AGENDA WATER COMMITTEE June 5, 1985 - 2:00 P,M. 1 Rural Water Applications: A, Thomas Oldham - 1200 Mary's Lake Road 2 Proposed amendment to the Municipal Code. 3. Fees assessed to customers for service calls, 4, Water Use Report, DRAFT COPY ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 13 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO, THE SAME PERTAINING TO PUBLIC UTILITIES BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: Section 1. That Section 13.28.030 of the Municipal Code of the Town of Estes Park, Colorado, shall be amended to read as follows: 13.28.030 Meter requirements. A. Individual water meters shall be required for the following water consumers: 1. All commercial consumers; 2. All single-family dwelling consumers which shall include individual units of a townhouse or planned unit development in which the ownership of the real property is capable of being held in individual and separate ownership from surrounding property even though the units are attached to other units; 3. All individual condominium units; 4. All individual apartment buildings. B. Water metering shall include a water meter, a meter pit, or other meter locations within the structure, yokes, and a remote reader. C. All costs related to such water metering shall be charged to the consumer and paid for by the consumers provided in Chapter 13.32 for the payment of water rent. In the event such charges are not paid when due, the provisions and procedures of Chapter 13.32 pertaining to delinquent water rent shall be applied ~~ to such delinquent charges. D. The requirements of this section for an individual water meter may be met by requesting a master meter thru the water superintendent. A request for a master meter shall include documentation disuring) that each individual dwelling unit or individual dwellih~g-units collectively are responsible for payment of all charges for water. Section 2. That Section 13.24.060 of the Municipal Code of the Town of Estes Park, Colorado, shall be amended to read as follows: 13.24.060 Service pipe regulations. A. Water service for a property may be from both the town's water service and a well. Fi nRAFT COPY W ?f Service must include all improvements on the property. In the event the property is served by both the town's water service and a well any cross-connections shall be governed by Chapter 14.24. - B. No consumer shall be permitted to conduct water pipe across lots or buildings to adjoining premises without the permission of the water superintendent. ,---47' C. Service pipes must be laid at leastidou©feet below the surface of the ground. The town shall not-Ne responsible for the service pipes and fixtures. All owners at their own expense must keep service pipes from the town main and all their apparatus in good working order and properly protected ~ from frost and other disturbances. No claim shall be made against the town on account of the breaking of service pipes or apparatus or for failure in the supply of water. No reduction in the rates will be made for any time that service pipes or fixtures may be frozen. D. In the event that a consumer desires to provide.water from the town's tap to more than a single family dwelling or one multi-family dwelling on an individual lot, said consumer must 1 obtain approval from the water superintendent of his distribution / system. Said approfal must be obtained prior to the town's furnishing any water to. the system. The consumer shall provide j the water superintendent with plans and specifications to the system detailed enough to allow the water superintendent to adequately review the same. Also, consumer shall provide documentation such as homeowner association documents, covenants or other deeded property restrictions indicating that there is adequate legal basis for perpetual maintenance and repair of the distribution system. Section 3. That Section 13.32.010 of the Municipal Code of the Town of Estes Park, Colorado, shall be amended to read as follows: 13.32.010 Tapping charge--Water rights fee. The consumer shall pay the town clerk for each new water tap a fee which shall be the total sum of the following charges, and for each water tap reconnected after being disconnected from the town's water system a reconnection fee which shall be the total sum of the following charges: the actual cost to the town of the 1 corporation cock, expansion joint, curb box, tapping saddle, L~Ju and water meter furnished by the town, to make such tap, and the following sums for each connection to the town's water system Connection Charge (in inches) 5/8 or 3/4 $ 1,005.00 1 1,785.00 1 1/4 2,790.00 1 1/2 4,020.00 2 7,150.00 3 16,085.00 4 28,595.00 6 64,346.00 The size of all connections shall be determined by the town. If the size of a connection is increased, the consumer shall pay the difference between the fee for the existing connection and the fee for the new connection. Individual water meters shall be required for the following water consumers: 1. All commercial consumers; .....510 2. However, this shall not include condominiums and/or cooperatives which, although are capable of separate air space ownership, do, in fact, share the common ownership of the real property. B. All costs related to such water metering shall be charged to the consumer and paid for by the consumers provided in Chapter 13.32 for the payment of water rent. (Ord. 3-81 §1, 1981: Ord. 16-80 §2, 1980: Ord. 16-72 §1(part), 1972: prior code §6.21-3). 141-1 (Estes Park 8/81) . 13.24.050--13.24.080 changing or adding to any plumbing, shall immediately report the same to the water superintendent, and any failure to do so shall constitute a violation of this code. (Prior code §6.8). 13.24.050 Separate connections required. Each consumer,***+ receiving water service must have a separate service line 44 running from the consumer's premises to be served to the cor- poration cock located at the town water main which will fur- nish water for such service. (Ord. 11-73 §1, 1973: prior code §6.12). 