O.Box 2270 Estes Park, Colorado 80507 Dear Mr. Hicks: By the time you receive this letter, hopefully I will have reached you by telephone regarding this matter. Your chief executive officer, Mr. Richards, in the Water Department of Estes Park, advised me that you are chairman of the Water Board, and suggested that it was appropriate procedure for me to file an "appeal" of this matter by filing the enclosed Application and Appeal (please cause the same to be appropriately filed) by mailing addressed as I have, and enclosing this cover letter to your attention. The application, I believe, fully explains mg quest. We were also advised that your regular monthly board meeting for March has been moved from March 14, 1985 to March 7, 1985 at 2:00 P.M. I would appreciate the opportunity to appear in person with our real estate agent (Carl Koontz (Realty World) during your meeting on March 7 to further appeal for consideration; and, ask that you give us a time on your agenda. I will plan to travel by auto, leaving North Platte around 8:00 A.M. C.SX (It's a 5-hour drive), which should bring us to Estes Park by 1:00 P.M. M.S.T., leaving an additional margin of time for the meeting. In the application, I have given several reasons why I feel that consideration be given. It is my understanding that Mr. Richards believes he has no prerogative to consider my request, but is sympathetic to my case, except for the fact that he feels that extension of the mains should be his primary objective. On the other hand, I sense he would accept pleasantly a Board ruling favoring my request. Furthermore, it has been reported to me that the Department is planning to eventually construct the main extension that would pass by Lot 47, such that the real issue here is only one of cost and timing. To cooperate in that regard, I suggested that since there are no other lots to share the cost except as to the overall benefit to all of the subdivision, I suggested that the City issue bonds to construct the main and I would buy the bonds needed to finance the some 300 feet of main needed to reach Lot 47. As a former City Attorney for North Platte, and as attorney for several small irrigation districts, I have documented such "private funding" using local banks without using the bond houses and agents normally used to float municipal bond issues. In fact, I could provide your attorney with examples of such documentation. An alternative, and perhaps the better cooperative means, would be to let me "tap in" at Lot 22 now, and then when and if the main comes by Lot Page 2 Mr. Hicks March 1, 1985 47 , I would pay the actual cost to "cut" the line to Lot 22 and "tap in" at the lot line of Lot 47 (or across the street). Unless I receive a call from the Department saying there is no room on the agenda, (there is not enough mail time), weather permitting, I'd like to shake hands with you in Estes Park on March 7, 1985. BEFORE THE WATER BOARD FOR THE CITY OF ESTES PARK, COLORADO IN THE MATTER OF THE APPLICATION ) APPLICATION AND APPEAL OF JESS C. NIELSEN ) FOR ) WATER UTILITY SERVICE In Re Lot 47, Grand Estates ) Applicant represents to the Board as follows: 1. Applicant and his wife, Harriet H. Nielsen, have signed a contract to purchase Lot 47, Grand Estates Addition to the Town of Estes Park, Larimer County, Colorado (Hereinafter: Lot 47). 2. Applicant has been informed by Water Department personnel that the nearest point to which a water main of the city water utility service is laid is at the south corner of Lot 22 in said Grand Estates 1 - Addition; thatAwater main reaches southward on Lakefront Street only about halfway from U. S. Highway 34 to the intersection of Grand Estates Drive with Lakefront Street; and another main goes no further east than the northeast corner of Lot 8. 3. Applicant believes that Lot 46 will receive water service from the west, that Lots 20 and 21 are occupied as one dwelling place already served with city water, and that Lots 48, 49, and 50 also now have water service; therefore, Lot 47 is the only lot in that general area which is without public utility water main service adjacent to the lot. 4. A water tap fee has not been paid for Lot 47; nor have there been any other fees or installations for water service to Lot 47 made except as stated above. 5. Lot 47 appears to be the only lot that could receive water service by extension of the water main at Lot 22 along Grand Estates Drive to Lot 47 and further westward. 6. Water Department personnel have indicated a desire to extend all of the mains in paragraph 2 above to the intersection of Grand Estates Drive and Lakefront Street for reasons of fire protection, increasing water supply volume, and maintaining pressure; but to date, have not scheduled the segment westward from Lot 22 for construction. Applicant proposes two alternate solutions for water service to be made available to Lot 47 by June 1, 1985: (a) The City should at its expense construct a water main from Lot 22 westward, at this time at least to a point opposite the northeast corner of Lot 47 (or continue on to said street intersection at City's choice). (b) Applicant be permitted to tap into the main at Lot 22, and, using street right-of-way, construct a 1-inch private service water line to Lot 47. 8. Water Department personnel have advised Applicant that current municipal regulations would require Applicant at his expense to construct for City a 6-inch water main from Lot 22 to Lot 47, the cost of which will exceed $24.00 per running foot, according to their estimates, for some 300 feet or more; or, a total cost in excess of $7,200.00. In addition, Lot 47 will be charged a tap fee of $2,800.00 or more (depending on the amount of estimated water use on the premises), making the total cost to provide water service to the lot of more than $10,000.00; to which Applicant must add the cost of 50 feet @ $7.50 per foot of private line in the lot to the house, or $375.00. This plan is cost prohibitive, unfair, and unwarranted. 9. Applicant respectfully requests the Board to waive such regulations as would prevent Applicant to follow plan (b) expressed in paragraph 7 above, allowing Applicant to obtain water service to Lot 47 at a cost of approximately $3,000.00 construction plus $2,800.00 tap fee, or $5,800.00. This approach is fair because: (a) A main extension is not needed to supply water to Lot 47 and there are no other lots to share in the cost of the extension. (b) Fire protection, and volume supply and pressure are objectives to be shared by all of the lots in said Grand Estates Addition. (c) The City requirements should be cost effective and fair. (d) The tap fee should pay for capital additions attributable only to Lot 47. (e) A municipality providing water utility service has an obligation to provide service to each lot in a subdivision which has been accepted into the corporate territory (City limits) and spread the -2- . cost thereof fairly on a pro rata basis to all of the land to be served or required to accept service. (f) Water mains are part of the utility system. (g) Since there are now houses on all of the lots in the area, except Lots 46 and 47, the quality of fire protection will be substantially no different than it now is; and, the water usage on one lot could hardly effect the quality and integrity of the City water utility system. (h) The City has an economic and aesthetic interest in seeing the lots developed and appropriately maintained, which is fostered by making such development economically feasible. (i) Lot 47 should not be saddled with a disproportionate development cost as compared to other lots in the area, as adjusted for inflation. (j) Said Plan (b) will be a suitable and adequate water supply system for Lot 47. Any upgrading of that service would be to achieve utility benefits to be made available to the entire subdivision. (k) The sanitary sewer utility has provided a main adjacent to Lot 47, the cost of which to Lot 47 is included in the tap fee of less than $1,500.00. (1) The City cannot discriminate in permitting use of mains and platted and dedicated rights-of-ways; wherefore it should not deny a tap at Lot 22. (m) The circumstances regarding water service to Lot 47 are unique as compared to any other lot within the subdivision. wherefore granting relief to Lot 47 will not serve as a precedent that would cause owners of other lots to believe the City should grant concessions to them. As we failed to obtain prior approval for any charges over $6,500.00 the Town may take any of the the three following methods of payment. 1. Pay the difference between the $6500 and our previous charges of $6096.50 or $403.50. 2. Split the difference of the over-run of $252.62 and pay us $6,752.62 (round to $6753.00) less our previous charges of $6,096.50 or $656.12. 3.
