Box 702 Loveland, Colorado 80539 Dear Greg: I represent the developer of Baldpate Estates which lies south of Estes Park on Colorado Highway 7 in the vacinity of Lily Lake. A portion of the Baldpate development lies within the Allenspark Fire Protection District whereas the northern portion of the development does not and has been served by the Estes Park Fire Department. In practicality, Estes Park has been responding to fires within the Allenspark Fire Protection District and it is my understanding Allenspark has, at times, assisted Estes Park for fires within its coverage. The Baldpate development has excellent fire protection faci- lities in the form of a frost-free water tap, from which tankers can be filled, located on the development property. A large storage facility has been constructed at the highest elevation on the development providing more than adequate gravity flow water to this tap. The entire fire protection set-up has been approved by the County Commissioners. Difficulty has arisen between my client and the Allenspark Fire Protection District. Two of the members of the District Board reside in Tahosa Valley and the Homeowners' Association of Tahosa Valley has, from the start, appeared in opposition to any approval of the Baldpate development, This conflict culminated last summer in a letter written by one of the board members,.pur- portedly on behalf of the board, which was published in the Estes Park paper stating that the Baldpate development was substandard in its fire protection set-up. Not only was this letter fac- tually incorrect, but the purpose of the letter was not to point out descrepancies but rather to create a negative attitude in the public toward Baldpate. Prior to final plat approval, the Allenspark Fire Protection District shall approve the fire protection plan and final plat configuration. Urban level fire protection shall be provided prior to the issuance of building permits for multi-dwelling units. A fire protection consultant shall be contracted by the developer with the approval of the District for the purpose of reviewing the development plans and site conditions. The Larimer County Board of Commissioners reserves the right to review and approve or disapprove the plan at the final plat stage. 18. No building permits shall be issued for any multi-use lot until an overall site plan for ultimate development of the lot has been reviewed and approved by the Colorado State Forest Service, the Allenspark Fire Protection District, and the Larimer County Drainage Administrator.