13.24.055 Tap connections to water mains. All work necessary to make any tap connection to a town water main shall be done by the town. The cost of the work shall be the responsibility of the consumer and billed to the con- sumer by the town. (Ord. 17-84 §1, 1984). 13.24.060 Service pipe regulations. No consumer shall be permitted to conduct water pipe across lots or buildings to adjoining premises without the permission of the water superintendent. Water service for a property may be from both the town's water service and a well. Service must include all improvements on the property. In the event the property is served by both the town's water service and a well any cross-connections shall be governed by Chapter 14.24. Service pipes must be laid at least four feet below the surface of the ground. The town shall not be responsible for the service pipes and fixtures. All owners at their own expense must keep service pipes from the town main and all their apparatus in good working order and properly protected from frost and other disturbances. No claim shall be made against the town on account of the breaking of service pipes or apparatus or for failure in the supply of water. No re- duction in the rates will be made for any time that service pipes or fixtures may be frozen. (Ord. 1-82 §1, 1982: Ord. 6-78 §1, 1978: prior code §6.13). 13.24.070 Hose and nozzle size. Consumers shall not use hose larger than three-fourths of an inch in diameter, and sprinkling without a nozzle or from a nozzle larger than three-sixteenths of an inch opening is strictly forbidden. In addition to the penalty provided herein for code viola- tions, any violation of this section may cause a revocation of sprinkling rights for the remainder of the season. (Prior code §6.145. 13.24.080 Water waste prohibited. Consumers shall pre- vent unnecessary waste of water and keep all water outlets closed when not in actual use. Hydrants, urinals, water 138 (Estes Park 8/84) 13.28.090--13.32.01'0 water service immediately to any user who violates the pro- vis-ions of this section until satisfactory payment has been made for all water used and all repairs to the meter. (Ord. 13-77 §5, 1977). 13.28.090 Charges when meter fails to register. If any meter fails to register in any billing period, the water user shall be charged according to the average quantity of water used in a similar period as shown by the meter when in order, and the town water department may prorate any water bill for any such period of time water service is received while not being metered. Should a consumer install a water-using device that is not defined above, or should special use of water be required, the ·consumer shall submit sufficient information thereon to enable the town to determine the fixture value weight for such device or use. All necessary pipe, fittings, valves, shutoff, trench- ing, backfilling and installation of the tap, must be at the expense of the consumer and under the supervision of the water superintendent. All water service connections and all water -06*e*~ service extensions, both within and without the town limits, <L are subject to special fees as adopted by the board of trus tee~9=m.x.4 Tapping must be done by a licensed plumber and a standard corporation cock and expansion joint, furnished by the town, must be used. No water service shall be furnished to the consumer until all tap fees and water rights fees have been paid to the town clerk. All property for which a connection fee has been paid after December 1, 1972, as herein provided, must be connected to the town's water system and put into service for the im- provement it is to serve within one year from the date of the payment of such fee. All property for which a water connection fee has been paid after January 20, 1966, but before December 1, 1972, must be connected to the town's water system and put into service for the improvement it is to serve within ten years from the date of the payment of such fee. All property for which a connection fee has been paid prior to January 20, 1966, must be connected to the town's water system and put into service for the improvement it is to serve prior to January 20, 144 (Estes Park 2/81) 13.32.020--13.32.050 1986. After the expiration of the applicable provided con- nectign dates provided in this section, a new application for water services must be made and another connection fee paid at the rate then prevailing for such fees before water service will be furnished to the property for which the application pertains. "Water tap," as used in this chapter, means the physical connection to a town water main so as to let out or draw water therefrom to furnish water service to a customer. In addition to the foregoing charges, the consumer shall pay to the town any charges the town has agreed to collect for property to be served by the water main to which the con- sumer's service line is to be connected. Should the owner or occupant of the premises desire additional service or fixtures, or to apply the water for a purpose not stated at the time of the original application, permission must be obtained therefor. When additional fixtures are added and permission therefor has not been obtained, such person shall be charged double the current water rights fee for each fix- ture value added without permission. All of such charges are to be added on to and collected with the water bill. (Ord. 31-78 §2, 1978: Ord. 6-78 §3, 1978: Ord. 14-74 §3, 1974: prior code §6.9). 13.32.040 Discontinuance, termination and abandonment of service. Any person who desires to discontinue the use of water shall file written notice with the finance officer and pay all current and back charges for water used. Any person who abandons a water tap or who fails to pay the applicable minimum rate set forth in this chapter for a period of two or more years, or whose service is terminated as elsewhere provided in this chapter and whose service has not been restored within a period of two years from such termination, shall be deemed to have requested discon- tinuance of service. Prior to service being reconnected after discontinuance of service for any of the reasons set forth in this section, a reconnection fee shall be charged as set forth in Sectior 13.32.010.
