POLICY 1. A police employee is the most conspicuous representative of government and to the majority of the people he is a symbol of stability and authority upon whom they can rely. The conduct of police department employees is closely scrutinized. When their actions are found to be excessive, unwarranted, or unjustified, they may be criticized far more severely than comparable behavior of persons in other professions. Since the conduct of an employee on or off duty may reflect directly upon the Department, employees must at all times conduct themselves in a manner bringing credit to themselves, the Department and the Town. B. AUTHORITY AND PURPOSE 1. The Code of Conduct of the Estes Park Police Department is promulgated by the Chief of Police and takes precedence over other regulatory directives of the Police Department. 2. The Code of Conduct of the Estes Park Police Department is designed to promote efficiency, discipline, and positive community relations by setting forth policies governing the conduct of every employee of the Police Department, both on and off duty. 3. If any section, item, clause, or phrase contained in this Code of Conduct is found to be in conflict with one or more of the provisions of the Town of Estes Park Personnel Polices and Procedures, the Town Personnel Policies and Procedures shall govern. C. SCOPE 1. The provisions of the Code of Conduct, the Town of Estes Park Personnel Policies, and those contained in the Estes Park Police Policies Manual apply to all employees of the Police Department so far as those provisions are applicable to their job descriptions. 1

RESPONSIBILITY IN REPORTING VIOLATIONS 1. It shall be the duty of all employees to take corrective action and/or submit a written report to the Chief of Police whenever they learn of any violation of the Code of Conduct, policy manual, the Town of Estes Park Personnel Policies, the ordinances of the Town of Estes Park, the laws of the State of Colorado, or the laws of the United States by any employee of the Department. 2. Serious violations are those which endanger lives or are a clear violation of policy such as disregard of a direct order, being under the influence of drugs or alcohol on duty, or criminal conduct. Should the violation involve an incident of a serious nature, the supervisor shall relieve the employee from duty and take custody of any credentials and/or weapons issued by the Department. Should the observing supervisor or employee be of lesser rank than the employee, he shall notify a supervisor of an equal rank or superior to that of the employee. The employee will be instructed to report to the office of the Chief of Police at a specified time the following business day. No loss of pay is suffered during this stage. 3. Minor violations are those which do not involve gross misconduct and which will not reflect discredit upon the Department, such as tardiness, dirty uniform, etc., which indicate a need for some form of discipline or training. A history of repetitive violations may escalate the seriousness of the offense. These may be handled by the employee's supervisor. E. UNIFORM, EQUIPMENT & APPEARANCE CODE 1. Societal interest demands highly trained employees who demonstrate disciplined conduct, and strict adherence to regulations. Therefore, employees shall be subject to, and must comply with, the uniform and appearance standards prescribed by the Chief of Police which are as follows: 2

Cleanliness/Neatness Uniforms shall be kept neat, clean, in good repair, and well pressed at all times. Leather and metal equipment will be well polished and in good working order. b. Proper Uniform Normally, employees shall wear the duty uniform on a tour of duty. However, supervisors may prescribe other clothing to be worn as required by the nature of the duty particular employees are assigned or unusual weather conditions. C. Authorized Equipment Employees on duty shall not carry any equipment which does not conform with departmental specifications or meet Department approval. Each employee shall be held responsible for the proper care, maintenance, and service of all Department property assigned to his/her use, and he/she shall promptly report, in writing, to his/her supervisor the loss, damage, or unserviceable condition of such property. d. Authorized Weapon When an employee is on duty, he/she shall wear a departmental authorized weapon, with departmental authorized ammunition. e. Plain Clothes Regulation Employees on duty who are permitted to wear civilian clothing shall wear the attire which conforms to standards normally subscribed to by office personnel in private business firms, unless otherwise directed by the Supervisor. 1.) No employee, when dressed in civilian clothes, shall wear a weapon in such a manner that it will attract attention or be open to the view of the public. f. Hair Regulation Hair must be neat, clean and combed. For male employees, hair shall not be worn longer than the top of the shirt collar at the back of the neck or below the middle of the ear. 3

