony Paglia, Park R-3 School District Director of Transportation, identified where caution signs are currently installed near this location, and Chairman Baudek confirmed the following number of school bus stops: Hwy. 7/33, Hwy. 36/16, Hwy. 34/21, and Spur 66/6, for a total of 76 major highway bus stops. Mr. Paglia confirmed that his driver for this route reported that the Avalon stop is preferable to others, and that vision is not impaired-the driver does give ample warning of his stop. Pal Mason, 1155 St. Vrain, prepared a sketch of the site and requested a "warning, bus stop ahead" sign, 'slow, bus stop» sign, and sign logo (children crossing). In addition, Ms. Mason questioned what a needs assessment is based on for placing signs. Public Works Director Linnane confirmed that CDOT manages the installation of all highway signs due to their expertise and: (1) 'children at play" signs are not allowed; (2) CDOT determined that a school bus stop sign should be placed at the north and south ends of Highway 7; and (3) the Manual of Traffic Control Devices contains regulations on signage. Trustee Barker reported on his experience as a school bus driver and that children are not allowed to exit the bus until all vehicles have come to a complete stop. Ms. Moudry concluded her discussion by stating that her primary concern is when vehicles approach the area of the bus stop when the bus is not yet there to caution drivers with the bus' flashing lights and stop sign. Chairman Baudek noted his experience where numerous signs tend to loose their effectiveness, as confirmed earlier by Ms. Moudry when she stated she was unaware of existing bus stop signage near Avalon. Trustee Jeffrey suggested the Town study/observe the site to better determine what mitigation options may be available. Michelle Chew, 645 S. St. Vrain Ave., questioned why crossing guards or lights are not utilized in highway crossing situations, and that a crosswalk and traffic signal should be placed at Graves Ave. as children will not walk an extra two blocks to use the existing crosswalk at the traffic signal at the intersection of Manford/Hwy. 7. Director Linnane 1 BRADFOMP PUBLISMING CO. RECORD OF PROCEEDINGS Public Works Committee - March 18, 1999 - Page 2 responded that pursuant to steadfast discussions with CDOT, the Town received what exists today-the traffic signal and crosswalk mentioned above. There is also a crosswalk at the intersection of Highway 7/Graves Ave. Installation of the above was approved by CDOT based on their standards, it was not based on funding. Mr. Paglia responded that due to liability issues, school districts no longer provide crossing guards. When such guards are found in neighboring communities, volunteers such as a local PTA are providing the service. Concluding discussion, the Committee recommends the Police Dept. place a radar unit and traffic monitor at the site, and that staff, including Committee members, personally observe the area in question. Further discussion on this request will take place at the April 15th Public Works Committee meeting. BONNIE BRAE/MOUNTAIN GOLF VILLAS RIGHT-OF-WAY & ACCESS EASEMENT - VACATION REQUEST BY PROPERTY OWNER. Jerry Lefebvre, owner of a Portion of Lot 33, Bonnie Brae Addition, has requested the Town vacate a 50' sedion of the right-of-way adjacent to Community Drive and Mountain Golf Villas. Mr. Lefebvre submitted a sketch of the site, and staff submitted copies of various plats. In addition, Mr. Lefebvre requested the Town dedicate an access easement across Outlot A Mountain Golf Villas. The 50' strip of right-of-way was dedicated for public use when the Mountain Golf Villas was subdivided in 1993. The Planning Commission requested this right-of-way to accommodate any possible future public road connection to Graves Avenue. Although the Town does not have any current plans for a connection, the future is difficult to loresee. Staff cited the Town's policy whereby vacations are granted where there is absolutely no possibility of future need for the right-of-way for either street or other access purposes. This policy was verified by a legal opinion from Town Attorney White concerning right-of- way vacation. Concerning the access easement request, the Town, nor anyone else, has the authority to grant an access or any other easement on an other's property, this case being the Mountain Golf Villas Home Owners Association property. The Municipal Building was repaired and painted in 1996. Subsequently it was discovered that the concrete window sills are cracked and spalling and should be sealed. The Public Works Department budgeted for this work in the 1999 Budget, and staff solicited a price from Western Waterproofing to perform this work, that also includes painting of the sills. Work requires mechanically routing out the cracks, placing a tooled bead of caulk and painting the sills with two coats of elastomeric sealing paint. The budgeted amount is $7,000, and Western can perform the work for $4,038.00. The Committee recommends approval of the bid from Western Waterproofing for $4,038.00. MUNICIPAL BUILDING ROOF SEAL PROJECT - REQUEST APPROVAL OF CHANGE ORDER. A new roof was installed on the Municipal Building in 1987. It is made of a flexible membrane material, and it is necessary to periodically apply an aluminized liquid coating . This maintains its integrity against weather and ultraviolet radiation and ensures its ability to stay waterproof. Bids