NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: Section 1. Section 10.04.010 of the Municipal Code is hereby amended to read as follows: 10.04.010. Model Traffic Code Adopted. The Model Traffic Code for Colorado Municipalities, Revised 2003, hereinafter referred to as the Model Traffic Code, is enacted and adopted herein by reference as a primary code. 10.04.030. This year, the event is held between Thursday, June 26th and Sunday, June 29th. We will be holding a seminar on Wednesday, th r June 25 ior all officers involved in the event to provide training in the Incident Command System and crovid control techniques as well as an orientation to the Country Jam event. For the 2003 festival, we are requesting the services o f two of your officers; they are encouraged to bring crowd control equipment and appropriate tactical uniforms for storage on site. My understanding is those who participated genuinely found the workshop to be educational and beneficial. However, the purpose of this letter is to follow up on our conversation pertaining to underage drinking enforcement within the Town of Estes Park and surrounding Estes Valley. Recently, the Colorado Department of Transportation awarded our department S10,000.00 in gr~~unding to address underage drinking issues within our community through education and enforcement. In preparation for addressing this issue, department staff discovered many of the underage drinking issues is occurring outside the Town limits of Estes Park. Because of the unique circumstances that involve our community youth, we have dealt with the inability to effectively address the enforcement of underage drinking parties. As you may know, our community teen's range in age from fourteen through eighteen years of age, attend the local high school but yet many of these students reside outside the Town limits of Estes Park. This situation creates substantial roadblocks for the Estes Park Police Department in our efforts to impact our number one juvenile problem, underage drinking. (970) 586-4465 · RO. The basic concept of our grant enforcement project is to actively enforce underage drinking and possession of alcohol using both the traditional criminal justice system and the Estes Valley Restorative Justice System. In any event, when the Estes Park Police Department conducts these enforcement efforts that take our activities outside the town limits we will notify your on-duty supervisor of our activity and the locations we intend to address. Section 42-2-125 (1)(m) CRS provides that the Department (the Colorado Department of Revenue) shall immediately revoke the license or permit of any driver or minor driver upon receiving a record showing that such driver has been convicted of violating Section 12-47-901 (1) (b) or (1)(c) CRS or Section 18-13-122 (2) CRS or any counterpart municipal charter or ordinance offense to such sections. The Town of Estes Park has enacted Section 9.20.050 ofthe Municipal Code, which provides that the Municipal Court shall require the surrender of a driver's license, minor drivers license or provisional drivers license to the Court upon conviction of a violation of Section 9.20.010 of the Municipal Code. Section 9.20.010 is the Underage Possession or Consumption of Ethyl Alcohol. The Municipal Court sentencing provision of Section 9.20.050 is authorized by the specific language of Section 42-2-125 (1)(m) CRS. The state statute on revocation of drivers license does contain a provision allowing revocation for use of a controlled substance as defined in Section 12-22-303 (7) CRS. The state statute 42-2-125 (1)(b) CRS requires revocation ofthe drivers license if the person has been convicted of driving a motor vehicle while under the influence of a controlled substance. The difference in these two situations is the fact that state statutes allow revocation of the drivers license for the possession and consumption of ethyl alcohol for any underage person without reference to driving a motor vehicle. The statute for revocation involving a controlled substance requires conviction of driving under the influence of a controlled substance. The Town of Estes Park as a statutory town is limited in the types of ordinances it may adopt to those authorized by state statute. Revocation of drivers licenses are controlled by the state statutes. The Town does not have the ability revoke a drivers license absent specific statutory authority to do the same. It is my opinion that the Town does not have the grant of statutory authority to require the revocation