MEMORANDUM TO: Honorable Mayor Baudek and Board of Trustees FROM: Deputy Chief Filsinger DATE: September 7,2000 SUBJECT: Paraphernalia Ordinance BACKGROUND: The Town ofEstes Park adopted ordinances in 1997 that enabled the Municipal Court to hear a wider range of cases relating to marihuana use, possession and the sale of related paraphernalia. What we did not address at the time was an ordinance that would deal with the simple possession of drug related paraphernalia. The applicable State Statute is as follows: Colorado Revised Statute 18-18-428. Possession of drug paraphernalia - penalty. €0 (1) A person commits possession of drug paraphernalia if he possesses drug paraphernalia and knows or reasonably should know that the drug paraphernalia could be used under circumstances in violation ofthe laws ofthis state. (2Tionwhocommits possession of dmg-paranhgmalia-Gemmits-a-class-2-petty- offense and, upon con~nished by a fine of not more than one hundced,dolmi:§. P Ill * LOPOSAL: Staff asks that this proposed ordinance be considered for adoption thus an owing the Municipal Court to hear and rule on matters of possession of drug paraphernalia. The wording ofthis Ordinance could be derived from the applicable State Statute with the approval of the Town Attorney.
ORDINANCE NO. 11-00 -Ii.&.--- . . AN ORDINANCE AMENDING CHAPTER JNKIPAL CODE OF THE TOWN OF ESTES PARY ELATING TO DRUG PARAPHEF WHEREAS, Colorado law currently prohibits the possession of drug paraphernalia; and WHEREAS, the Board of Trustees of the Town of Estes Park, Colorado has determined that it is in the best interest of the Town to amend Chapter 9.28 of the Municipal Code of the Town of Estes Park, Colorado. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: Section 1. That Chapter 9.28 of the Municipal Code of the Town of Estes Park is amended by adding thereto a new Section 9.28.050 to read as follows: Chapter 9.28.050 Possession of drug paraphernalia A person commits possession of drug paraphernalia if he possesses drug paraphernalia and knows or reasonably should know that the drug paraphernalia could be used under circumstances in violation of the laws of this state. Section 2: This Ordinance shall take effect and be enforced thirty (30) days after its adoption and publication.