were solicited last year, and two were received: Halls Roofing $12,985 Black Roofing $13,521 The budgeted amount is $17,000, and Halls Roofing was the company that installed the new roof on the Police Department and Garage, and staff was quite satisfied with their work The Committee recommends accepting the Halls Roofing bid of $12,985.00, and authorizing staff to expend the remaining budget of up to $3,000 for minor roof repairs. GLACIER CREEK WATER TREATMENT PLANT REHAB. PROJECT - REQUEST APPROVAL OF CHANGE ORDER. The roof at the new chemical room at Glacier Creek is north-facing and is experiencing an icing problem in the gutters. RMC has determined that heat tape will alleviate the problem, thus this mitigation effort requires a change order. Estimated cost is $2,000 which can be funded from the under-budget 1999 Water Line Engineering Design/Construction Management line item ($24,000 excess). The Street Dept. is using a 1984 Chevrolet One-Ton (G-53 with 51,150 miles) to snowplow and sand cul-de-sacs. The One-Ton's limited plow width (maximum for truck size) and limited ability to carry sand (approx two yards) makes it very difficult and time-consuming to plow elli-de-sacs. This truck has become undependable due to age and hard usage. The vehicle qualifies for replacement in accordance with the Town's Vehicle Replacement Policy, and staff is seeking approval to replace it with a budgeted Freightliner truck. The Freightliner would be a short-turning radius truck allowing improved maneuverability in cul- de-sacs and close spaces. It would also feature a wider snowplow and the ability to carry 5 to 6 yards of sand. Additionally, the "Swaploader" assembly option allows conversion of the truck from a snowplowing vehicle to a water truck, dump truck, flatbed, rock-box truck, or de-icing tank truck. The conversion assemblies were unknown to staff during budget preparation, thus the budgeted amount is inadequate. The water tank conversion assembly would eliminate the $70,000 water truck replacement cost that staff is anticipating in the near future, and the other identified options would also be available in the future. The 1999 Budgeted amount is $110,000, and the prices are as follows: Freightliner without Swaploader: $105,671 (net with trade-in) Freightliner with Swaploader: $119,902 (net with trade-in) The City of Lakewood purchased 8 similar trucks this year, and Fleet Supt. Mahany confirmed that other municipalities are well pleased with this assembly option. The Freightliner is a unique, specialty truck style supplied by only one vendor, Transwest Trucks, and staff negotiated the price down $7,000. The Committee recommends approval of the Freightliner Truck with the Swaploader option at a cost of $119,902. The additional assembly option of $10,000 will be funded by postponing the $10,000 emergency back-up snowplow assembly currently in the 1999 Budget. REPORTS. The Water Accountability Report should be presented by John Gallagher/Black and Veatch in May. The Supplemental Augmentation Plan approved by the State, thus staff intends to start using the supplemental plan next month. The Committee reviewed the Customer Service Response Report for February, 1999. Thus far, the number of snow removal is down more than half from previous years. Staff confirmed that work on completing the Lake Estes Trail is progressing. Negotiations are underway to obtain the necessary right-of-way easements, and the goal for completion of negotiations is this year. It was started in 1916 by the Estes Park Woman's Club in one room in the school, and was open two afternoons each week. Six years later, the library moved into its own building in Bond Park and stayed there for the next 69 years. On June 23, 1991, opening ceremonies were held for the present building on Elkhorn Avenue, which houses the current collection. The new building, 13,652 square feet in size, was completed on time and $150,000 under budget. The Library is open 62 hours a week in the winter, and 68 hours per week in the summer months. MISSION STATEMENT The mission of the Estes Valley Public Library District is to be a leading resource for information, education, culture and recreation, contributing to life-long learning and adapted to the special needs of our resort community. The Library will provide access and guidance to materials, both in-house and world wide, utilizing both print and non-print technology. We will maintain quality materials and service. We will preserve and make accessible the history and culture of the Estes Valley. We will develop in our youth the love and habit of reading. We will manage our financial resources in a responsible and prudent manner. Experience in library work on the part of the current Staff ranges from four to twenty-six years, and among them, the Staff has a total of 154 years of library experience. Of all the comments received by the Library, the most common is a report of the helpful, competent, and courteous performance of the Staff. Volunteers The Library is very fortunate to have 60 volunteers, who work in many areas of library operations. In 1998, volunteers worked over 3,000 hours at such tasks as checking out items, repairing and preparing books for shelving, shelf reading, sorting and displaying periodicals, and many other areas of library work. Volunteers are an integral part of the day-to-day operation of the Library, and without them it would not be the special place that it