This training was scheduled for 2005, however we did not accomplish this task. In an effort to accomplish this training goal the department is requesting to sole source this training with Griggs Achievement Academy who the Town has used in the past. And is currently using for Police Department supervisory development training. The Police Department and Finance Department would like to collaborate and combine efforts for both departments to receive this training. This would include sharing costs which have been pre-arranged. The Police Department has adequate space savings within the 2006 budget to pay for this training program. Attached are the course outline, cost of services, and a customer service survey to be distributed to all employees within the two departments. Budget/Costs The training is for 40 students (Police and Finance combined) for a total cost of $9,600.00 (That is a Per Student Cost of $240.00) Recommendations Staff recommends approving and retaining the services of Griggs Achievement Academy to provide this training in May and June of this year. This year the department has established new policies in the following areas: 1. Segway Patrol (attached) 2. Internal Promotional Processes (attached) The department is recommending revisions to the following approved policy and procedures: 1. Burglary Target Cards (section 3. (1) a., b., & c. and section 3 (2) a. (attached and highlited in blue pg. 2). 2. Organizational Structure (Section C. pages 2-4 highlited in blue). 3. Non-Lethal Force and Use of Non-Lethal Weapons ( section a. (7), section I., and section K., highlited in blue). 4. Firearms Training (section C-2. a. (7-12), section 2. b. (8-10), 2. c., and E-2 h-j), and G. 6.). 5. Bicyde Patrol (section D., section F. 1., 4., and 6., and section G. blue highlited). Budget/Costs Na Recommendations Staff recommends approving the new policies presented and the policies presented for revision. 1 ESTES PARK POLICE DEPARTMENT SEGWAY PATROL CACP Standard: NA Issued: 03-25-06 1 of 4 A. Purpose The purpose of this policy is to establish a uniform procedure for the Estes Park Police Department Segway Patrol Unit. B. Policy It is the policy of the Estes Park Police Department to maintain a Segway Patrol Unit which is not only effective, but is as safe as possible for the officers and the department. The program will provide optimum mobility and high visibility to aid in the reduction of crime in the Town of Estes Park and encourage contact with the public to increase Community Relations as well as Community involvement. C. Administration The Segway Coordinator will administer the program. The Commander shall designate the Segway Coordinator. The coordinator will be responsible for the unit's maintenance program, coordinating rider training with the training sergeant and the entire record keeping. D. Assignment The Segway Patrol Officer position is voluntary. The Police Commander will select qualified officers. E. Care of Equipment and Supplies The Police Department will furnish the basic equipment and maintain the Segway necessary to deliver quality service to the community. Damage and/or abuse or injury will be handled consistent with existing procedures. Basic maintenance and rider training will be provided to participants. Supplies include the Segway, the helmet, eye protection, the shirt and shorts, and rain gear. EPPD Policies and Procedures 04-01-2006 ESTES PARK POLICE DEPARTMENT SEGWAY PATROL CACP Standard: NA Issued: 11-01-04 2 of 4 F. Uniform and Accessories Segway officers shall, at all times, maintain a high standard of dress and general appearance. As a part of the Patrol Unit, members must wear the departmental approved bike uniform when patrolling on a Segway. Segway Officers may wear approved apparel accessories, at their discretion due to temperature changes and/or inclement weather. When not on Segway patrol, officers will wear their standard department uniform. Segway officers may wear departmental approved clothing as assigned. 1. Protective Head Gear A departmental approved helmet will be worn at all times the Segway is in motion. The helmet will be white or black in color and have a "POLICE" decal on each side. 2. Shons Shorts worn by Segway officers shall be department approved. They should be loose fitting with several pockets and belt loops. 3. Lonq Pants Long pants worn by Segway officers shall be department approved. They should be loose fitting with several pockets, belt loops and ankle tie downs. 4. Shirts Shirts worn by Segway officers shall be uniform style, navy blue in color. Each shirt will have the officer's name located on the right front chest. Each shirt will have a Estes Park Police Department cloth badge on the left front chest. Shirts should have a longer tail side to ensure a proper fit. 5. Foot Wear A good quality department approved athletic shoe must be worn. 6. Socks Socks will be of an athletic type, no stripes or logos. EPPD Policies and Procedures 04-01-2006 ESTES PARK POLICE DEPARTMENT SEGWAY PATROL CACP Standard: NA Issued: 11-01-04 3 of 4 7. Eve Protection Eye protection should be worn at all times the Segway is in motion. The eye protection should be either clear or tinted lenses made of a safety type material. 