ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 10.16 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO, THE SAME PERTAINING TO RECREATIONAL VEHICLES BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: SECTION 1. That Chapter 10.16 of the Municipal Code of the Town of Estes Park, Colorado, shall be amended as follows: 10.16.010 Regulations. A. No recreational vehicle nor travel trailer, as the same are defined in Section 17.08.030, shall be parked on any of the streets, alleys, highways, parking lots, or other public ways of the Town in violation of any parking regulation of the Town. In no event shall any recreational vehicle nor travel trailer be parked on any of the streets, alleys, highways, parking lots or other public place of the Town for a period greater than eighteen consecutive hours. B. No recreational vehicle nor travel trailer, as the same are defined in Section 17.08.030, shall be used for living or sleeping purposes or as a store, office, or place for the carrying on of a business, trade or profession within the Town. C. Any recreational vehicle or travel trailer, as the same are defined in Section 17.08.030, may be parked 7LLD__~~~~...Zb. for a period of greater than eighteen consecutive hours ,1- and used for living or sleeping purposes in any recreational vehicle park approved pursuant to the provisions of Chapter 17.32 of the Municipal Code. SECTION 2. The Board of Trustees of the Town of Estes Park, Colorado, herewith finds, determines and designates that this Ordinance is necessary in order to immediately prevent the use of recreational vehicles for living purposes upon the streets of Estes Park; and whereas, in the opinion of the Board of Trustees, an emergency exists, this Ordinance shall take effect and be in force immediately after its passage, adoption and signature of the Mayor. AN ORDINANCE AMENDING CHAPTER 8.04 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO, THE SAME PERTAINING TO OPEN BURNING AND BURNING OF GARBAGE, WASTE AND TRASH. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: SECTION 1. That Chapter 8.04 of the Municipal Code of the Town of Estes Park, Colorado, shall be amended by the addition of the following Section. 8.040.075 Open Burning Prohibited. Except as provided in this Section, it shall be unlawful for any person to burn or allow the burning of any garbage, trash, wastepaper, wood, leaves, waste or any other flammable material on any open premises within the Town of Estes Park unless an open burning permit is first obtained from the Air Quality Control Division of the Colorado Department of Health, or any agency authorized by said Department to grant open burning permits. The owner or operator of any diesel-powered locomotive that has been cited for violation of Section II.B.1. of this regulation, but which is not available for a compliance inspection shall submit to the Division an affidavit attesting to those abatement measures which have been completed and shall state in that affidavit that the vehicles cited have achieved compliance with this regulation, as determined in accordance with EPA Method 9 (40 CFR, Part 60, Appendix A (1977)). C. Open Burni ng 1. Except as provided in paragraph 2 below, no person shall burn or allow the burning of rubbish, wastepaper, wood, or other flammable material on any open premises, or on any public street, alley, or other land adjacent to such premises, unless an open burning permit is first obtained O.3. L from the Division. In granting or denying such permits the Division shall base its decision on the location and proximity of such burning to any building or other structure, the potential contribution of such burning to tvo, air pollution in the area, climatic conditions on the day or days of such burning, and compliance by the applicant for the permit with applicable fire protection and safety £ #U requirements of the local authority. The Division may consider: (a) whether there is any practical alternative method for the disposal of the material to be burned and (b) whether burning will be conducted so as to minimize . emissions. Methods for minimizing emissions may include, but are not necessarily limited to, the use of permitted i ncinerators or air curtain destructors, the use of clean auxilliary fuel, drying the material prior to ignition and separating out for alternative disposal: rubber, tires, i plastic, insulated wire, insulation, and other material s which produce more smoke than clean combustible materials. .le 2. Noncommercial burning of trash in the unincorporated . . areas of counties of less than 25,000 population . according to the latest federal census provided such open burning is subject to regulations of the Board of County Commissioners for such county adopted by resolution and such regulations include, among other things, permit provisions and prohibit any such burning that would result in the exceedence of any NAAQS. 3. Nothing herein shall be construed as relieving any person conducting open burning from meeting the requirements of any applicable federal, state or local requirements concerning di sposal of waste material s. III. PARTICULATES A. Fuel Burning Equipment 1. No owner or operator shall cause or permit to be emitted into the atmosphere from any fuel-burning equipment, particulate matter in the flue gases which exceeds the following: a. 0.5 lbs. per 106 BTU heat input for fuel burning equipment of less than or equal to lx106 BTU/hr. total heat input design capacity; For fuel burning equipment with designed heat inputs b. greater than lx106 BTU per hour, but less than or equal to 500x106 BTU per hour, the following equation will be used to determine the allowable particulate emission limitation. PE=0.5(FI)-0·26 Where: PE = Particulate Emission in Pounds per million BTU heat input. FI = Fuel Input in Million BTU per hour. C. 0.1 lbs. per 106 BTU heat input for fuel burning equipment of greater than 500x106 BTU per hour or more. d. If two or more fuel burning units connect to any opening, the maximum allowable emission rate shall be calculated by summing the allowable emissions from the units being operated. 2.