is. Friends of the Library The purpose of the Friends of the Estes Park Public Library is to promote the use and awareness of the Library's resources and facilities and to provide current financial and volunteer support to the Library. A membership organization, the Friends group sponsors special events at the Library, provides refreshments at Library-sponsored events, supplies a copier for public use, and furnishes extra copies of best-selling novels for customers at a nominal fee to avoid delays in being able to read the most popular books. In addition, the Friends group conducts the annual Book Sale, a highly popular event, in August of each year. Library Foundation The Estes Park Public Library Foundation, Inc. was founded in 1985 for the purpose of creating an endowment fund to benefit the Library and its customers over a long-term planning period. The Foundation conducts fund raising events to develop the endowment fund, and to provide periodic financial support to the Library for special projects. The Foundation engages in applying for grants to benefit the Library. Each October, the Foundation Board sponsors a dinner with a noted literary figure as guest speaker, and these events have become highly anticipated. 4 .. I , THE STATE OF THE LIBRARY PROGRAMS Youth Department In 1998, the Youth Department presented a total of 467 programs for preschool and school children in grades K - 5. The total attendance at these programs was 9,716 children. Nearly 300 preschool story time programs were presented, with 4,537 children attending. This represents growth in attendance from 1991 of 800%. The Library's Summer Reading Program has finished in the top three places in the annual Colorado Library Association competition for three consecutive years, an unprecedented accomplishment. + The Youth Department Staff, Kerry Aiken and Charlotte Baxter, are frequent presenters at conferences and symposia around the state because of the quality of their programs. Internet Access Having recognized the potential for information access, retrieval, and analysis offered by the Internet and the World Wide Web, the Library chose early on to make access available to the community as part of its mission. Two public access computers were installed in the main Library, and one was placed in the Youth Room. Available by reservation, at no charge, they were soon busy all the time. The number of computers was doubled. They were soon busy all the time. The Library's Public Access Internet Computers provide all members of our community with not only access to the world of information, but an opportunity to acquire skills in computer usage. As a result of the refinancing, interest cost to the District's taxpayers was reduced by $107,843.12 over the life of the bonds. The Library of the next Millennium The Estes Valley Public Library District is now operating two libraries. One, the traditional library of books and other print materials, has been around for a long time, and continues to thrive. There is no indication that books are any less popular, or that they will be replaced by computers, and so the library of books will continue to grow in size and activity. The second library is based on information technology - computers, networks, and the Internet - and has emerged with the last few years. Its convenience, scope, and rapid diffusion throughout the world has led it to become a necessity for library users. This library will grow even more rapidly as new applications emerge. The role of the Library in serving as the source for information access takes on new importance, as technology tends to widen the gaps between those who have access and those who do not. Training becomes a major requirement, for Staff and for Library customers. Careful adoption of technology, keeping up but with proven applications remains the strategy of choice. Growth in the number of customers, usage, collection size, circulation, and equipment must be projected and considered in long-range plans. Accordingly, we have restructured the payment to be ten payments of $12,500 per year to be used for property upgrades with a provision to release the lien holders if foreclosure is made. We think this is an acceptable risk since most foreclosures will tend to occur in the early years of a project. The latest version of the Development Agreement is in your packet. Most of the basic points discussed in my memo of March 5 have not been significantly altered except as noted above. Other minor changes have been made in the agreement, including adding a provision for renting the units to people employed in the Estes Valley to the extent possible. Town Attorney White will explain the agreement in detail at the Town Board meeting. This draft is very close to a final version of the agreement. If there are other changes, Mr. White will bring the final draft to the Town Board meeting. BUDGET/COST: The $10,000 option payment can be paid out of the contingency account, or another area if you want to cancel something already budgeted. The $75,000 option payment can be added to the 2000 budget if that is your desire. The 1999 budget and 2000 budget both contain $25,000 each year for housing. RECOMMENDATION: Staff continues to believe this Development Agreement is a win-win approach for everyone. Ultimately, the community receives a much safer, improved intersection at Stanley Avenue and SH 7, as well as low-income year-around rentals and seasonal housing in a great location at a lower cost than past projects. It also underscores the Town's commitment to helping provide as wide a range of housing opportunities as possible. Staff recommends the Mayor be authorized to sign the Development Agreement. Upon exercise of the Town's option for the reserved iight-of-way, the Owner shall execute a right-of.way deed to the Town decding the reserved right-of- way to the Town for street purposes free of all liens and encumbrances. 