Afro hairstyles extending not more than two inches from the head are permissible. 2.) Beards and mustaches are acceptable as long as they are kept neat and trimmed. The facial hair shall not be longer than one inch. 3.) Civilian employees are exempt from these regulations; however, no employee shall wear his/her hair in a style that would be repugnant to the general public. g. Suspension Regulations No employee shall wear the uniform, be armed, or carry his badge or identification card while under suspension. Such employee shall immediately surrender his badge and identification card to the supervisor notifying the offender of his suspension. h. Damage to Town Property Improper or negligent handling of or willful damage to Town property is in violation of this code. i. Town Property Town employees who have lost, damaged, or destroyed any equipment issued to them by the Department may be required to make restitution if the loss or damage is the result of negligence on their part. 1.) No employee shall alter, repair, or in any way change, add to, or remove any parts or accessories of any town-owned property without the permission of the Chief of Police. This includes, but is not limited to, buildings, office equipment, machines, clothing, firearms, communications equipment, and motor vehicles. F. RULES OF CONDUCT 1. Obedience to Orders a. Failure or deliberate refusal of any employee to obey a lawful order given by a superior employee shall be considered insubordination. All employees shall perform 4

Employees in uniform are at all times subject to Department policies and must obey the orders of superiors regardless of their duty status. 2. Change of Orders All employees shall obey the orders of a command employee or supervisory employee. When an employee is acting under the orders of one command employee or supervisory employee and is then given a conflicting order by another command employee or supervisory employee, he/she shall immediately report the first order to the second commanding employee or supervisory employee and then abide by the decision of the last commanding employee or supervisory employee. 3. Expenditures No expenditure of money shall be made or liability incurred by an employee in the name of the Town of Estes Park or the Department unless authorized by the Chief of Police. 4. Publicity Employees shall not permit their names or photographs to be used to endorse any product or service without the permission of the Chief of Police. Employees shall not, without permission of the Chief of Police, allow their names or photograph to be used in any commercial testimonial which alludes to their position or employment with the Department. 5. Undercover Investigations Employees shall have prior approval of the Lieutenant, Deputy Chief or Chief before initiating undercover investigations. In cases in which employees are already deployed in an undercover capacity and they begin another assignment unrelated to the existing assignment, they shall notify the Lieutenant, Deputy Chief or Chief as soon as possible. Officers involved in covert or undercover operations are prohibited from engaging in criminal activity unless specifically authorized by the Larimer County District Attorney's Office and with the approval of the Chief of Police. 5

Civil Intervention The Department has jurisdiction in criminal cases only. No mployee shall render aid or assistance in civil cases except to prevent an immediate breach of the peace or to quell a disturbance actually existing. The rule is not intended to prevent employees from informing any citizen as to steps necessary to institute a civil lawsuit. 7. Personal Involvement No employee shall investigate any incident in which he/she is personally involved. Offenses that may be committed against him/her or members of his/her family shall be reported to the law enforcement agency having responsibility for the investigation of such offenses. 8. Polygraph/Stress Tests Upon order of the Chief of Police, employees shall submit to polygraph examinations and/or stress evaluation analysis when the examinations are specifically directed and narrowly related to a particular investigation being conducted by the Department. 9. Evidentiary/Identification Procedures Upon order of the Chief of Police, employees shall submit to any medical, ballistics, chemical, and/or other test, photographs, or lineups. All procedures carried out under this subsection shall be specifically directed and narrowly related to particular internal investigations being conducted by the Department. 10. Overall Responsibility The administrative delegation of the enforcement of certain laws and ordinances to particular units of the Department does not relieve employees or other units from the responsibility of taking prompt, effective police action within the scope of those laws and ordinances when the occasion so requires. 11. Neglect of Duty Neglect of duty on the part of any employee is cause for corrective and/or disciplinary action. The employee will be punished according to the degree of severity of the violation, the results brought about by the dereliction, and the effect it has upon the discipline, good order, and best interest of the 6

