MEMORANDUM OF UNDERSTANDING Between Larimer Center for Mental Health And the 00- Town of Estes Park V Through the r Estes Park Police Department This Memorandum of Understanding is entered this Day of , 2002 between the Town of Estes Park through the Estes Park Police Department, herein referred to as "Police" and Larimer Center for Mental Health (LCMH), herein referred to as "Center" a comprehensive community mental health center licensed by the Division of Mental Health of the Colorado Department of Human Services and the Colorado Department of Public Health and Environment, a designated CRS 27-10-101 et seq. facility and a member center of Northeast Behavioral Health, LLC (NBH). Introduction WHEREAS, 1. Center is required by its licensure, CRS 27-10-101 et seq. designation, and certain contracts to provide twenty-four hour emergency services for mental health emergencies; 2. The Police are required by state, county and/or local statute to provide for the safety and protection of all residents of its jurisdiction; and 3. Center and the Police wish to work cooperatively regarding individuals of mutual concern so that each may fulfill its individual requirements to the greatest degree possible. NOW, THEREFORE, This Memorandum of Understanding (MOU) is made between the Center and the Police to specify the activities and responsibilities of each organization for the benefit and protection of persons of mutual concern. It CO 81 1- :- Memorandum Of Understanding Page 2 shall remain in effect unless and until terminated by either Party as described in this paragraph. The Parties agree to periodically review this MOU and to make adjustments as mutually agreed. Either Party may terminate this agreement with or without cause upon thirty (30) days' written notice to the other. The Parties shall mutually agree, in writing, upon modifications, amendments or other alterations. 1. Center Activities and Responsibilities • May call for Police assistance when a mental health consumer's statements or behavior lead a Center staff person to believe that the consumer may need to be guarded or restrained to prevent harm to self or others while arrangements are being made to facilitate a disposition. • Will request the involvement of the Police only when that involvement appears essential to protect the consumer/citizen involved, other citizens, Center personnel providing services or the community. • Will request the involvement of the Police during a mental health emergency and will offer to assist the Police by remaining in contact with the Police until the emergent situation is resolved. • Will respond to requests to provide emergency mental health evaluations and other assistance when the personnel of those organizations call the Police to offices, schools, or non-mental health organizations. • Will respond to requests from the Police for an emergency evaluation of a detained person when that person's behavior or statements lead Police personnel to believe mental health intervention is needed. • Will work with the Police to provide information on appropriate disposition for persons requiring additional mental health assessments or treatment. • Will gain an understanding of the concerns of involved family members and legal custodians when recommending additional mental health assessment or involuntary treatment. • Will respond to Police's requests to participate in disaster planning and simulated and actual disaster situations. . 1 T 4 Memorandum Of Understanding Page 3 4. Police Activities and Responsibilities • Will deliver petitions for mental health evaluation requested by family/friend concerned about a person's welfare and may continue to be involved in attempts to contact the individual in person so that an assessment may be done; • Will, when requested by an employee or agent of the Center conduct a "welfare check" on a person, known or unknown in the mental health system, when danger to self or others or grave disability is in question. • Will coordinate with Center staff and its own staff a semi-annual training provided by LCMH in the area of intervention techniques with persons experiencing mental illnesses and/or a mental health emergency and additional curricula as agreed upon between the Police and the Center. • Will transport persons placed on CRS 27-10-101 et seq. with an Emergency Mental Illness Report and Application (M-1) completed to an appropriate facility for a mental health evaluation or the Larimer County Detention Center (if charges are pending), a psychiatric inpatient facility or a hospital emergency room (if there are medical ssues). Governmental Immunity. The parties agree and understand that the Town is relying on and does not waive, by an provision of this Agreement, the monetary limitations (presently One Hundred Fifty Thousand and 00/100 Dollars ($150,000) per person and Six Hundred Thousand and 00/100 ($600,000) per occurrence) or any other rights, immunities, and protections provided by the Colorado Governmental Immunity Act, Section 24-10-101, C. R. S as from time to time amended, or otherwise available to the Town or any of its officers, agents, or employees. In consideration of services to be performed by each party to this Agreement, neither party shall seek reimbursement or payments from the other party for the services provided pursuant to this Memorandum of Understanding. . ..
