The department is recommending revisions to the following approved policy and procedures: 1. BudgeUCosts n/a Recommendations Staff recommends approving the policy presented for revision. 1 ESTES PARKPOLICE DEPARTMENT EVIDENCE CUSTODIAN/PATROL OFFICERS PROPERTY RECORDING RESPONSIBILITIES CACP Standard: 200.1 - 200.8 Issued: 11-01-2004 Page 1 of 8 A. Purpose To establish the control and inventory of evidence received by members of this agency and identify the duties of the department's evidence custodian. B. Policy jThe Estes Park Police Department understands the neces@ty to maintain thei integrity and proper storage otfound- property, received_evidence, and the broper disposal of these items. Therefore, one person is assigned lesponsibility as Evidence Custodian. This position requires responsibility off receiving, recording, storing, and disposing of evidence. The evidencd bustodian shall work under the direct supervision of the Investigationd ~Sergeant who is responsible for the overall operations of evidence collection! preservation, and disposition._The_Investigations_Sergeant-reports_directly-td ghe_Police_Commanded *Fevidenbe-and--property received by officers and civilian employees of this' 6epartment sh&11 be submitted_for_storage_as_soon_as_possible_but no_longe; than-by-the_end_ofwatch.1 This property will be inventoried, logged, chain of custody properly ide-fitified and secured in the department's evidence storage facility_by the evidence custodian. iThis-facility is kept locked and is accessibl@ by the evidenle custodian- or the Investigations Sergeant. Evidence - Designated Evidence Storage Locations: • Estes Park Police Department • Estes Park Fish Hatchery (for large items) Officers of this department shall submit evidence at the Estes Park Police Department's evidence facility regardless of circumstances with undo delay to maintain the integrity and chain of custody, those items are: EPPD Policies and Procedures 11-01-04 Revision04/24/06 (Subsection G) ESTES PARKPOLICE DEPARTMENT EVIDENCE CUSTODIAN/PATROL OFFICERS PROPERTY RECORDING RESPONSIBILITIES CACP Standard: 200.1 - 200.8 Issued: 11-01-2004 Page 2 of 8 1. Evidence retrieved from a crime scene having evidentiary value. 2. Photographs having evidentiary value. 3. Found property turned in by a citizen or found by an officer regardless of value. 4. Items for safekeeping if reasonable and requested by a citizen and approved by a supervisor. Items not to be brought on the premises and booked into the Estes Park Police Department's evidence facility are: 1. Any explosive devices. 2. Any dry fireworks. 3. Any gasoline, diesel fuel, or similar combustible materials. 4. Any loaded firearms which cannot be rendered safe for handling. 5. Any military ordinances of any kind. 6. Any noxious substances or liquids. These types of evidence or property shall be taken to the alternate site location, the Fish Hatchery Facility. In the event that the item to be submitted for booking is dangerous to the officer or possibly to the evidence custodian the Colorado Bureau of Investigation Office shall be contacted and requested to retrieve such evidence for proper storage or disposition. In all cases when property is submitted for storage in the department's evidence facility, chain of custody shall be recorded by officer's name; date; time received; location received from; location item booked; date item booked; and time item booked. D. Evidence/Found Property Submittal There are two acceptable locations that police officers shall submit property as found property or as evidence. The first location is at the Estes Park Police Department and the second is the Estes Park Fish Hatchery location. The following booking procedures shall be adhered to with all property recovered or submitted by any officer or civilian employee of the Estes Park Police Department. Larger items shall be stored at the Fish Hatchery control facility and properly secured. All booked property shall be inventoried b~ the evidence custodian the next business day and removed from the temporary locker and submitted into the police department's evidencd 6torage facility. Evidence needed for criminal trials shall remain secured in the department's evidence storage facility until proper authorization for release has been received in writing by the presiding court or the district attorney's office. 7. If possible the evidence custodian will attempt to photograph evidence items to be returned to the owner if allowed by the courts or the prosecuting attorney. 8. All evidence will be submitted into a temporary storage locker the Evidence custodian will retrieve all items submitted each business day and inventory this property. Storage All large items and hazardous items shall be stored at the Estes Park Fish Hatchery for storage, at no time will any of the items be left within the confines of the Estes Park Police Department building other than for immediate processing purposes. 2. Disposition The evidence custodian is responsible for the disposition of all items stored at the Fish Hatchery facility. The expeditious disposition of these items shall be the sole responsibility of the Investigations Sergeant once evidentiary value has been determined for the items. F. Annual Evidence Inventon; ~fo insure all property, either evidence or found property, is received bv members of the Estes Park Police Department and is correctly submitted fo~ temporary storage or permanent storage. To insure all items received through the department's property submittal process are accurately recorded! the department will conduct an annual evidence inventory. The Polic4 ,Commander will assign the annual inventory responsibility to a Patg! The evidencd inventory.will be-conducted on.the Second.Mondayofeach New_Year.1 The results of that inventory will be maintained in department archives for a period of seven years or longer dependant on the type of evidence and the criminal case associated with the evidence. A written report will be submitted to the Chief of Police no later than the last Friday of January of the New Year. The report shall contain the following information: 1. The name of the sergeant who conducted the inventory. 2. The name of the evidence custodian for the year of the inventory. 3. Every item maintained in the department evidence storage facilities. 4. A comment on whether an actual physical inspection of the evidence was conducted or a review of a photograph of evidence was conducted. 5. The dates and times the inventory occurred. 6. Indicate the times and date a review of the department's evidence computer inventory files was conducted. 