Violations of the following subsections constitute neglect of duty: a. Failure to Supervise Failure of a supervisor to take immediate and appropriate action when a violation of the rules and regulations comes to his attention, or when a supervisor him or herself violates departmental rules or policy thereby setting a negative example for subordinates. b. Disregard of Departmental Rules Failure to observe and adhere to the policies of the Department. C. Property Procedure Failure to deliver, to the proper custodian, any property found by, confiscated by, or relinquished to employees of this Department without undue delay and, in any event, before their tour of duty is ended. Failure to place evidence in its officially designated place for preservation and storage without undue delay and, in any event, before the tour of duty is ended. d. Responsibility to Identify Self Failure to identify yourself by name, officer number and Department, to any person upon request. e. Drug Use Being under the influence of drugs or being a user of drugs when such drugs are not prescribed by a physician or dentist, or taking drugs in a manner not prescribed by a physician or dentist. f. Drivers License Failure to maintain a valid Colorado Drivers License. g. Alertness on Duty . Failing to remain alert, observant, and occupied with police business during the tour of duty. 7

Outside Employment Employees are prohibited from following any other vocation which might conflict or interfere with their responsibility to the Department. Employees must receive permission from the Chief of Police to engage in off-duty employment or operating a business. Employees are prohibited from holding a deputation or commission from any other law enforcement agency without the expressed permission from the Chief of Police. i. A.W.O.L. No employee shall be absent without leave. (Absent without leave shall mean either failure to report for duty at the time and place of duty or the leaving of a place of duty or assignment without proper authorization). j. Tardiness/Attention to Orders Unless otherwise directed, employees shall report at the time and place specified in proper uniform and equipment. They shall give careful attention to orders and instructions. k. Illness It shall be the responsibility of employees who, because of illness, cannot report for duty to notify the on-duty or on- call supervisor at least 2 hours prior to the beginning of the assigned shift. If a supervisor cannot be reached, the senior officer on duty is to be notified. It is the responsibility of the officer to make direct contact with the supervisor/senior officer. 1. Telephone Employees shall have a telephone installed in their place of residence within 30 days of appointment, unless specifically exempted by the Chief of Police. m. Address Employees shall report any change in address or telephone number within twenty four hours of such change to the Chief's secretary and to their immediate supervisor. 8

Residency 1.) All non-supervisory sworn and civilian personnel shall reside in a place which allows them, on notification, to arrive at the police department within one hour of such notification under normal weather and traffic conditions. 2.) All supervisory personnel, the Police Investigator and the Community Resource Officer shall reside in a place which allows them, on notification, to arrive at the police department within one-half hour of such notification under normal weather and traffic conditions. o. Confidentiality of Employee Data The home address and telephone number of employees of the Department shall not be given out to the public without prior approval of the employee. P. Intoxicants The use or display of alcoholic beverages by a Town employee while on duty is prohibited. Employees shall not consume intoxicants while off duty, or on-call, to the extent that evidence of such consumption is apparent when reporting for regular duty or to the extent that their job performance is impaired. q. Response Employees shall respond without delay to all calls for police assistance from citizens or other employees of the Department. Emergency calls take precedence. However, all calls shall be answered as soon as possible consistent with normal safety precautions and traffic laws. Except under the most extraordinary circumstances or when otherwise directed by competent authority, no employee shall fail to answer any call for service directed to him. r. Responsibility on Duty Within the Town of Estes Park, on-duty employees shall at all times take appropriate action to: 9