8. Jackets Jackets worn by the Segway officers shall be department approved. 9. Hand Protection Gloves worn by the Segway officers shall be black in color, full or half- fingered style. Riders are encouraged to wear gloves with padding to protect the palms of the hands when the Segway is in motion. Cycling gloves provide two forms of protection. The most obvious is the protection it offers when the rider lands during a fall. Greater significance is the fact that the padded palms helps prevent Carpal Tunnel Syndrome, an injury associated with the constant gripping a rider does while holding on to the handlebars. 10. Dutv Belt The duty belt and accessories will be of black nylon. G. Police Seaway The designated Segway is a modified XT model. The Segway will be equipped with front, side, and rear reflectors, a rack over the front handle bar to facilitate an equipment bag, a kickstand, and headlights. H. Seqwav Function The Segway Patrol Officers will perform duties such as routine patrol, directed patrol of problem crime areas, schools, business areas, crime prevention and community relation activities. The Segway Patrol Officers will be made available for special assignments as necessary. The Patrol Officers will be allowed to use the Segway as a method of patrol providing at least one other officer is on duty in a marked patrol car. Officers will respond to calls for service and take reports. Segway Patrol Officers will not be dispatched as primary officers in any calls for service when emergency lights or equipment are required. On duty riding habits must be a good example of safety and courtesy for others. Community Relations All officers' participation in the Segway Patrol Unit is expected to interact with the community, making positive contacts during the course of duty. J. Training Police Segway Officers will successfully complete a law enforcement Segway patrol training course. The training will cover riding a Segway, policing on a Segway, officer safety, Segway laws and regulations, etc.. K. Professional Bearing Segway Patrol Officers shall at all times exhibit a high standard of professionalism, tactfulness, and courtesy to others. Segway Patrol Officers shall maintain an attitude of professionalism, which will reflect well upon the program as well as the Estes Park Police Department. EPPD Policies and Procedures 04-01-2006 ESTES PARK POLICE DEPARTMENT PROMOTIONAL PROCESS CACP Standards: N/A Issued: 04-21-2006 Page 1 of 7 A. Purpose To provide clarity, consistency, and standardize promotional processes within the Estes Park Police Department. B. Policv Selected promotional processes used within the Police Department intend to identify the most qualified candidate(s) for vacant positions. EPPD administration shall adopt the use of contemporary promotional practices to select candidates eligible for vacant non-supervisor, supervisor, or management positions. Police Administration shall attempt to fill vacancies with qualified internal candidates. However, if limited or no qualified candidates are available external applicants shall be recruited to fill the positions. Those supervisory positions include: • Police Sergeant • Police Commander • Support Services Supervisor • Support Services Manager Positions that involve non-supervisory promotions include: • Police Officer 11 • Police Officer 111 • Master Police Officer • Emergency Services Dispatcher 11 • Emergency Services Dispatcher 111 All candidates must complete the established processes below. C. Procedures Included within this policy are flowcharts outlining supervisor and non- supervisor positions, these flowcharts are located in sections (F) and (G) of this policy. 1. Vacant Supervisor positions process The Police Department Leadership Team (administration) shall determine if the need exists to seek candidates from outside the agency using the following criteria: EPPD Policies and Procedures 04/21/2006 ESTES PARK POLICE DEPARTMENT PROMOTIONAL PROCESS CACP Standards: N/A Issued: 04-21-2006 Page 2 of 7 a. Evaluate current internal employee qualifications (do they meet the minimum requirements for the position). b. Determine employee interest. c. Identify number of eligible applicants from within the department promotional pool. 2. Once a determination is made Town of Estes Park policies shall be followed for Internal Job Announcements using the Town of Estes Park internal communication system (email and postings). Once an this time frame has expired: d. Internal applicants will submit an application packet. The packet shall include the following: 1. A letter of interest outlining the candidate's qualifications 2. A resume with references 3. A written report outlining a community or department issue identified by the candidate with recommendations for corrective action. 4. Copies of certifications 5. Copies of commendations 6. Copies of relevant training certificates. 