5. Upon exercise o f the option to purchase the reserved fight-of way by the Town and the receipt of the right-of-way deed, the Town shall deed the former right-of-way to the then Owner o f Lots 33A and 34A of the Amended Plat. The legal descriptions of the area ro be transferred to each individual lot are set forth on Exhibit B attached hereto. In the event that the Town does not exercise its option to purchase the Ieserve right-of-way, the Owner of Lots 33A and 34A of the Amended Plat shall execute a right-of-way deed to the Town for the former right-of-way dedicating the right-of-way to the Town for street purposes free of all liens and encumbrances. 6. Upon the exercise of the option to purchase the reserved right-of-way by the Town ser fo~th in paragraph 4 above, the Owner shall have six months to remove rhe two single story framed structures that encroach upon the reserved right-of-way. Said removal shall nor include underground drainage and utilities located on the reserved right-of-way. If the option is exercised, the removal of the structures shall occur either six months from the exercise of the option by the Town to purchase the reserved right-of-way or January 10, 2001, whichever shall last occur. The obligation of [he Owner IO remove the units shall only occur if the Town exercises its option to purchase the right-of-way. 7. The Owner shall be entided to construct the relocated units on Lot 32A of the Amended Plat in the configuration and locations set forth on Exhibit C attached hereto. 8. The Town shall widen Stanley Avenue using the reserved right-of-way purchased by the Town on or before January 10,2002. All costs of the widening of the right-of- way shall be that of the Town. 9. As ofJune 1, 1999, all dwelling units on the Amended Plat shall be low cost housing units for a period often (10) years to June 1,2009. Set forth on Exhibit D attached hereto is a compilation of all dwelling units on the Amended Plat by location, structure type and the rent limitation for each unit based on the 1999 Colorado Housing and Finance Authority Income and Rent Tables for 40°/0-12090 of Median Income for Colorado Counties for 1999 at the 50°/0 level. The rent for all units shall be adjusted on or before June l.t of each calendar year based upon the new Income 2 and Ren[ Tables for that year to reflect the 50% level. On or before June l't of each year, the Owner shall provide to the Town an annual occupancy report for the previous calendar year showing occupancy levels and rents for all dwelling units on the Amended Plat. The annual occupancy report shall continue for the ten year low cost housing period. 10. In consideration of the provision of low cost housing for the ten years, the Town shall pay to the Owner the sum of $12,500 per year. The Town shall on or before June l" of each calendar year pay $12,500 to be used by the Owner for upgrading the low Cost housing units including but not limited to replacing roofs, winterizing water lines, and insulating cabins. On or before May Pt of each year, the Owner shall provide the Town with a budget listing all proposed upgrades. On or before May 1" of each calendar year, the Owner shall provide the Town with an accounting of the use of said $12,500 payment by the Owner in the previous calendar year. For the first year, the $12,500 annual payment shall be used by the Owner for actual expenditures in labor and materials for the upgrade of the low-cost housing units. Beginning in the second year, the O·wner may use all or a portion of the $12,500 payment to amortize any financing used by the Owner for the purpose of upgrading the low-cost housing units and any remaining portion for actual expenditures in labor and materials for rhe upgrade of the low-cost housing units. 11. The rent limitation set forth in paragraph 9 above may be modified by the Owner to pass rhrough ucility costs. Said utility cost shall not count against the rent limitations set forth in paragraph 9. The annual occupancy level and rent report set forth in paragraph 9 shall also contain a reconciliation of actual utility cost attributable to each occupied unit. 12. Owner shall, to the maximum extent feasible, rent the units to persons employed within the Estes Valley. Also, the units may not be used for nightly rentals during the term of this Agreement. Nightly rentals shall be defined as rentals to members of the public which are using said rentals for vacation purposes. 13. The Owner may sell and or transfer the property or any portion thereof at any time, however, the rerms of said transfer shall include the restriction that the low cost housing on the Property and the terms of this Development Agreement shall remain with the Property until at least Apdl 1,2004. 14. All other Town ordinances and rules and regulations of the Town unless otherwise set forrh in this Development Agreement shall apply to development on the Property. Those requirements shall include but not be limited to required filings and development plan approval, landscaping, parking and access requirements. 