MEMORANDUM To: Public Safety Committee From: Fire Chief Scott Dorman Date: July 9,2007 Subject: Fireworks permit for the Longs Peak Scottish/Irish Highland Festival Background: The Longs Peak Scottish/Irish Highland Festival, Inc. has requested a permit to perform a fireworks display during the 2007 Tattoo event on September 6-8, 2007. There will be a display each evening between 8:30 and 10:00 p.m. during specific portions of the program. The program will consist of gerbs (sparklers) and a concussion display during performances between 8:30 p.m. and 9:30 p.m. followed by (5) pyro flags at approximately 10:00 p.m. The applicant has hired licensed pyro technicians, Mark Palissard and Jeff Arnold for the display. All of the fireworks are class C and are supplied by Stonebraker Fireworks Co. of Denver, CO. The applicant has had similar displays in previous years without incident. Budget: There is no budget or cost required by the Town of Estes Park. Recommendation: Staff recommends approval ofthis permit request with the following conditions: • Contingent on fire restrictions • The Fire Chief or his designee may cancel the permit at anytime if conditions are deemed unsafe. • A safety perimeter around the display per NFPA standards be maintained • A type "A" or "ABC" fire extinguisher is on hand at the site. • A list of the exact type and size of all of the fireworks is to be submitted to the fire department for approval prior to the event. • The Town of Estes Park and the Estes Park Volunteer Fire Department will need to be named as additional insured on the applicant' s liability insurance. ctrish H, Longs Peak Scottish/Irish Highland Festival, Inc. JAD/psy MEMORANDUM To: Public Safety Committee From: Fire Chief Scott Dorman Date: July 13, 2007 Subject: IGA # 01520070004 with RMNP Background: The Estes Park Volunteer Fire Department and Rocky Mountain National Park currently have been working under a Memorandum of Understanding (MOU) to provide services and assistance between the two agencies. The MOU was valid for five years and was due to expire on July 20,2003. The MOU has been extended on an annual basis since 2003 in an effort to continue to provide the services and assistance between the two entities while a new agreement was written. The current MOU expires on July 20,2007. The Estes Park Volunteer Fire Department, on behalf of the Town o f Estes Park, and Rocky Mountain National Park have incorporated the current MOU into an Intergovernmental Agreement (IGA) that better meets our current needs. The purpose of this IGA was to establish the terms and conditions under which the Town through the Estes Park Volunteer Fire Department will provide structural fire suppression and other emergency services assistance in and near RMNP. Additionally, it will provide the terms and conditions to provide access to the Park's Fire Operations Center on Mills Drive allowing for the Estes Park Volunteer Fire Department to house a structural fire engine(s) and related equipment. This IGA has been reviewed and approved by Town Attorney Greg White. Budget: There is no budget or cost required by the Town of Estes Park. Recommendation: Staff recommends approval ofthis IGA General Agreement I.L. (#G1520070004) Intergovernmental Agreement Between the National Park Service (Rocky Mountain National Park) And Town of Estes Park This agreement is entered into by the United States Department of Interior, National Park Service (hereinafter "NPS"), acting through the Superintendent of Rocky Mountain National Park (hereinafter "RMNP"), and the Town of Estes Park (hereinafter "the Town"), a political subdivision of the State of Colorado collectively, "the parties." The purpose of this agreement is to establish the terms and conditions under which the Town through the Estes Park Volunteer Fire Department (hereinafter "EPVFD") will provide structural fire suppression and other emergency services assistance in and near RMNP, which will provide access to the Park's Fire Operations Center for housing of the Town's structural fire engine(s) and equipment. ARTICLE I-BACKGROUND AND OBJECTIVES As used in this agreement: The term Rocky Mountain National Park encompasses the area authorized by Title 16 United States Code § 191-198j. The term Pai.k Ranger refers to a person designated by the Secretary of Interior, per 16 USC § 1 a-6 (b), to "...maintain law and order and protect persons and property within areas of the National Park System." Rangers so designated are commonly referred to as "commissioned jangers." The term Estes Park Volunteer Firefighter, refers to persons designated by the Town to perform structural fire suppression services within its territorial jurisdiction and other areas contiguous to the Town. The term lead agency refers to the agency with primary responsibility for structural fire suppression and other emergency services in the referenced geographic area. 1 The term cooperating agency refers to the agency without primary responsibility, i.e. the agency providing assistance to the lead agency. The term emergency services personnel refers to any other person authorized by either the lead agency or cooperating agency to provide emergency medical services, search and rescue services and/or firefighting, and/or related emergency incident support services within the territorial jurisdiction of that agency. Whereas, the following authorities are relevant to the NPS: 1. The United States Department of Interior, NPS manages RMNP pursuant to Title 16 United States Code § 1 et seq. 2. 