7. Copies of college transcripts (if applicable). e. An assessment board will be convened to evaluate the applicants. The promotional processes shall include an assessment process intended to identify the following skills and capacities of the candidate: 1. Leadership skills. 2. Character. 3. Management skills. 4. Overall potential. 5. Relevant experience. 6. A review of the candidate's application packet. c. The assessment can be comprised of the following but is not limited to: 1. An oral resume. 2. Leadership panel question and answer. 3. A practical exercise. Interview with the Chief of Police and a Command staff member. d. Candidates are rated by the assessors. e. All tabulated scores are submitted to the Chief of Police for review. f. Internal candidates final scores and past performance evaluations are considered before presenting a final decision. g. Executive discretion is allowed by the Chief of Police when making a selection however, in most instances the overall top candidate will be selected. F. Non-Supervisory Promotional Process 1. Supervisors must identify employees eligible for promotion in conjunction with the Town budget cycle. Names of employees must be submitted to the Commander or Support Services Manager no later then May 1 of the bi-annual budget year. 2. Purpose The purpose of this policy is to establish a uniform procedure for the Estes Park Police Department Bicycle Patrol Unit. B. Policy It is the policy of the Estes Park Police Department to maintain a Bicycle Patrol Unit which is not only effective, but is as safe as possible for the officers and the department. The program will provide optimum mobility and high visibility to aid in the reduction of crime in the Town of Estes Park and encourage contact with the public to increase Community Relations as well as Community involvement. C. Administration The Bicycle Coordinator will administer the program. The Commander shall designate the Bicycle Coordinator. The coordinator will be responsible for the unit's maintenance program, coordinating rider training with the training sergeant and the entire record keeping. D. The eye protection should be either clear or tinted lenses made of a safety type material. 8. Jackets Jackets worn by the bicycle officers shall be department approved. 9. Hand Protection Gloves worn by the bicycle officers shall be black in color, full or half- fingered style. Riders are encouraged to wear bicycle gloves with padding to protect the palms of the hands when the bicycle is in motion. Cycling gloves provide tow forms of protection. The most obvious is the protection it offers when the rider lands during a fall. Greater significance is the fact that the padded palms helps prevent Carpal Tunnel Syndrome, an injury associated with the constant gripping a rider does while braking and holding on to the handlebars. 10. Bicycle Function The Bicycle Patrol Officers will perform duties such as routine patrol, directed patrol of problem crime areas, schools, business areas, crime prevention and community relation activities. The Bicycle Patrol Officers will be made available for special assignments as necessary. The Patrol Officers will be allowed to use the bicycles as a method of patrol providing at least one other officer is on duty in a marked patrol car. Officers will respond to calls for service and take reports. Bicycle Patrol Officers will not be dispatched as primary officers in any calls for service when emergency lights or equipment are required. This is a computerized system that allows the user to enter license plate information into a handheld device and downloaded onto a stand alone computer. The Town of Estes Park has used this system in the past for parking enforcement and parking data gathering purposes. For 2006 the police department will continue to enforce parking violations when necessary, however the need to gather accurate data of parking demographic information is critical to future parking management by the Town of Estes Park. Wth that said the department contacted Clancy Parking Systems Inc. to retain their services for the upcoming summer season. Parking responsibilities shall be that of the assigned downtown Master Police Officer and Community Service Officer Staff. The contract has been reviewed by Town Attorney White. He provided minor revisions and is satisfied with the content of the contract Budget/Costs Equipment Use (4) months X $150.00 per month = $600.00 Additional expenses are anticipated for ticket and written warnings printing costs (amount is unknown since baseline information is unavailable). Recommendations Staff recommends approving the contract with Clancy Systems Inc., for the 2006 year. 1 AGREEMENT BETWEEN Clancy Systems International, Inc. 2250 S. Oneida #308 Denver, Colorado 80224 and Town of Estes Park PO Box 1287 Estes Park, CO 80517 This Agreement made and entered into this 1 st day of May, 2006, by and between the Town of Estes Park, CO, hereinafter referred to as the "Town" and