15. In the event the Town does not approve the Amended Plat and this Development Agreement, this Agreement shall be null and void and have no other force and effect In the event the l'own does approve the Amended Plat and this Development Agreement,the provisions of this Development Agreement shall be a covenant running wirh the Property and shall be binding of upon of all heirs, personal 3 , representacives, successors and assigns of the Owner. A separate Memorandum of this Development Agreement shall be recorded in the office of the Clerk and Recorder, Larimer County, Colorado. 16. This Agreement represents the entire agreement between the parties and shall be amended by the par€es only by written document executed by the parties. 17. In consideration of the payment by the Town, the Owner shall maintain the exterior of the Property including all open area in a clean and orderly manner. The Owner shall not allow any accumulation of trash, abandoned or inoperable vehicles, junk, or any other unsightly use upon the Property. 18. This Agreement shall be binding upon and inure to the benefit of the parties hereto, their respective heirs, personal representatives, successors and assigns. 19. This Agreement shall be governed by the laws of the State of Colorado. Venue for any lidgation regarding this Agreement shall be in che District Court of Larimer County, Colorado. 20. In the event of a default by either party in the terms and conditions hereof, the non- defaulting party shall give the defaulting patty ten (10) days' notice in wridng of said default. If said default is not cured within said ten (10) day period, the non-defauldng party shall be entided to begin legal proceedings, including an action for specific performance and/or damages. Damages shall include all reasonable attorneys fees and court costs incurred by the non-defaulting party. 21. The Town is not obligated by the Development Agreement to make any payments in any fiscal year beyond the fiscal year for which funds are appropriated for the payment thereof or to make payments from any funds of the Town other than funds appropriated for the payment of curitnt expenditures. All payment obligations of the Town under this Development Agreement are from year to year only and do not constitute a multiple-fiscal year direct or indirect debt or other financial obligation of the Town. 22. In the event that the Town does not make any of the payments set forth in paragraph 10 above and the Owner has met all of its responsibilities and obligations under the rerms of [his Development Agreement, the Owner, following ten (10) days notice in writing of the failure of the Town to pay said sum, may declare this Development Agreement terminated and che obligation of Owner to maintain the units as low cost housing units shall terininate. Upon that event, the Town shall, upon request by the Owner, execute a document terminating the terms and conditions of this Development Agreement as a lien and covenant nlnning with the property. 23. This Development Agreement shall become part of the site specific development plan of the Amended Plat upon the vesting of the Amended Plat pursuant to Chapter 17.40 of the Municipal Code. 4 LIEN HOLDERS APPROVAL The undersigned, being all of the lien holders of the Property more fully described on Exhibit A, agree to the terms and conditions o f the provisions of paragraphs 4-8 of this Development Agreement with regard co the liens held by the undersigned on the Property. In the event rhat the undersigned receive the Properry as a result of the exercise of any legal Iight their lien on the Property gives the undersigned, said lien holder agrees to be bound by the terms and condinons of paragraphs 4-8 of this Development Agreement as it relates to the Property. This approval shall be binding on the undersigned lien holders their heirs, personal representatives, successon and assigns. In consideration of lien holders approval of the Developrnent Agreement, the Town hereby agrees thar should the undersigned, their successors or assigns, receive the Propefty through a foreclosure of their lien or take a deed in lieu of foreclosuie, the covenant and agreement to use the Property only for low-cost housing as more fully set forth in paragraphs 9- 13 of this Development Agreement would at the election of the undersigned, their successors or assigns, be terminated by giving thirry (30) days written notice to the Town of sid election. The Town shall, if requested in writing by the undersigned, their successors or assigns, deliver a quit claim deed to the undersigned fermina&tg the low-cost housing covenant ser forth in paragraphs 9-13 hereof Also, it is understood becween the undersigned, their successors and assigns, and the Town chat upon receipt of the Property through foreclosure or a deed in lieu of foreclosure, the undersigned, their successors and assigns, have no obligation to the Town under the ternhs and conditions of the Development Agreement, other than their obligation to be bound by the terms and conditions of paragraphs 4-8 of this Development Agreement as it relates to the Property. '." --- Re: Amended Plat of Lot 26 and Lot 27, Block 9, Country Club Manor Dear Mr. Stamey: The above mentioned plat was recommended for approval by the planning commission with conditions. One of the conditions relative to access cannot be met. At