16 USC § 1(b) (1) authorizes the Secretary of Interior to render "emergency rescue, firefighting, and cooperative assistance to nearby law enforcement and fire prevention agencies and for related purposes outside of the National Park System." Whereas, the NPS and the Town have determined that providing mutual assistance in the area of fire suppression and related emergency services will be mutually advantageous and is in the public interest, and Whereas, it is their mutual desire to work in harmony and to cooperate in the use of equipment and trained personnel where threats to human life and property arise within their respective jurisdictions, and Whereas, it has been determined by the Town that having a structural fire engine equipped and ready to respond to structural fires in the western edge of the Town in the location of RMN P's Fire Operations Center can potentially save life and property, and Whereas, staffing levels at RMNP cannot be significantly augmented by employees trained in structural fire suppression from other federal agencies in a timely manner, and In order to accomplish the above stated objectives and to set forth in specific manner a cooperative mutual aid and assistance agreement which will be equally beneficial to both parties, NPS and Town agree as follows: ARTICLE II-STATEMENT OF ITORK A. Structural Fire Suppression Operations within the Park 1. The NPS has prima/3 responsibility for fire suppression and other emergency services and for the protection of persons, property and resources upon park lands and that it cannot d oleizate that responsibility to a State or local agency. 2 2. In response to a request from the NPS, the Town will provide available fire suppression services and/or equipment, which can be reasonably made available without jeopardizing Town operations. 3. The parties will cooperate in the formulation and application of practical plans and programs for the handling of fire suppression and other emergency situations including vehicle extrication, hazardous materials evaluation and control and dive search and rescue operations. 4. The parties will work jointly on matters pertaining to radio communications and dispatching. training, prevention of incidents and violations, natural disasters and public safety concerns. 5. RMNP will install key lock box systems on structures within RMNP pursuant to Estes Park Municipal Code Section 8.04.091. B. Other Emergency Services within the Park l. NPS has primary responsibility for all emergency rescue and firefighting operations upon park lands. 2. In response to a request from the NPS, EPVFD will provide emergency services personnel and/or equipment, which can be reasonably made available without jeopardizing Town operations. 3. The parties will cooperate in the formulation and application ofpractical plans and programs for firefighting and related emergency services. C. Requests for Assistance 1. Unless exigent circumstances preclude it, we agree that the lead agency will gerlei-ally request assistance from the cooperating agency in one or more of the following manners: a. Verbally, from Communications Center to Communications Center. b. Verbally, from EPVFD or Estes Park Police Department representative/Ranger or supervisor to Communications Center. c. In the case of planned events, a request for assistance shall be made in advance and in writing to the responsible agency's chief fire fighting officer. 2. Park Rangers are responsible for notifying their respective Communications Center or supervisor that a request for assistance has been made or received. Communications Centers are responsible for notifying appropriate supervisory personnel within their agency. D. Command and Control of a Mutual Aid Incident 3 1. Consistent with the structure and principles of the Incident Command System (ICS) the Incident Commander (IC) of the lead agency shall be in command of incidents, and other agencies and resources assigned to the incident shall work under his/her direction. While specific and/or individual resources may work under the direction o f their functional leader (chief, strike team leader, task force leader, etc.), overall command and contro I o f the incident remains with the IC. 2. Whenever feasible, Volunteer Firefighters/Rangers/emergency services personnel from the cooperating agency will be used in a support role. When possible, the parties will: a. Assign assisting Volunteer Fire fighters/Rangers/emergency services personnel to ons or more Volunteer Fire fighters/Rangers/emergency services personnel of the lead agency. b. Incorporate Volunteer Firefighter/Ranger/emergency services personnel, preferably a supervisor, from the cooperating agency as an agency representative in the incident command structure of the lead agency. 