Clancy Systems International, Inc., hereinafter referred to as the "Company". WITNESSETH WHEREAS, the volume of parking violations now being issued and handled by the Town has reached a level that an automated system for the issuance and processing of parking citations may be cost effective; and ~ WHEREAS, the Company is in the business of providing a computerized parking control and enforcement systems that may prove to be effective and compliment the Town's parking operations; and WHEREAS, the Town desires to implement an automated parking citation writing and enforcement system; and WHEREAS, the Company has evidenced a willingness to install and implement its system at the Town on a service contract basis. NOW, THEREFORE, in consideration of mutual covenants, promises and agreements herein set forth, it is agreed as follows: 1. PORTABLE DATA ENTRY EQUIPMENT The Company will provide all portable data entry terminals and accompanying printers for use by the Parking Enforcement Officers in the field. There shall be one unit for each officer plus an on site spare. 2. OFFICE COMPUTERS AND OTHER EQUIPMENT The Company will provide a computer and printer, storage and charging racks, and all equipment needed to support the office data acquisition and data processing tasks. 3. SUPPLIES The Company will provide all preprinted citation forms, payment envelopes, and batteries. 4. EQUIPMENT WARRANTY The Company unconditionally warrants all equipment. At any time during the contract, or any renewal thereof, Company will provide for repair or replacement of equipment regardless of the reason for malfunction, even if from misuse, without cost. On site spares will be provided in addition to the required number of portable data entry units with printers during the term of the contract and any renewal thereof. The Town recognizes that the field units are computers and printers, and, although ruggedized for portable use, do require care to ensure the integrity of same. The user shall take required measures to protect from frequent drops, exposure to extreme weather conditions and at all times treat the equipment with respect. The Company will provide special mounts, mounting materials and plastic covers upon the request of the Town. 5. INSTALLATION The Company will install the System (System is defined herein as all hardware described above or listed on any exhibit and all custom software for ticket issuance, processing and management). The initial installation and training period shall include a Company representative on site at the Town for 3 business days. 6. SOFTWARE The Company will produce all custom programming and procedures for both the office computers and data entry terminals to reflect the Town's requirements. Company personnel will devote such time as is necessary to familiarize themselves with the Town's protocol for citation generation and the general geography and logistics of the Town. The Company will provide ticket management software including ticket management reports, complaint generation, notices, permit information management, as well as other reports as required. The Company shall put forth best efforts to deliver the initial system software and any additional software provided to, or developed for the Town in error free form. Company shall promptly debug and correct any deficiencies upon notice of defect from the Town. 7. SITE LICENSE By execution of this contract and any extensions thereof, the Town is granted a site license to use the system software and any modifications or customization thereof to operate its computerized parking citation issuance and management operations. This software is protected by both United States copyright law and international treaty provisions. Clancy grants the Town the right to make archival copies of the software for sole purpose of backing up and protecting your data from hazard or loss. You may not give copies to another person, Town, organization Lor duplicate the software by any other means including electronic transmission. The statements in this section of the contract shall be construed, interpreted and governed by the laws of the state of Colorado. 8. CONSULTING SERVICES The Company agrees to be immediately available for consultation by telephone when required at no additional cost. UPDATES The Company will provide updating and improvements to the system as needs arise and as new technology becomes available. Such updates shall include hardware upgrades, software updates and software enhancements and will be provided at no additional cost to the Town. Software updates and enhancements shall be delivered by diskette or be loaded directly on-line by modem transfer and/or internet FTP connection. 10. TRAINING The Company will provide training for officers who will be using the ticket issuance devices in the field and for all personnel who will work on system management on the PC computer(s). 11. SUPPORT The Company shall provide ongoing system support for the term of the contract and any renewal period thereof. Support shall include telephone support, on-line modem support, overnight delivery of critical materials, and on-site visits as required. 