Protect life and property 2.) Preserve the peace 3.) Prevent crime 4.) Detect and arrest violators of the law 5.) Enforce all Federal, State, and local laws and ordinances within departmental jurisdiction. S. On-Scene Command Responsibility The ranking on-duty supervisor at the scene of any police incident shall be responsible for the proper handling of that incident. In the absence of a supervisor, the senior employee present shall be responsible for the proper handling of the incident. 12. Conduct Unbecoming an Employee a. Employees shall not engage in any conduct which constitutes Conduct Unbecoming. Conduct Unbecoming shall include that which brings the Department into disrepute or reflects discredit upon the employee as an employee of the Department or that which impairs the operation or efficiency of the Department or employee, such as: 1.) Personal Conduct Engaging in any personal conduct or act which if brought to the attention of the public, could result in justified unfavorable criticism of that employee or the Department. 2.) Work Actions Participating in a strike or work stoppage or slowdown. It is the policy of the Department to seek the removal from office of any employee or civilian employee who plans or engages in such strike, work stoppage, or slow-down. 3.) Courtesy to Citizens and Fellow Employees Failing to be courteous and civil at all times in their relationships with one another. When on duty in the presence of the public, employees should be referred to by rank. 10

Criticism of Department or Town Administrator Publicly criticizing or ridiculing the Department, its policies, supervisors, the Town Administrator, Board members, Mayor, members of appointed commissions or other employees by talking, writing, or expressing in a manner which tends to impair the operation of the Department or the Town by interfering with the ability of supervisors to maintain discipline, or by a reckless disregard for the truth. 5.) Provocation Ridiculing, mocking, deriding, taunting, or belittling any person. The employee will not willfully embarrass, humiliate, shame any person, or do anything that might incite any person to violence. 6.) Conduct Conducting himself/herself in the offices, buildings, and vehicles of the Department in a manner which would discredit the police service. Engaging in "horseplay" or the playing of pranks while on duty. 7.) Gambling Engaging in any form of gambling or card playing in the police facility, including, but not limited to, briefing rooms, locker rooms, and lounge. 8.) Profanity Using loud, indecent, profane or harsh language in the presence of the public. 9.) Bribes/Gratuities Soliciting or accepting any bribe, gift, gratuity, loan, fee, or favor where there is any relationship between the solicitation and their Department membership except as provided by law and approved by the Chief of Police. 10.) Transfer of Valuables Buying from, or selling anything, to any complainant, suspect, witness, defendant, prisoner, or other person involved in any case which has come to their attention through their employment with the Department; nor can they act as an intermediary in the payment of a reward for the return of stolen 11

This does not prohibit employees from dealing with legitimate places of business. 11.) Respect to Nation Failing to render a military salute to the United States Flag and National Anthem at appropriate times. Employees in civilian dress shall render proper civilian honors to the United States flag and National Anthem at appropriate times. 12.) Using Authority for Gain Employees shall not use their official position, official identification cards or badges: a.) For personal or financial gain; b.) For obtaining privileges not otherwise available to them except in the performance of duty; C.) For avoiding consequences of illegal acts. 13.) Identification Card Security Lending to another person their identification cards or badges or permitting them to be photographed or reproduced without the approval of the Chief of Police is prohibited. 14.) Sobriety No employee, while in uniform, shall be under the influence of, or use, intoxicants. 15.) Possession of Alcohol/Drugs Employees shall not keep any intoxicating liquor or drugs on departmental premises, except for the following purposes: a.) Liquor brought on to departmental premises in the furtherance of a police task shall be properly identified and stored according to policy. b.) Prescription medications issued to the employee for legitimate use which shall not interfere with job performance. 12

Use of Gum & Tobacco No employee shall smoke or chew tobacco or gum while making personal contacts with citizens in the performance of his duties. The use of tobacco in any form is prohibited: a.) in the Municipal Building. b.) in any Town vehicle. C.) in contact with any citizen while on duty or in uniform. 17.) Warrantless Search/Arrest No employee shall arrest any person or search any premises or person without a warrant for arrest, or a search warrant except when such arrest or search is authorized without a warrant under the laws of the State of Colorado, the U.S., or the ordinances of the Town of Estes Park, or by consent. 18.) Group Affiliation No employee shall become a member of any organization, association, movement or group which advocates or approves the commission of acts of force of violence to deny others their rights under the Constitution of the United States, or which seeks to alter the form of the government of the United States by unconstitutional means. 19.) Protests/Demonstrations No employee shall participate in any type of disruptive protest or demonstration, nor shall any employee act as a spokesman, representative, or agent for any group engaged in or planning to engage in any type of disruptive protest or demonstration. 20.) Self Control No employee shall display unnecessary violence or disrespect towards any person. 13

