Estes Park, Colorado 80517 - -J \ C MEMORANDUM TO: David Racine FROM: Gary Shanafelt DATE: July 21, 1987 SUBJECT: Sirens and Control Centers I would like to recommend that we phase out our older Federal Model Control Centers #TCC3 and replace them with Signal Division Sirens #PA300 and Switch #SW300. The installation of the Federal Equipment consumes 50% more time in labor than the signal equipment and requires that wiring be run literally from one end of the car to the other with some wiring being run several times the full length of the car. Should the control unit require servicing most of the above mentioned wiring has to be removed from the car. The Signal Division Equipment is wired 95% in the front seat area and should repair be needed the control unit can be simply unplugged and removed from the car. The money saved on installation alone of the signal system would almost pay for the unit itself. P. O. AN ORDINANCE AMENDING CHAPTERS |E100 and 9.163}OF THE MUNICIPAL CODE OF THE 'IOW& -Of-ETEE PARK, COLORADO, THE SAME PERTAINING TO ALARM SYSTEMS BE IT ORDAINED BY THE TRUSTEES OF THE TOWN OF ESTES PARK, OOLORADO: SECTION 1. That Chapter 9.100 of the Municipal Code of the Tbwn of Estes Park, Colorado is hereby amended to to read as follows: Sections: 9.100.010 Definitions generally. 9.100.020 Alarm device defined. 9.100.030 False alarm defined. 9.100.040 Main emergency terminal definded. 9.100.050 Alarm device terminating at town facilities. 9.100.055 Installation of direct connections. 9.100.060 Permit and registration required. 9.100.070 Permit application and registration. 9.100.080 Transfer of permit. 9.100.090 Permit tee. 9.100.100 Revocation of permit--Hearing. 9.100.110 Administration and regulation. 9.100.120 Audible fire and burglar alarms not to be similar to siren. 9.100.130 Instruction as to operation of system. 9.100.140 False alarm charges and penalties. 9.100.150 Responsibility for alarm service. 9.100.160 Service requirement. 9.100.170 Campliance required and time period. 9.100.180 Noncampliance deemed unlawful and a public nuisance. 9.100.190 Violation. 9.100.010 Definitions generally. For the purpose of this chapter certain terms and words are defined as set forth in this chapter. 9.100.020 Alarm device defined. "Alarm device" means any device located in a building (or-fadilit¥) in the town which, when activated, causes an alarm to be -transmitted to the town police or tire departments or other town terminals from any switchboard, transferring terminal or other switching device, either by self- dialing prerecorded notification units, telephone lines, radio waves, sound waves, or any other means; which alarm, whether sent directly or indirectly, is sent for the purpose of alerting any person or device of fire, intrusion, possible intrusion, open door, open window, holdup, or for any other purpose. 9.100.030 False alarm defined. "False alarm" means any alarm signal originating frantany_ alann -deViteto which the police or fire department responds and which results from: A. False activation, including reporting a robbery where no actual or attempted robbery has occurred, or reporting a burglar alarm where there is no evidence to substantiate an attempted or forced entry to the premises; B. Alarm malfunction, including a mechanical or electrical railure; C. Alarm triggered by permittee's or subscriber's negligence; D. Troubled condition of the alarm device, including electrical failure or telephone company malfunction. 9.100.040 Main emergency terminal de finded. "Main emergency terminal" means the telephone terminal utilized to receive emergency information for transmittal to the town police or fire departments and any other such terminal utilized for like purposes. 9.100.050 Alarm device terminating at town facilities. All alarm systems within the town now serviced by direct connection to the town-policq__dgpartment and fire department shall continue until (3~15*QF_ 1,- 19673, Upon the expiration of such period, the town departments shall-60 longer service such alarm systems and the direct connection with the town departments shall be terminated, except as provided in Section 9.100.055. C£100:0557 Installation of direct connections. The Town shall continue bo service by direct connection any alarm system of any medical facility which has as a requirement for its operation that said facility maintain an alann system. Said facility shall be responsible for all costs incurred by the Town in installing, maintaining, and/or removing its alarm system with the Town. All alarm system equiprnent shall be approved by the Town prior to installation. By use of the town' s facilities for direct connection of its alarm system, each facility agrees to indemnify and hold harmless the Town, any of its employees, officials and agents fram any and all claims and liabilities of any third party arising out of the monitoring of the alarm system by the Town. This indemnification shall include all attorneys fees and costs incurred by the Town, any of its employees, officials and agents as a result of the monitoring of an alarm system. 9.100.060 Permit and registration required. A. Alarm Business Permit. No person shall engage in, conduct, -2- operate or carry on an alarm business without first applying for and receiving a business permit therefor in accordance with the provisions of this chapter. B. No person shall place, allow or contract for the installation, servicing, maintaining, repairing, replacing, moving or removing of any alarm device unless registration of the device is made pursuant to and in compliance with this chapter. Existing alarm devices shall be registered on or before June 1, 1987. 