3. The parties will conduct .joint After Action Reviews of mutual aid incidents, when appropriate. 4. Estes Park Voluiiteer Firefighters, National Park Rangers and all other emergency services personnel shall be subject to the laws, regulations and policies oftheir respective agency. 5. We agree that Es:es Park Volunteer Firefighters, Park Rangers and all other einergency services personnel of the cooperating agency who are rendering assistance pursuant to this agreement shall be deemed to be acting within the scope of their employment and subject to the laws, regulations and policies oftheir respective agencies. 6. Command and control of incidents in RMNP will utilize the Incident Command System CICS). 7. The Lead Agency shall coordinate all infonilation released to the press and media. The Lead Agency will typically designate a Public Information Officer for incidents, and all niedia/press inquiries an·d release of information will be coordinated through that position. 8. The parties will agree to an Annual Operating Plan that addresses and clarifies operating procedures associated with the occupancy of the RMNP Fire Operations Center. This Plan will be reviewed and finalized by January 1 of each year. E. Compensation ~ 4 1. We agree that Estes Park Volunteer Firefighters, National Park Rangers and all other emergency services personnel shall not receive any monetary compensation for services rendered except through their respective agency. 2. Each party shall bear its own costs for furnishing services under this agreement, and neither party shall collect reimbursement for those costs from the other. 3. Nothing in this agreement shall be construed to bind either party to expend in any one fiscal year any sum in excess of funds appropriated by its governing body or allocated by the party for the purpose of this agreement. 4. All claims whatsoever against the Unites States or its employees arising out of this Agreement shall be governed by the Federal Tort Claims Act. 5. To the extent pennitted by applicable law, the parties agree and understand that the Town of Estes Park is relying on and does not waive, by any provision of this Agreement, the monetary limitations or terms (presently One Hundred Fifty Thousand and 00/100 Dollars ($ 1 50,000) per person and Six Hundred Thousand and 00/100 (%600,000) per occurrence) or any other rights, immunities, and protection provided by the Colorado Governmental Immunity Act, Section 24-10- 101, C.R.S., as from time to time amended, or otherwise available to the Town of Estes Park or any of its officers: agents. volunteers or employees. F. Miscellaneous Provisions 1. The Town will house a structural fire engine, suitable for initial attack in RMNP, iii the garage bay of the Fire Operations Center at no cost to the Town. RMNP will provide all utility expenses, snow removal, trash removal and any other maintenance of the garage bay. EPVFD will be provided access to other areas of the Fire Operations Center as agreed upon. RMNP employees will occupy a portloa of the Fire Operations Center and will not have routine access to the Town bay unless necessary for building maintenance, upkeep, and repair, or in the event of an elnergency. 2. Space to expand and add an additional two gatage bays to house additional Town struclural and/or wildland equipment is available at such time that the Town has the need und funds to cio so. At that time, construction plans and specifications wiu be coordinated by RMNP as owner of the property/buildiiig. 3. Each patty authorizes the use of radio fiequencies by the other agency for mutual aid incidents. 4. The parties will cooperate and share fire, all-risk, and other emergency services training opportunities as applicable. 