Cowardice No employee shall display cowardice or failure to perform police duties. 22.) Court Appearance Employees must be present and available to testify in any court, or before any grand jury, when officially notified to appear. In criminal cases outside Larimer County and in all civil cases, employees shall respond to a legal subpoena only. a.) Employees who, for a valid reason, are unable to answer an official summons must be excused by the court or grand jury prior to the time they are scheduled to appear. The reason for the excused absence shall be reported to the employee's supervisor. In case the supervisor is not available, employees shall report their reason for being absent to the Chief of Police. b.) Any employee who is subpoenaed or volunteers to testify for the defense in any criminal or civil case or hearing or against the Town or Department in any hearing or trial shall notify his/her supervisor upon receipt of the subpoena or of his/her intention to testify prior to his/her appearance as a witness. Any witness fee resulting shall be turned over to the town of Estes Park. 23.) Interference with Legal Procedure Employees shall not engage in any of the following conduct: a.) Interfering with the service of a lawful process. b.) Interfering with the attendance or testimony of witnesses through coercion, bribery, or other means. C.) Attempting to have any notice to appear or traffic citation reduced, voided, or stricken from the calendar without approval of the Chief of Police. d.) Discussing a dismissal, reduction in charges, or other disposition of a pending criminal case 14

This would not apply to an employee in the capacity of court liaison. e.) Taking any other action which interferes with the efficiency or integrity of the administration of criminal justice. f.) Having knowledge of such interference on the part of a fellow employee and failing to inform a supervisor in writing. 24.) Recommending Services Employees shall not suggest, recommend, advise, or otherwise counsel the retention of any attorney or bail bond broker to any person coming to their attention as a result of police business. This does not apply when a relative or personal acquaintance of the employee seeks such service. 25.) Prisoner Treatment All employees shall protect the rights of any person held in custody. 26.) False Arrest/Malicious Prosecution No employee shall falsely arrest, imprison, or direct any malicious prosecution against any person. 27.) Necessary Force Employees shall use only that amount of force that is reasonable and necessary in effecting an arrest. 28.) Responsibility for Property Under Employees Control Any employee who has lost, damaged, or destroyed any property or equipment belonging to a person in custody or which has come into possession of said employee by reason of his office may be required to make restitution if the loss or damage is the result of improper handling on the part of the employee. 29.) False Reports/Testimony No employee shall knowingly falsify any report, document, or record or cause to be entered any inaccurate, false, or improper information on records, documents, or reports of the Department or of any court; or alter any record, document, or report except by a supplemental record, document or report. Deception Employees are expected to be credible. No employee shall knowingly make a false statement or give false answers to any supervisor of the Town. 31.) Confidentiality No employee shall give any lawyer, bondsman, or the agency of either, or any other person unauthorized information regarding prisoners in confinement, property in custody, records of the Department or other confidential information. 13. Probationary Status a. The employment of employees of the Police Department holding the position of probationary police employee may be terminated without cause. They are cautioned to maintain the standards of employee performance, and to observe the Code of Conduct, the Town of Estes Park, and the laws of the State of Colorado and the United States. b. After completion of probation, the employee will be accorded due process, to include a predisciplinary hearing, in matters affecting compensation benefits, status, or tenure. c. No employee shall procure appointment in the Department by means of willful misrepresentation or omission of any fact concerning his personal history, qualifications for employment, or physical condition. Such misrepresentation, when discovered, will result in immediate termination of employment. 14. Responsibility of Knowledge a. Employees are required to establish and maintain a working knowledge of this Code of Conduct, & policy procedure manual, and all laws and ordinances in force in the town of Estes Park, and written rules and policies of the Department and each division thereof. In the event of improper action or breach of discipline, it will be presumed that the employee was familiar with the law, rule, or policy in question. 16