9.100.070 Permit application and registration. A. Alarm Business Permit. Application for a permit to engage in, conduct, operate, or carry on an alarm business as set forth in Section 9.100.060A shall be in the form to be determined by the town. Upon the filing of an application for a permit in campliance with this chapter, the chief of police and the fire chief shall make such investigations as they deem necessary to satisfy the requirements set forth in this chapter. It must be determined by the town that all applicants for permits to engage in, manage, conduct or carry on an alarm business are of good character and of good business repute; have not been convicted of theft, embezzlement, or any felany or misdemeanor involving robbery, burglary, dishonesty, fraud or the buying or receiving of stolen property and do not employ persons who have been similarly oonvicted; or, if the applicant is a corporation, that its officers, directors, principal stockholders and employees meet said like requirements. To assist the chief of police and fire chief and/or the town in its investigations, the applicant and his employees shall furnish the following information and records: 1. Name and description of applicant and all employees; 2. Address and telephone number; 3. Fingerprints and photograph of the applicant and all employees to be taken by a member of the police department of the town; 4. A sworn statement as to whether or not the applicant or the applicant's employees have been convicted of a crime, felony or misdemeanor, the nature of the offense and the punishment assessed therefor; 5. A description of the activities proposed to be undertaken by the applicant and a description of all equipment to be used by the applicant in undertaking those activities; 6. A statement setting forth the experience, if any, with respect to the activities proposed to be undertaken; and 7. Such other information as may be reasonably required to carry out the purposes of this chapter. -3- B. Registration of Alarm Device. All alarm devices installed, serviced, maintained, repaired, replaced, moved or removed from any premises located within the town shall be registered with the town. Existing devices shall be registered on or before June 1, 1987. Every person maintaining an audible or silent alarm device shall furnish as part of the required registration, the type of alarm device being registered, name and telephone number of the alarm business or person to be notified to render service to the system during any hour of the day or night when such alarm sounds, unless such device also transmits notification to said alarm business or person upon its activation, together with the names and telephone numbers of the occupant of the premises and at least one alternate person and their address and telephone number. 9.100.080 Transfer of penmit. A. The permittee shall not transfer any permit issued under the terms of this chapter nor transfer the business or real property or an interest in the real property on which the alarm system is placed to any other person or entity without filing a request for transfer of pennit in the form to be determined by the town. B. The form shall contain information sufficient to allow the town to determine whether or not the proposed transferee is qualified under the provisions of this chapter. Failure to obtain approval of the transfer of the permit fram the town prior to transferring of the business or real property upon which the alarm system is located is a violation of the provisions of this chapter and subjects the permit to revocation under the terms and conditions of Section€97100:10077 C. In the event any person, including but not limited to a new owner or occupant, of a buil£ling 0TZ-faci]Jity#having an alarm device that is not in operation activates the alarm device or causes the alarm device to be activated, said person shall prior to activation, register said alann device with the town. 9.100.090 Permit fee. The fee for a permit to engage in, manage, conduct or carry on a business of installing, servicing, maintaining, repairing, replacing, moving or removing fire or burglar alarm devices shall be fifty dollars for each year or portion of the year the permit is in effect. The annual fee for such a pennit granted in a previous year shall be due and payable on or before January 31 st of each succeeding year in which the permit is to be effective. Upon such payment, the permit shall be renewed if there have been no violations of the provisions of this chapter with respect to the permit. 9.100.100 Revocation of permit--Hearing. A permit granted pursuant to this chapter may be revoked by the town for violation of any provision of this chapter and of rules and regulations in irrplementation thereof. The revocation shall be effective on the -4- fifteenth day after a notice of such revocation is placed in the United States mail, with adequate postage thereon, addressed to the permittee at the address shown on the permit being revoked, unless the pemittee has filed with the town within said fi fteen days a written appeal of the revocation addressed to the board of trustees. The board of trustees shall consider the appeal at the next regular meeting of the board of trustees following the filing of such appeal as herein provided. If the revocation is approved, such revocation shall be effective on the date the board of trustees approves the revocation. 