BOND PARK CAMPFIRE REQUEST The Chamber Resort Association, Business Advocates and Special Events Department ask permission to use the fire pit in Bond Park for the following this Summer: Sing-A-Long Campfire to be held Thursday thru Sunday of each week from June 11 thru August 15. Approximate time 7:30 pm to 8:30 pm. Scottish Festival Torch Parade 9:00 pm on September 11. It is my understanding the Ben Goff will be the fire attendant. Mr. Goff was the attendant last Summer. Box 1200 Estes Park, CO 80517 Dear Chie f Dorman: You requested that I review the situation concerning claims for reimbursements for emergency response authorities concerning Hazmat response. In checking with Vickie, the matter was taken to Committee in 1994 but no resolution was ever adopted by the Town. Accompanying this letter is a resolution for that purpose. You can make the determination whether or not you feel this needs to go back through Committee or be placed on the Town Board agenda. I am sending the original of the Resolution to Vickie. In the event the Fire Department responds to a hazardous substance incident within the Town, the Town of Estes Park has a right to claim reimbursement from the parties responsible for the incident for the "reasonable and documented costs resulting from action taken, removed, contained or otherwise mitigates the effects of such incident." However, please note that you may not claim reimbursement for any charges involving extinguishing a fire. In reviewing the Statute, I do not believe it's necessary to adopt any fee schedule at this time. If an incident does occur in which the Town needs to seek reimbursement, I'm surewe can determine reasonable and documented costs. Also, if you respond to a hazardous substance incident in the County, the County is the proper authority to collect all costs incurred. The County is to collect the money and reimburse the Town for its expenses. Be sure to submit a bill to the County for any Hazmat response. This can be accomplished in three steps with which we need your assistance and cooperation. The first step is for you to fill out the enclosed information sheet about your business and location and mail it back to us in the self addressed stamped envelope. The second step would be for us to do an on site inspection of your business. This inspection would consist of looking for potential fire hazards, location and access to utility disconnects, special construction hazards, type of contents, fire load, life hazards and water supply. We estimate this inspection to take approximately two hours and it will provide us with information so that we can better prepare for an emergency at your place of business. The third step will consist of a written report from us as to any hazards that we find and will include fire prevention suggestions to make your business a safer place in which to operate. Upon receipt of your information sheet you will be contacted in order to set up a convenient time for the inspection. Although it means more paperwork for us, I see the value in your incident reports as well. We will be using these reports on our Wildland incidents starting immediately. I unde,stand that you have a Wildland fire truck leasing program. As you know we ale a ·volunteer fire department with limited funds. We are also in great need of a MAIC:bnd fire truck. Also after reviewing the Wildfire Hazard Mitigation and Response P/an, I feel the addition of this type of vehicle would greatly benefit our Department and the Colorado State Forest Service in the performance of our duties. Our mission is to foster life-enhancing mentor relationships between referred youth and adult volunteers. Since the opening of a local office two years ago, we have worked with 35 youth in Estes Park and surrounding communities. Partners is a valuable part of the continued efforts of schools, law enforcement and other concerned entities, to promote youth development and prevent juvenile delinquency. Stuart A. VanMeveren, District Attorney for the Eighth Judicial District, has stated that 'Partners has done more to help our troubled youth than any other program". We are proud of our ability to provide at risk youth with stable, positive adult role models. Partners is funded primarily by contributions made by private sources (78%) the rest of our budget comes from state contracts. The major vehicle for raising funds for the Estes Park office has been our Grand Prix style go-kan race, hosted by Fun Trax. We have raised over 16,000 dollars in the Estes Community through this event and received a tremendous amount of good will and exposure for the program. This year we would like to try a new concept that we feel is more sustainable over time. We are proposing to host . a street race in conjunction with Chuck Couter and The Karting Community in Colorado. This race, which would attract amateur Karters from all over the county, is an exciting new event for Partners and Estes Park. The race will involve two days of street races with multiple class involving people ages' 8-80. We will also provide opportunities for local organizations to buy a team and participate in a special celebrity race. We began working with Linda Hinzie in the fall of last year to determine feasibility, track location and a date for this event. Since that time we have received a tremendous amount of support and encouragement for the concept. We sought and obtained permission from the Park R-3 School District to use the high school parking lot for the majority of the track and pit area. Now we are seeking permission from the town for the attached street closure. The event will be insured by Janowski Insurance in conjunction with the National Karting Alliance specifications and we will name all involved entities as an additionally insured. Our vision for this event is to first and foremost to continue to fund the Partners of Estes Park program. In the future, we hope to seek major sponsors and develop a quality special event for the town. Karting is a fun, safe, family sport in which spectator and driver alike can enjoy. We look forward to the opportunity to host such a unique event in our community. AN ORDINANCE AMENDING THE MUNICIPAL CODE BY THE ADDITION OF THE FOLLOWING TWO SECTIONS TO TITLE 9 THE SAME RELATING TO PUBLIC HEALTH, SAFETY AND WELFARE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO. Section 1: The Municipal Code of the Town of Estes Park, Colorado is hereby amended by the addition of the following two Sections. Section 9.08.080: Third Degree Assault. A person commits the crime of assault in the third degree if he knowingly or recklessly causes bodily injury to another person or with criminal negligence he causes bodily injury to another person by means of a deadly weapon. Section 9.08.090: Harassment. (1) A person commits harassment if, with intent to harass, annoy, or alarm another person, he or she: (a) Strikes, shoves, kicks, or otherwise touches a person or subjects him to physical contact; or (b) In a public place directs obscene language or makes an obscene gesture to or at another person; or (c) Follows a person in or about a public place; or (d) Initiates communication with a person, anonymously or otherwise by telephone, in a manner intended to harass or thfeaten bodily injury or property damage, or makes any comment, request, suggestion, or proposal by telephone which is obscene; or (e) Makes a telephone call or causes a telephone to ring repeatedly, whether or not a. conversation ensues, with no purpose of legitimate conversation; or (f) Makes repeated communications at inconvenient hours that invade the privacy of another and interfere in the use and enjoyment of another's home or private residence or other private property; or ® Repeatedly insults, taunts, challenges, or makes communications in offensively coarse language to, another in a manner likely to provoke a violent or disorderly response. Section 2: This Ordinance shall take effect and be enforced thirty (30) days after its adoption and publication. Offficer Brand coordinated the situation for them by calling Triple A and directing traffic. Received a recommendation from Captain Filsinger to recognize Telecommunicator Donna Hubach for her " initiative and investigative instinct" in assisting with a suicide incident that occurred in February.