of a drivers license for anything other than those offenses set forth in Section 9.20.010 of the Municipal Code. A change in the state statutes would be necessary for the Town to have the authority to pass an ordinance requiring revocation of a drivers license for underage possession and/or use of a controlled substance. Report Status: Info Report Date(s)/Time(s) 05/02/03 - 06/10/03 Date Assigned: 06/11/03 Of Occurrence: Incident Name: Criminal Mischief, Theft Counts: 16 SYNOPSIS Between 05/02/03 and 06/10/03 a series of criminal mischiefs and thefts (vandalism) has taken place in Estes Park. Supposing that those incidents are related to each other, a spatial and temporal analysis of those incidents has been performed. The purpose of this analysis is to determine where and when the crimes took place, to determine if there exists a pattern and to determine where and when the criminals might strike again. 10 out of 16 incidents have taken place between 05/02/13 and 05/15/03. The following cases might be involved in this series: 03-681 03-687 03-688 03-689 03-703 (2 counts) 03-707 03-711 03-712 03-759 03-760 03-761 03-821 03-837 03-846 03-879 Van der Avoort #3038 DATE 06/11/03 Page 1 of 3 11 ESTES PARK POLICE DEPARTMENT REPORT NUMBER: - ESTES PARK, COLORADO SPATIAL ANALYSIS To present the locations of the different incidents, two different spot maps have been created. The first spot map (map 1) represents the incidents that have taken place between 05/02/03 and 05/15/03, which is the period that counts 10 out of 16 incidents. The second spot map (map 5) represents the incidents that have taken place between 05/02/03 and 06/10/03. Based on the spot maps, maps with the number of incidents per 0.05 square mile (map 2 and 6) and the number of incidents per district (map 3 and 7) have been created to present the areas where most of the incidents are concentrated. The spot map that covers incidents from 05/02/03-05/15/03 (map 1) shows that all incidents have taken place on Moraine Avenue, Big Thompson Avenue and East Elkhorn Avenue. To determine the possible crime path of the criminals, the locations of the different incidents were numbered. The spot map shows clearly that the first incidents have taken place on Moraine Avenue. The next two incidents have taken place in the area where Big Thompson Avenue intersects with Summit Dr and Hillside Lane. Finally the suspects have worked their way down from the west side of town, where Big Thompson Avenue intersects with Lone Pine Dr, up to Riverside Plaza, where the last incident in the period until 05/15/03 has taken place. After 05/15/03 the frequency of criminal mischiefs that were committed dropped. Between 05/21/03 and 06/10/03 six crimes were committed that might be related to the previous crimes, however three of those crimes were committed outside of the area where previous crimes were committed (map 5). The map with the number of incidents per square mile from 05/02/03 - 06/10/03 (map 6) shows the following concentrations of committed crimes: Big Thompson Avenue, from 34/36 to intersection with Hillside Ln and Summit Dr (600-1000 bl): 7 counts, 43,8% probability E. Elkhorn Avenue, from Riverside Plaza to 34/36: 2 counts, 12,5% probability Big Thompson Avenue, from intersection with Elk Trail Ct to intersection with Lone Pine Dr(1300-1600 bl): 2 counts, 12.5% probability Moraine Avenue, area of Telemark cottages (600-700 bl): 2 counts, 12,5% probability Manford Avenue, school area/Stanley Park (1500-1700 bl): 2 counts, 12,5% probability Fall River Road, 1200 bl: 1 count, 6,2% probability The map with the number of incidents per district from 05/02/03 - 06/10/03 shows that the highest concentration of crimes is found in North End (\Nest) (5 out of 16), which basically represents Big Thompson Avenue 500-1000. Van der Avoort #3038 DATE 06/11/03 Page 2 of 3 ESTES PARK POLICE DEPARTMENT REPORT NUMBER: - ESTES PARK, COLORADO - NEXT HIT PROBABILITY To determine the next hit probability two different methods have been used: Probability ellipses based on the standard deviation and probability rectangles based on Steven Gottliebs principles. Map 8 shows that there is a 68% probability that another crime will be committed in the area that basically covers downtown (E. and W. Elkhorn, Moraine 100-200), Wonderview Ave, Saint Vrain Ave, the northwestern parts of South St Vrain Ave and North St Vrain Ave, and 500-1000 Big Thompson Ave. Map 9 displays almost the same area but includes Big Thompson Ave up to the 1600 block. TIMESPAN ANALYSIS To