MEMORANDUM TO: Honorable Mayor Dekker and Board of Trustees FROM: Deputy Chief Filsinger DATE: May 3, 1999 SUBJECT: PURCHASE OF MINOLTA CS PRO 2080 BACKGROUND: Current Canon Copier - The Estes Park Police Department is in need of a consistently reliable copy machine. The Canon 3050 we presently have needs to be replaced. For the year 1998, we had 12 service calls, averaging one call per month. The response time for 3-4 of those calls was not within a 24-hour timeframe. On some of the calls a part had to be ordered for the machine, therefore, the copier was still out of order for 2-3 days longer. The blue color toner has not been used for at least three years. The staple option is very unreliable and is no longer used. When we make a large number of copies using the duplex option, the machine overheats, jams and has to cool down before continuing operation. Canon Demo - When we requested a Demo because we were going to purchase a new machine, at first, Canon had nothing available, and then they delivered a model we did not request. While the technician was putting the Canon together, the sorter bin was broken and we were told a new one would be brought up within 1-2 days. We had the demo for one week and had one service call. The sorter bin never was replaced. The cost of the Canon Copier with necessary options is $7,365. The annual maintenance contract is a cost of $1,050 per year. Minolta Demo - The Minolta CS PRO 2080 - During the week that we had this model as a demo, it worked consistently and efficiently. The sorter, duplex and staple options worked continuously. We have spoken to other depaitments within the Town of Estes Park, which have Minoltas; Administration, Finance and Community Development. All these departments highly recommend this machine and the service response. The Town's Administration Department purchased a Minolta late in 1997 and has had only two service calls with response occurring within 24 hours. The technician for Minolta also stops in on a regular basis without being called. While we had the Minolta 2080 as a demo, we did a project that consisted of copying a 280-page notebook three times, using the duplex option. During the project, it did not jam or overheat and the copies looked like originals. BUDGET/COST: The total cost for the purchase ofthe Minolta CS PRO 2080 is $7,393, which includes: 28 copies per minute (2) 505 Sheet Drawers (1) Dual Feed Paper Cabinet Automatic Duplex Document Feeder 10 Bin Stapling Sorter Duplex Unit Dual Paper Feed Free Delivery and Installation There is $7,000 allotted in the budget for the purchase of a copy machine. Also, the present Canon copier can be sold for $750, which would cover the amount of $393 over the budget. Note: The Estes Park Police Department makes approximately 60,000 copies per year. In addition, the service contract would be $1,040/year for 60,000 copies. The maintenance cost is under a separate account in the budget. RECOMMENDATION: Staff recommends the purchase ofthe Minolta CS PRO 2080 at the cost of $7,393. WITNESSETH: WHEREAS. the parties to this Memorandum of Understanding are entities charged in part with the duty to provide fire protection and other emergency services within their respecnve remtories; and WHEREAS, it is to the mutual advantage and benefit of the paItieS that the parties should voluntarily aid and assist each other iII the event of a fire or other emergency that endangers hfe orpropeny: and WHEREAS, fire or relared eme / arise in one or the other of the terniories of rhe parties resulting in greater dernal manpower, equipment and exper[ise of an mdividual party can handle, or incid, intensity may occur rhat cannot be handled solely by rhe resources of the party in, , £y the emergency occurs. THEREFORE. IT IS AGREED THAT: ~-~~ 1. Requested Response. Each of the parties agrees to respond to requests for assistance within the boundaries of the other party upon the request of the requesting fire chief or his designee at any and all times, provided that it shall be enlireIy within the discretion of the fire chief or his designee of the responding pany as to what personnel and equipment shall answer such call and whether or not, in any event, such call may be answered consistently with the safety and protecIion of the cirizens, personnel and properry of the responding party. 2. Request for Aid. Any request for aid under this Memorandum of Understanding shall mclude a statement of the amount and type of equipment and personnel requested from the responding party, and shall specify the location to which the equipment and personnel are to be dispatched. However, the amount and type of equipment and number of personnel actually to be furnished by the responding party shall be determined ar the sole discretion of the responding party. 3. Command. The officer in charge of the responding party shall report to the requesting party' s officer in charge at the location to which the equipment is dispatched and shall be under the direcrion and control of the requesting party's officer in charge. In the event that the responding party is the first party on the scene, then the officer in charge of the responding party will be in command until an officer in charge of the reques{ing party in whose jurisdiction the incident has occurred has arrived on the scene. The equipment and personnel that are provided by the responding party shall be under the immediate command and control of the responding party's officer in charge. The responding party shall be permined to withdraw irs personnel and/or equipment from Ihe scene of any incident in rhe requesting parry's jurisdicrion when: A. The personnel and/or equipment are released by the requesong parry's officer in charge; B. The conditions at the incident create a risk of injury or death ro the responding parry's personnel. Or C. The needs of the responding party, as determined by the responding party in its sole discretion, require the return of its personnel and/or equipment to irs rerntory. 5. Compensation. Neirher party to this Memorandum of Understanding shall be required to pay any compensation zo the other par[y for any services rendered hereunder. 