'v ~ b' 61 a MEMO OF UNDERSTANDING In recognition of mutual benefits shared between the Estes Park Police Department (EPPD) and the Estes Park Medical Center (EPMC), the following agreement shall be in effect until changed as herein provided. The Estes Park Police Department shall provide: 1. 24-hour dispatch service (to include the reception of calls for service via regular telephone lines, 9-1-1 and E-9-1-1 when available) and proper dispatch of and monitoring during these calls. a) All dispatch service communications shall be recorded. Upon request, copies of any tape recording pertaining to Emergency Services shall be provided so long as the request is made within thirty days of the date of recording. b) Maintaining and providing written records Of all dispatch services to include date, time, brief description, nature of the call, and location. C) Standards of services and quality assurance shall be set forth as agreed upon through written agreement by Estes Park Medical Center Ambulance Manager and Estes Park Police Department Dispatch Supervisor. 2. Current Emergency Medical Dispatch trained personnel to provide dispatch service. 3. Physical aid in working traffic, moving victims, etc., provided by Estes Park Police Officers. In the case of moving victims of accidents, all such movement under non- emergent conditions shall be done at the direction Of ambulance personnel. 4. Response to calls from hospital personnel for aid regarding violent persons, etc. In return for past and future services, the Estes Park Medical Center agrees that: 1. The past accumulation of billings to the Estes Park Police Department shall be forgiven. 2. The uncollectible fees for medical services provided to persons under police custody shall be absorbed by the Estes Park Medical Center in an amount not to exceed $4,000.00 per year. Uncollectible fees exceeding $4,000.00 in any calendar year shall be the responsibility of the EPPD. (Blood alcohol screens shall be a separate billable expense.) .t I I 3. The Estes Park Medical Center agrees to assist in coordinating future Emergency Medical Dispatch training in the Estes Park area. The Police Department shall bear the costs of training, wages and benefits for the duration of that training. 4. The Estes Park Police Department and Estes Park Medical Center shall be solely responsible for the actions or omissions of their respective officers, agents and employees and shall not be responsible or legally liable for the negligent acts of the other party. Accordingly, to the extent authorized by law, each party hereby indemnifies and holds harmless the other party from any damages, losses, expenses, causes of action or other liability whatsoever arising from or in any way relating to any personal injury or damages to person or property caused by the negligent acts or omissions of its own officers, agents or employees.