determine at which time the criminals will most likely strike again, the equal opportunity method and the weighted method, as defined by Steven Gottlieb, have been used (Charts 1,2,3 and 4. Tables 1,2,3 and 4) Both methods show that there is a peak between 2200-2400. The weighted method, applied for incidents that occurred between 05/02/03 and 06/10/03 (Chart 4) shows that there is a probability of 32,8% that an incident occurs between 22:00-24:00 and a two-third probability (67.5%) that an incident occurs between 20:00-03:00. The equal opportunity method suggests that most of the crimes are spread out over a longer time span, basically from 20:00-07:00 (Chart 3) ANALYSIS OF PREFERRED WEEKDAYS .. Chart 5 shows that 42,8% of all criminal mischiefs were committed on a Monday/Tuesday night. For the 68% probability (Map 9) area, this percentage is even 54,5% followed by a probability of 27.3% for Saturday/Sunday nights. Within our 68% probability area no crimes were committed on Sunday/Monday, Wednesday/Thursday, Thursday/Friday or Friday/Saturday nights. CONCLUSIONS There is a 68% probability that criminals will strike again within the area that covers E. Elkhorn Avenue and Big Thompson Ave , from Riverside Plaza up to Lone Pine Drive, and its nearby surroundings. The probability is highest between 34/36 and Steamer Dr. Another area of interest is the 1500-1700 Block of Manford Ave, as crimes were committed there recently. The criminals will most likely strike again between 20:00 and 03:00 (68% probability) with a peak between 22:00- 24:00 (32.8%). Most incidents within our 68% probability area occur on nights from Monday to Tuesday (54.5%) and nights from Saturday to Sunday (27.3%). Recommendation for patrol: extra patrol and regular checks on E. Elkhorn Ave and Big Thompson Ave between Riverside Plaza and Lone Pine Drive between 20:00-03:00, particularly on Monday/Tuesday and Saturday/Sunday nights. The Mutual Aid Agreement is valid indefinitely or until either party decides to either terminate or amend the agreement. Platte River Power Authority has requested updating the agreement to include giving the Fire Chiefs of the respective parties the authority to establish written protocols, plans and procedures. Additionally, other wording has been changed for clarification. The new Mutual Aid Agreement has been reviewed and approved by the town attorney and the Town of Estes Park Fire Chief: Budget: There is no budget impact. Recommendation: Staff recommends that the Town of Estes Park, on behalf ofthe Estes Park Volunteer Fire Department, accept this agreement for the mutual benefit of both entities. FIRE SERVICE MUTUAL AID AGREEMENT 1 PARTIES. This agreement is between the Platte River Power Authority and The Town of Estes Park Fire Department (the "parties"). 2 RECITALS OF PURPOSE AND AUTHORITY. 2.1 Each party maintains a fire department, together with appropriate personnel and equipment, but from time to time is faced with emergencies beyond the capacity of its individual forces. 2.2 It is to the mutual benefit of each of the parties to assist the other when necessary in providing additional fire and emergency equipment and personnel for the purpose of fighting fires and responding to other emergency calls within the boundaries of the other party, and in turn to receive such assistance. 2.3 Sections 29-5-105 through 29-5-110, C.R.S., provide authority for the parties to give mutual aid. 2.4 Section 29-1-203, C.R.S., provides authority for the parties to make intergovernmental agreements. 3 DEFINITIONS. 3.1 The party responding to a request within the boundaries of the other party is the "answering party." 3.2 The party requesting aid under this agreement is the "requesting party." 3.3 "Fire Chief" means the Chief of the respective fire department or the Chief's authorized representative. 4 MUTUAL ASSISTANCE AND AID. 4.1 Each of the parties agrees to respond to requests for assistance within the boundaries of the other party upon request of the requesting Fire Chief at any time, but it shall be entirely within the discretion of the Fire Chief of the answering party as to what personnel and equipment shall answer such call and whether or not, in any event, such call is to be answered consistently with the safety and protection of the citizens and property of the answering party. 4.2 Any request for assistance should include a statement of the amount and type of equipment and personnel requested, and shall specify the location to which the equipment and personnel are to be dispatched, but the amount and type of equipment and number of personnel to be furnished shall be determined by the Fire Chief of the answering party. 