this time each lot owner uses the drive located on the neighboring lot to the south for access. However, the plat that gives them access rights indicates they are using the area north of their lot. Our submittal to the planning commission corrected the situation for lots 26A and 26B. The other two ots receive their access from the south but on a lot commonly held by all 8 owners of the original latting. A copy of the original plat is attached for your reference. The owner of Lot 27A will not agree to modifying the access location for various reasons as stated in his letter of January 14, 1998. Since receiving this letter, Ruth Goetzel, the applicant for this amended plat and owner of lots 26A and 26B, has attempted to resolve the parking (access) situation with the neighbors. You can imagine the difficulty in getting 7 owners to agree on a simple matter let alone a somewhat complex matter as this. One of the owners is not competent to agree and this alone precludes any real progress. This platting still accomplishes all the other goals as originally intended. Easements are confirmed, if not in actuality given, to the neighboring lots as would have been accomplished by the original plat had it been a legal subdivision. Easements are provided for all utilities crossing the property (their are no easements on the property now for utility lines except along the west side). The granting to you the proposed easement, takes from me the legal privilege of ever parking my own automobile on my own property, which it is still my right to do. This granting would leave me no place to park, except in communal lots above my house. ( This I am presently doing without authorization from the other share- holders). This is what all of the other refidents are doing, parking on lots that do not belonge to theme At present. to my knowlege no one has challanged my or Sh#ron Quarino's parking in the common area. I would advise you to contact your legal advisor, and have him check out the amount of tax that each of the eight residents pay on the Community (two lots above us). Technicaly all eight property owners, are to keep up and maintain the communit area, which no one has ever done except Sharon and myselg. If each owner would be willing to be releaved-of the txation ' •, (which would be 1/8th of the total assesment for each), and be free of maintaining it; then I may consider taking it over. This would solve the parking for Sharon and our need, if we give up our easement area to the houses below. It would be good if we could solve the parking situation so we could all be leagel in where we are presently parking. We had intended to come up to Estes after I go, your letter , but it seems that things do got always work out the way we would like. This amended plat recognizes the south half of a subdivision of ownership that was created and recorded in 1972, known as "Prospect Ten'aces Vacation Homes". This old "plat" divided ownership of eight existing cabins that have been held and sold in separate ownership since 1972. This subdivision has never been approved by the Town, and the owners of four of the lots are now requesting this approval in order to improve their title to the property. The review of this amended plat by the Planning Commission in November 1997 included requirements for new access and utility easements that recognized current use. Since that tillie the applicants have been unable to fulfill those conditions. The plat has recently been revised to reflect the original access easements that do not fit with current use ( please see Mr. Kochevar's letter). The old access easements as now shown on the pIat do, however, provide a required means of legal access to the four lots included within this plat. The applicants now request approval of this plat, although they are unable to meet all of the Planning Commission's conditions of approval. Staff regrets that it did not prove to be possible to provide the new access and utility easements that would fit with the current use of the property. However, staff does recommend approval of this amended plat in its present form. Approval of this plat will not create any new problems for the owners of these lots, and it does provide formal approval of the existing division of ownership. It simply does not correct many of the existing problems associated with the 1972 plat. Due to Federal funding guidelines, the Town is not eligible for the direct block grant. Our only option is to participate with a larger entity such as Larimer County; additionally, our participation along with the other cities in Larimer County, enhances the County's grant application. The programs outlined in the proposal are extensions of services currently being provided by Larimer County to various clients. Budget/Cost: The Town will provide a grant match of $299 (10%). The funds will come from the Police Department. The County will then receive our allocation of grant money ($2695) and provide the services outlined in the March 19 memo from Lorrie Wolfe. Of the four programs being proposed, all but the "Truancy/Accountability" program will be available to Estes Park residents. County staff has indicated that Estes Park residents will receive services regardless of our participation in the grant. However, if we agree to participate and authorize the County to receive our allocation, they will receive an additional $2994.00 ($2695 from grant funds and $299 from Estes Park). g L.