7. A chain of custody that delineates date, time, and location of property. Upon completion of the annual inventory process the evidence custodian shall review and report through the proper chain of command any discrepancies uncovered as a result of the inventory. The evidence custodian shall submit any recommendations for change or improvements within the evidence/property system in writing for review. The evidence custodian shall submit comments regarding the inventory process with any suggestions for change or improvements. 13. These 12 ft trailers hold supplies for any mass causality incident that may occur in our area or other areas within Colorado and more specifically within the 11 counties comprising the Northeast All Hazards Region. RETAC identified Estes Park as a critical location for one of these trailers. As the first response agency for this type of incident, the fire department was chosen as the recipient of this unit. Equipment list is attached. Budget: Minor budget impacts w/ insurance. Recommendation: It is staffs recommendation that the Town of Estes Park accept this MCI trailer along with the provisions for use, as specified in the existing MOU with Larimer County, with regard to the use of the equipment and availability of equipment that is purchased with Homeland Security funding. This was accomplished. In the Homeland Security Grant 2004 Radio's were the major part of the HLSG but Mass Casualty Incidents was still being worked on as some equipment through a Hospital Preparedness grant was allocated to agencies who did not have any Mass Casualty equipment. In the Homeland Security Grant 2005 Mass Casualty Equipment was recognized as a need in area's who had the greatest potential with the least amount of resources. Due to time and distance it was decided to utilize smaller trailers instead of one large trailer for the entire region. It was felt that getting some equipment early was better than a lot of equipment later. Unfortunately the original project of 11 Mass Casualty trailers was denied by the state All Hazards Committee. Only 3 trailers were funded. However by working with the Federal programs for Hospital Preparedness Grant (HRSA) two grants were leveraged to provide 6 Mass Casualty Trailers. Agencies were identified by a working group made up of EMS representatives from Poudre Valley Hospital, Weld County Paramedics, Washington County Ambulance, City of Yuma Ambulance, Kit Carson County EMS and two Regional EMS/Trauma Advisory Councils. The agencies identified by this working group of having the greatest potential with the least amount of resources were 1. Sedgwick County a. Sedgwick County Ambulance 2. Washington County a. Washington County Ambulance 3. Eastern Yuma County a. Wray Volunteer Fire Department 4. Logan County a. City of Sterling Fire Department 5. Cheyenne County a. Cheyenne Wells Fire Department 6. Western Larimer County a. Estes Park Volunteer Fire Department These agencies were chosen as they had long standing relationships with their EMS counter parts or had good resources to house and transport the trailers. In addition each of these agencies were strategically located as equidistant between other resources as to provide the most rapid response to an Mass Casualty Incident. Since the 2005 Homeland Security Grant, both RETAC's along with the Northeast All Hazards Region are partnering with each other to provide Mass Casualty operational plans throughout the 11 county All Hazards Region. The Northeast Colorado RETAC is providing funding for developing the curriculum based on the operational Mass Casualty plan adopted by the Northeast Physicians Advisory Board. This curriculum should be delivered within 120 day's from execution of the contract on May 24th 2006. We are hoping that the Northeast All Hazards can come up with Homeland Security Funds to deliver this curriculum through a train the trainer process and then through delivery across the 11 county region. However that works out, equipment will still be needed as Mass Casualty's will happen either large or small and the equipment will be in place. It is hoped that those agencies receiving Homeland Security Grant equipment/trailers would respond to incidents outside their jurisdiction if requested. No formal agreements can be signed at this time but that is in the works. Your Agency Here agrees to provide oversight of these supplies on behalf of the Northeast Colorado Regional EMS/Trauma Advisory Council as defined below: • Inventory all items upon receipt and document date and time items are received, individual responsible for checking in items and storage location of all items. • Store all items in an appropriate manner and in an appropriate environment to maintain the safety and integrity of the items. • Store all items in the Trailer supplied that allows for easy access by EMS personnel in the event that the cache needs to be activated. • Inventory all items every twelve (12) months. o Document that the seal is intact on the door monthly and break the seal to inspect the items every 12 months. • Ensure that sufficient security exists to guarantee the safety of the cache from damage or theft. • Post an inventory list near the cache to be used to track items removed due to damage or use. Document those items used or damaged. Report these items to the Northeast Colorado Regional EMS/Trauma Advisory Council regional coordinator. o Breaking the seal on the door constitutes an inspection on the items and documentation needs to be supplied as to integrity and amounts of supplies/equipment. • Northeast Colorado Regional EMS/Trauma Advisory Council will notify all EMS agencies and emergency managers within the Northeast All Hazards Region of the cache location(s) and the process to be used to access and activate the cache. o By retaining this Cache you're agency agrees to respond to requests for the cache as needed. This response may mean transportation of the cache within the trailer supplied to a specified location either to transfer to another agency or to provide equipment on the scene as needed. • Keep documentation in an accessible location within the agency for easy access by agency and hospital personnel. Copies of documentation will be provided to the hospital after each inventory. • If in the case that equipment is lost or used as in the case of a Mass Casualty Incident (not exercise) your agency will not be responsible for replacement of the equipment. If in the case of a local emergency (non declared) all efforts to replace the disposable or lost equipment will be done through an emergency grant through the efforts ofthe Northeast RETAC. If in the case of a disaster declaration all efforts to replace the equipment will be done through the Department ofLocal Affairs.