4.3 The answering party shall report to the designated staging area for assignment by the requesting party's incident commander. The equipment and personnel that are assigned shall ·be under the immediate command of a superior officer designated by the answering party and accompanying them. 4.4 An answering party will be released by the requesting party when the services of the answering party are no longer required or when the answering party's resources are needed within the area for which it normally provides fire protection, emergency medical services or other emergency public safety services, for matters of cost, or matters of safety to the answering party's personnel and/or equipment, as determined by the Fire Chief of the answering party. 4.5 The Fire Chiefs of the respective parties are authorized to establish such written protocols, plans, and procedures as they deem useful and upon which they mutually agree, so long as they are consistent with this agreement and do not divest the answering party of its absolute discretion over the level of response, if any, to be provided in each case, and when it is to end. 5. FINANCIAL PROVISIONS. Any dispatch of equipment and personnel pursuant to this agreement is subject to the following additional conditions: 5.1 The answering party shall continue to be responsible for the pay and benefits of its firefighters, including any overtime, and the expenses incident to the operation and maintenance of its equipment. If the requesting party provides fuel or other incidental expendables, it shall do so without reimbursement by the answering party. 5.2 Each party waives all claims against the other party for compensation for any loss of or damage to firefighting equipment and for any loss, damage, personal injury or death sustained by firefighting personnel, which occurs as a consequence of the performance of this agreement., The provisions of this agreement shall not affect the right of any member of the answering fire department to receive workmen's compensation benefits pursuant to Section 29-5-109, C.R.S., or pension fund payments pursuant to Section 29-5-110, C.R.S. 5.3 The provisions of this agreement shall not affect the allocation of civil liability pursuant to Section 29-5-108, C.R.S. 6 GENERAL PROVISIONS. 6.1 Nothing in this agreement shall be deemed a waiver of any immunity granted under the Colorado Governmental Immunity Act, 24-10-101 2 seq., C.R.S. 6.2 Nothing in this agreement confers any benefits on any person not a party to this agreenaent. 6.3 This agreement is effective upon approval by the general manager of the Platte River Power Authority and the Fire Chief, and the Mayor of the Town of Estes Park Fire Department in accordance with Section 29-1-203(1), C.R.S., and continues until such time as either party gives sixty days advance written notice to the other party of its intention to terminate this agreement. I wanted to take this opportunity to thank those of you involved in the rescue efforts at "The Crack" on Sunday night, June 15 on Old Ranger Road. I work with an organization called Student Venture, with whom I was leading a team building event through "The Crack" that night. We have used this location close to twenty times before and never had a prob- lem. Unfortunately on Sunday night, Steve,an adult leader from Minnesota, got stuck in a vertical crack and we were unable to free him. He managed to get about halfway through before getting stuck, making it that much more difficult to access him for any help. After 30- 45 minutes of pushing and pulling I realized that he wasn't going anywhere. I had to make the decision to call 911 for assistance. I wante*to reiterate my appreciation for the patience, the materials, and manpower that went into the removal of Steve that night. I cannot be sure of the potential life threat that Steve faced in there, but I am certain that I felt very helpless in doing anything for him. Therefore, because I was responsible for that group outing, I cannot express how much of a relief it was to see him come free after six hours of being stuck. Your professionalism and calmness certainly helped Steve, myself, and the other students involved know that every- thing possible was being done, by the most qualified individuals. A special thanks also for the fact that this occurred from 11 pm -7am, when most of you would cer~nly have R[~- ferred to stay in bed.