6, Effect of Memorandum of U nding. This Memorandum of Understanding is nor inrended tO, nor should it be construed~*Iffect or extend the legal responsibillties of any of the parties hereto; create or modify any pr,~sting legal obhgation, if any: or create for or extend any of the legal rights to any person. 1~[emorandum of Understanding shall nor be construed as or deemed ro be a Memorandum 2~Indersranding for the benefir of any third party or parties, and no third party or parties shall have a righT of acrion hereunder for any cause whatsoever. Any services performed or expenditures made in connecnon with furnishing mutual aid under this Memorandum of Understanding by either of the parties hereto shall be deemed conclusively to be for the direct protection and benefit of the inhabitants and property of such party. 7. Governmemal Immunity. Nothing in this Memorandum of Understanding shall be deemed a waiver of the defenses and limitations of The Colorado Governmenral Immunizy Act, Section 24-10-101, C.R.S., er seq., nor deemed to confer any beneths ro any person not a party to this Memorandum of Understanding. 8. Benefits. if any firefighIer or other personnel of the responding pam' is injured, disabled or dies as a reSult of performing services within Ihe boundaries of the requesting party, said individual shall remain covered by, and eligible for, Ihe workers compensation and firefighters pension benefrs which said individual would orherwise be entitled if the injury, disabiliIy or death had occurred within the Ierrirory of Ille responding party. 9. Term. This Memorandum of Understanding shall be effective as of the date and year first above written and shall continue in effect indefinitely. Entire Agreement. This Memorandum of Understanding represents the entire agreement of the parties and any amendment to this Memorandum of Understanding shall be inwrinng and executed by all parties hereto. LETTER OF COMMENDATION Officer James Kenney Estes Park Police Department Estes Park, CO 80517 Dear Officer Kenney, Sergeant Wes Kufeld submitted the attached letter describing actions taken by yourself in response to a suicide BOLO as received from Greeley Police Department on April 25, 1999. The Sergeant reports that upon receipt of the computer relayed information, you took the initiative to search hotel/motel parking lots in an effort to locate the described vehicle. You did locate the vehicle just 49 minutes later and continued your investigation to the point of locating the room in which the person was staying. Upon receiving no response at the door, you made entry and found the despondent person was unconscious as a result of attempting suicide through the ingestion of prescription drugs. According to the attending Physician at the Emergency Room, the subject would have been deceased in very short order had you not intervened. On behalf of the Estes Park Police Depanment I commend you for your prompt and thorough attention to this case. We are very proud of your performance and handling of this situation. You can take a great deal of personal pride in this case, with the knowledge that your actions resulted in saving the life of another human being. Congratulations and keep up the great work! While on patrol, you located the bolo vehicle at 0233 hours, parked in the Holiday Inn parking lot. You contacted a Holiday Inn Manager at the front desk and obtained the room number (#329) where the female was staying with out alarming the employees. Due to the urgency of the situation and with the help from hotel employees, you were able to gain entry into the room where the door was found to be locked, bolted and chained, subsequently finding the despondent female lying on the bed unconscious. The female had attempted suicide by drinking % of a bottle of Sutter Home wine and taking a considerable amount of anti- depressant prescription narcotics. Ambulance personnel who were on stand-by at the scene, attended to the female and transported her to the Hospital. Once at the Medical Center, Doctor Daley of the Emergency Room Staff advised us that the female would have been dead in a short amount of time had you not found her in the hotel room and taken action. I would like to take this opportunity and commend you for your actions taken in this situation. Because you were able to locate the victim's vehicle in the parking lot and gain entry into her hotel room, you saved her life, and she is now able to receive the counseling and medical attention she needs. You subsequently discovered that there was an active arrest warrant for the person you were in contact with. Your questioning ofthis person led to your discovery of a clandestine methamphetamine lab which was actively engaged in the making of methamphetamine. This illegal laboratory was discovered to be the largest clandestine methamphetamine laboratory in the 7 year history of the Larimer County Drug Task Force. It is reported that this lab had the necessary precursors of producing pounds of methamphetamine with a street value of approximately $32,000.00. More importantly, your efforts helped to remove a highly addictive illegal substance from our community, and safeguarded commercial rental properties from the high probability of explosive damage. The victim had been sleeping when 3 unknown masked suspects broke into his home. He was held down and received numerous blows to the face and body. Eventually his attackers did break a leg in two places with a metal bar. The victim required extensive medical attention and hospitalization. Your investigation of this case led you to a suspect who did confess to the crimes stated above and eventually led to the arrest ofthe 3 assailants. Two ofthe suspects are juveniles and due to the seriousness ofthe crimes committed, they are being tried as adults in the Larimer County District Courts. You did discover evidence in that vehicle of a possible drug transaction in progress. Due to your attention to detail, you were able to discover where the other suspects were located. This information led to the discovery of a clandestine methamphetamine drug lab which had produced approximately 70 grams of methamphetamine. This methamphetamine has an estimated street value of $100.00 per gram with a total street value of $7,000.00.