9.100.110 Administration and regulation. The provisions of this chapter shall be administered and enforced by the chief of police and fire chief. They are authorized to make inspections of the fire or burglar alarm device and of the premises whereon the device is located, provided such inspections are consistent with the provisions of this code regulating inspections. The chief of police and fire chief shall have the power to make and enforce such rules and regulations as may in their discretion be necessary to irrplement the provisions as may be provided elsewhere in this code. Such rules and regulations shall be effective on the fifteenth day after a notice of such rules and regulations is placed in the United States mail, with adequate postage thereon, addressed to all holders of valid permits, issued in accordance with the provisions of this chapter, unless a permittee has filed with the town clerk a written objection to such rules and regulations addressed to the board of trustees. The board of trustees shall consider the objections at a hearing to be held at the next regular meeting of the board of trustees following the filing of such objections as herein provided. Such rules and regulations approved by the board of trustees shall be effective on the date of their approval. 9.100.120 Audible fire and burglar alarms not to be similar to siren. It is unlawful to install or use a fire or burglar alarm device which, upon activation, emits a sound similar to sirens in use on emergency vehicles or for civil defense purposes. 9.100.130 Instruction as to operation of system. It shall be the responsibility of the holder of a permit to instruct his subscriber and the occupant of the premises wherein the fire or burglar alarm device is installed in the proper use and operation of the device, whether silent or audible, including all necessary instruction in turning off the alarm and in avoiding false alarms. 9.100.140 False alarm charges and penalties. A. The permittee of the premises, amer or occupant of a residence, or operator of a business Call collectively referred to in this section as "permittee") wherein a fire or burglar alarm device is installed is subject to the following charges and penalties for all -5- false alarms from the device which exceed three in any calendar year: 1. Fourth false alarm, twenty-five dollars; 2. Fifth false alarm, fifty dollars; 3. Sixth false alanm, one hundred dollars; 4. Seventh false alanm, one hundred fifty dollars; 5. Eighth false alarm, two hundred dollars; 6. Ninth false alarm, two hundred fifty dollars; 7. Ch-€R*-filmalam-and-each successive-filmEilarm, -thEi;@7 - Ch-Pa-16113*=3 B. All false alarm charges shall be paid to the town within twenty days form the date of billing by the town. The town shall notify the permittee of each false alarm by a written notice thereof addressed to the permittee at the address shown on the pennit applicable to the premises. The permittee shall have fifteen days fram the date the notice is placed in the United States mail, with adequate postage thereon, within which to file with the town clerk a written request addressed to the board of trustees requesting that it determine that the permittee is not responsible for such false alarm and that the alarm should not be considered a false alarm under the provisions of this section. The board of trustees shall consider the request at the next regular meeting of the board of trustees following the filing of the request. If the board of trustees determines that the permittee is not responsible for the false alarm, the alarm shall not be considered a false alarm under the provisions of this section. 9.100.150 Responsibility for alarm service. The person or persons named in the permit to be notified upon activation of the device, or the person or persons notified by the device, shall, upon proper notification inmediately notify the town police or fire department of the alarm activation and then shall proceed immediately to the location of the activated alarm and render all necessary service; provided that the occupant of the premises may, by agreement with.the permittee, assume the permittee' s obligation to respond. 9.100.160 Service requirement. No person shall install, permit installation, maintain, or cause to be maintained any fire or burglar alann device for which periodic service or maintenance is not provided. 9.100.170 Campliance required and time period. All fire or burglar alarm devices installed on or prior to the effective date of the ordinance codified in this chapter shall be brought into conformity with the requirements of this chapter on or before June 1, -6- 1987. Any person owning, managing, conducting, carrying on the business of, or permitting the installing, servicing, maintaining, repairing, replacing, moving or removing of fire or burglar alarm devices, on the effective date of the ordinance codified in this chapter, shall be permitted a period not to exceed ninety days form such date to make application as required under the provisions of this chapter. Upon application to the town and showing of hardship by any person required to comply with this section, the town may permit an extension, for a reasonable period o f time, within which to canply with the provisions. 9.100.180 Nancompliance deemed unlawful and a public nuisance. Any and all fire or burglar alarm devices which do not camply with the provisions of this chapter are unlawful and a public nuisance, and shall be abated as such. 9.100.190 Violation. It is unlawful for any person to violate or fail to comply with any provision of this chapter. Every person convicted of a violation of any provision stated or adopted herein shall be subject to a fine and/or imprisonment as set forth in Section 1.20.020 of this code. SECTION 2. That Section 19.102 of the Municipal Code of the Town of Estes Park, Colorado is hereby deleted. SECTION 3. This Ordinance shall take effect and be enforced thirty days after its adoption and subsequent publication.
