This year is no exception. As in the past, the project was advertised in the area papers with the hopes of spurning interest and participation from local qualified paint contractors. Again as in the past one bid was submitted by area contractor Roger Ping of Estes Park Painting and Decorating Inc. the bid for this year's work is $7,700.00 Cost/Budget Cost: $7,700 Budget: $13,000 Action Staff recommends approval to contract the Manford Ave./Colo. State Hwy 7 painting project with Estes Park Painting and Decorating at a cost of $7,700. This is a continual process which benefits the system through increased reliability and safety. An RFP for this service was sent to (4) contractors in the winter of 2008. Each contractor submitted a bid for 800 hours of work (two-person crew). The results are as follows, including an hourly rate for each contractor (bid price divided by 800 hours). The second year contract will be contingent upon Town Board approval. Cost/Budget: Cost: 1) Asplundh Tree Expert Year 2008: $66,912.00 or $83.64/Hr. It,-r,-= Water Department Inter-Office Memorandum ESTES|gm]PARK COLORADO TO: Utilities Committee From: Jeff Boles Date: 3/28/2008 Re: Waterline Extension Agreement - Lot 9, Hill Crest Estates Background: In order to get service from the Town's water system the owners of Lot 9 Hill Crest Estates extended the water main from Ptarmigan Trail and continuing along Stone Gate Drive to their lot. This water main will be available to other lots that would not previously had access to the Town's water supply. The owners of Lot 9 have requested to enter into a Waterline Extension Across Vacant Land Agreement to recover portions of the costs related to the construction of this infrastructure. This Agreement would be in effect for a period of ten years and would equally distribute the infrastructure costs between Lots 1, 9, 10 and 11 of Hill Crest Estates in the amount of $21,544.75 each. (Attachment: Waterline Extension Across Vacant Land Agreemenf) Budget: There is no budget/cost associated with this memorandum. Recommended Action: Enter into the Waterline Extension Agreement with the Owners of Lot 9 Hill Crest Estates for a period of ten years. 1-1 WATERLINE EXTENSION ACROSS VACANT LAND AGREEMENT THIS Agreement, made and entered into this day of , 2008, by and between the TOWN OF ESTES PARK ("Town"), operating and existing under and by virtue of the laws of the State of Colorado, and LINDA JEAN STENNETTE ("Developer"). WITNESSETH WHEREAS, Developer is the owner of the following described property: (See Exhibit A, attached hereto and incorporated herein by this reference.) and the proposed water main that serves said property will be constructed across undeveloped property described below: (See Exhibit B, attached hereto and incorporated herein by this reference.) WHEREAS, Developer wishes to construct water distribution facilities to serve said property and connect to the distribution system; and WHEREAS, the Town is not required to enlarge or extend its facilities beyond those currently existing and all such enlargements or extensions are undertaken at the discretion of the Town in the interest of the public health, safety, and welfare. THEREFORE, it is mutually understood and agreed as follows: 1. Waterline Extension. The waterline extension facilities (the "waterline") will be designed and constructed in accordance with the most current edition of the Town's Water Utility Policies and Standards ("Design Standards"): Developer: Linda Jean Stennette Project: Lot 9, Hill Crest Estate Subdivision Engineer: Cornerstone Engineering & Surveying, Inc. 2. Warranty. Upon completion acceptance of the waterline by the Town, the Developer shall deliver to the Town a written warranty in accordance with the requirements of the Design Standards. 3. Transfer of Facilities. The Developer shall deliver to the Town a good and sufficient bill of sale for the waterline. The Bill of Sale shall convey the facilities free and clear of all liens, claims or encumbrances. The Developer shall also deliver a permanent easement, in a form approved by the Town, for all portions of the waterline which have been installed upon private property. The permanent easement shall be executed by all the owners of said property. Ownership and maintenance responsibility for the waterline will transfer from the Developer to the Town upon receipt of the Bill of Sale and Easement for the waterline. 4. Operation and Maintenance of Waterline. After the waterline has been transferred and subject to the provisions of the warranty, the Town will have full responsibility for operation and maintenance of the waterline and the actual costs incurred in connection therewith. The Town agrees to allow connection to the waterline in accordance with the Rules and Regulations of the Town of Estes Park. 5. Indemnification. In addition to and separate from the warranty set forth in Paragraph 2 above, the Developer hereby agrees to hold harmless the Town, its successors and assigns, against any and all liability, loss, or damage the Town may suffer as a result of claims or judgments against it under the mechanics' lien laws of the State of Colorado, or on account of defective materials and workmanship used to install the waterline. Said indemnification shall include, but not be limited to, court costs, damages, repair costs, and reasonable attorney's fees. 6. Enforcement of Agreement. The Developer and Town acknowledge and agree that this Agreement may be enforced in law or in equity including specific performance, damages, or such other legal and equitable relief as may be available to either party. 7. Survival of Obligations. The provisions of this Agreement shall be deemed to survive the transfer of the waterline and shall be binding upon the successors, transferees, and assigns of the parties. 8. Assignments. The Developer shall not assign its rights or delegate its duties under this Agreement without prior written consent of the Town. 9. Reimbursement for Extension Over Vacant Land. If a third party connects to the waterline during the 10-year period beginning with the date of this Agreement, the Town will collect the appropriate payment from the third party and reimburse the Developer in accordance with the schedule set forth on Exhibit C attached hereto and incorporated herein by reference. The Developer specifically understands and agrees that the Town shall use its best efforts to collect the appropriate reimbursement amount during the 10-year period. However, in the event that the Town does not collect the appropriate amount, the Developer shall not have any right or cause of action against the Town for its failure to collect and reimburse the Developer. 10. Notices.