12. ACCESS The Town will provide the Company with reasonable and appropriate access to both the officers writing parking tickets and to data processing personnel who will be using the computer systems. 13. INTERNET PAYMENT PROCESSING The Company shall, at the election of the Town, create and host a web site for payment by credit card (Visa and Mastercard) and checks for citations, permits and other services as desired by the Town. There will be no charge to the Town for this service. A $2.50 handling fee is added to the remitter's costs. The funds shall be transferred to the Town either once each week or once each month (agency shall elect payment schedule). Payment shall be made by check to the agency or direct ACH transfer into the agency's bank. A spread sheet of detail (transaction number, ticket number and payment amount) shall be provided with each settlement for verification. 14. DMV lookup The company shall obtain registered owner information for the Town for Colorado License plates and provide the Town with a full notice issuance program. 15. Notice Letter Processing Should the Town decide to outsource the notice letter generation, the Company can provide the service at a fee of $.68 per license plate submitted (the Town acknowledges that all plates may not result in obtaining correct owner information for letter generation). 15. PAYMENT The Town agrees to pay $.38 for each ticket form purchased and $150 per month for system computer and support fee for primary system computer (additional nodes are charged at $100 per month per PC/support). The Town may have need to contract the system on a seasonal basis. This shall be defined in Exhibit B attached hereto. 16. NON-DISCRIMINATION CLAUSE The Company agrees not to discriminate against any employee or applicant for employment because of age, race, creed, color, sex, national origin or ancestry. The Company shall take affirmative action to insure that employees are treated without regard to their age, race, creed, color, national origin, sex or ancestry. Such actions shall include, but not be limited to the following: employment, upgrading, demotion or transfer, of pay or other forms of compensation and selection for training, including apprenticeship. In the event of the Company's non-compliance with this non-discrimination clause, the contract may be canceled or terminated by the Town. The Company may be declared by the Town ineligible for further contracts with the Town until satisfactory proof of intent to comply shall be made by the Company. The Company agrees to include this non-discrimination clause in any subcontracts connected with the performance of this agreement. 17. NOTICE Any written notice provided for hereto shall be deemed properly mailed and delivered when the same is deposited in the United States mail, postage prepaid and properly addressed to the party to whom such notice is directed. PROPERTY TAX, SALES TAX, USE TAX, EXCISE TAX, OTHER SPECIAL LICENSES Any property tax due on the hardware placed on Town premises for use by the Town shall be the responsibility of the Town in such event that the Town does not have tax exempt status. Should the Town fall under tax exempt status provisions, such hardware shall fall under such provisions. Any applicable sales tax, use tax, excise tax or other special taxes or licensing requirements shall be paid directly by the Town to the proper taxing agency. The Company shall not be required to collect, file and transmit such taxes on behalf of the Town. 19. OWNERSHIP On lease and transactional contracts all hardware, software and source code shall at all times remain the exclusive property of Clancy Systems International, Inc. At the expiration of the contract term, all equipment shall be returned to the Company. Any missing equipment shall be billed to the Town at depreciated value. On purchase contract, software and source code shall only be used while under contract and periods where license/support fees are paid. 20. RETURN OF SYSTEM For lease and transactional contracts, subsequent to non-renewal or cancellation of contract, all system hardware and peripherals placed on Town premises for use during contract term shall be properly packaged and returned to the Company in good working order. All software provided for system use during the term of the contract shall no longer be used nor shall any copies of the software be made and transferred to other equipment. 21. TOWN PROVIDED RESPONSIBILITIES The Town shall be responsible for providing the following items: 1. Desk or table top space to accommodate field units, chargers, and system computer and printer. 2. A dedicated modem telephone line 3. A staff person assigned as the system administrator. This person shall be given in depth training, shall be the liaison between the Company and the Town, and shall have the responsibility of operating the system and providing training to new personnel. 4.