5 ARTICLE III-TERM OF AGREEMENT - This agreement shall be effective for a period of five years from the date of final signature. unless it is terminated earlier by one of the parties pursuant to ARTICLE VIII below. Nothing in this agreement shall preclude either party from entering into similar agreements with other agencies. Civil Rights During the perform ance of this agreement, the parties agree to abide by the terms of the USDI-Civil Rights Assurance Certification, non-discrimination, and will not discriminate against any person because of race, color, religion, sex, or national origin. B. Officials Not to Benefit No member or delegate to congress, or resident Commissioner, shall be admitted to any share or part of this agreeinent, or to any benefit that may arise therefrom, but this provision shall not be construed to extend to this agreement if made with a corporation for its general benefit. C. Promotions Neither party shall publicize. or otherwise circulate, promotional material, which states or implies goverrimental, departmental, bureau or government employee endorsement of a product, service, or position. D. Public Information Release The Town of Estes Park must obiain prior government approval from the Chief Park Ranger for any public information release, which refers to the Department of Interior, or to any bureau, park uni t. or employee (by name or title), or to this agreement. The specific text. layout, photographs, etc. of the proposed release must be submitted with the request of approval. The NPS must obtain prior government approval from the Town of Estes Park for any public intormation release, which refers to the Town of Estes Park or any employee (by name or vitle), or to this agreement. A prepared resolution by the LETA board is presented for adoption at the next available Town Board meeting. These fees fund all 911 related costs required to operate the Estes Park Communication Center's computers, software, and training of 911 dispatchers. BEING A RESOLUTION ESTABLISHING A TELEPHONE EXCHANGE ACCESS FACILITY CHARGE AND A WIRELESS COMMUNICATIONS ACCESS CHARGE FOR THE LARIMER EMERGENCY TELEPHONE AUTHORITY EFFECTIVE JANUARY 1, 2008. WHEREAS, the Larimer Emergency Telephone Authority was created pursuant to § 29-11- 101, et seq., C.R.S., by an Intergovernmental Agreement Concerning the Implementation of an "E911" Emergency Telephone Service, dated November 14, 1990, between certain governmental entities located in Larimer County, Colorado; and WHEREAS, pursuant to the aforesaid statutory authority and by resolution of the Town of Estes Park on May 8, 1990, and Ordinance No. 4-98 properly adopted by the Board ofTrustees on February 10, 1998, the Board of Trustees is authorized to raise, lower, or reestablish a telephone exchange access facility charge and a wireless communications access charge to be assessed telephone (wireline and wireless) service users in the Town of Estes Park; and WHEREAS, the Board ofTrustees deems that reestablishing the telephone exchange access facility charge at the rate of forty-five cents ($.45) per month and the wireless communications access charge at the rate of forty-five cents ($.45) per month is necessary and appropriate to adequately fund emergency telephone services in the Town of Estes Park; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO, AS FOLLOWS: 1. WHEREAS, the Larimer Emergency Telephone Authority (LETA) was created pursuant to Section 29-11-101, et seq., C.R.S., by an Intergovernmental Agreement Concerning the Implementation of an E-911 Emergency Telephone Service dated November 14, 1990, between certain governmental entities located in Larimer County, Colorado; and WHEREAS, pursuant to the aforesaid statutory authority, Larimer County, Colorado, and the incorporated municipalities which are signatories to the aforesaid Intergovernmental Agreement are empowered to annually establish a telephone access facility charge and a wireless communications access charge for the Larimer Emergency Telephone Authority; and WHEREAS, by the terms of this Resolution, the Board of Directors ofLarimer Emergency Telephone Authority desires to recommend to the County of Larimer and the participating municipalities that the telephone exchange access facility charge and the wireless communications access charge remain unchanged for the calendar year 2008; NOW, THEREFORE, BE IT RESOLVED BY THE ·BOARD OF DIRECTORS OF LARIMER EMERGENCY TELEPHONE AUTHORITY AS FOLLOWS: 1. Thatitis recommended that effective January 1, 2008, the County ofLarimer andthe participating municipalities reestablish the telephone exchange access facility charge and the wireless communications access charge at forty-five cents ($.45) per month per exchange access facility or per wireless communications access. 2. That copies of this Resolution be transmitted to the County of Larimer and the participating municipalities with the request that the charges set forth herein be promptly adopted. 3. That upon the establishment orreestablishment ofcharges bythe County ofLarimer and the participating municipalities, the Larimer Emergency Telephone Authority shall forthwith notify all telephone service suppliers affected thereby of the establishment or reestablishment of these charges effective January 1, 2008. 1 .
