The Classic is proposing to use the same race course as 1985; however, it is anticipated the "start/finish" line will be relocated. In a letter dated Febru- ary 10, 1986, Mr. Hobbs responded to the letters of critique submitted by Department Supervisors concerning the 1985 race. Discussion followed regarding notification, in person, of mer- chants and residents affected by the race course: notification efforts should be as good as or better than last year; specifica- tions and regulations for the "banner": a copy of which was submitted to Mr. Hobbs; plantings: every effort will be made (i.e.: boost.ing the number of PA announcements advising specta- tors to use caution near all plantings, additional free-standing fence poles) to protect landscaped areas; the "VIP/Sponsor" stage area: ensure the area is secured so as to prevent any alcoholic beverage from being available to the general public; prior notification by f.he. Classic to the Fire Department of the race set-up time which will enable the Department to relocate fire equipment; the possibility of installing bleachers for spectator viewing on Elkhorn Avenue; concessions: operation of thrce concession stands in the vicinity of the Start/Finish area; marshals: additional marshals will he included this year; and parking: the Classic requires approximately 100 parking spaces for the entire crew. The Committee recommends: (1) not allowing : ··mving concessionairef, (2) the VIP/Sponsor stage area_be allowed 2 to serve an alcoholic beverage, ensuring the beverage is con- ' tained to the stage area, and (3) the Wiest and American Legion /64 Parking Lots be designated for Coors Classic Crew Parking with notification, bv letter, of the parking assignment to all affect- ed merEEZEis. Submittal of pertinent drawings to the Town Clerk will be forthcoming. Contact person for the Town will be Police Chief Ault and Chamber Advertising Manager Myers. PARKING: The Committee discussed the level of enforcement desired in time-limit parking lots. Chief Ault reported eleven part-time officers will be on staff this summer; nine traffig directors and two parking attendants. Should a revision concerning the afore- mentioned personnel he necessary, the matter will be considered by the Committee at that time. As an example of stringent enforcement of the parking limits, Chief Ault stated that in a two-hour parking lot, vehicles would be checked and ticketed 15 minutes following tile ti.me limit. The Committee recommends strict enforcement of all time-limits in parking lots. Public Works Director widmer presented a drawing of all parking lots and a summary shoot indicating parking lot number, location, name, existing and proposed parking spaces, and parking limits. GENERAL PROVISIONS It is agreed that a united effort shall be made toward reducing man-caused fires, and that the parties shall work in close harmony on matters pertaining to public relations, fire prevention, and fire suppression activities, including: The exchange of up-to-date basic information regarding protection area, maps, manpower, supplies, equipment and communication facilities on a continuing basis. SPECIFIC PROVISIONS 1. That each party shall make available to the other party such manpower and equipment as may be requested and can reasonably be spared at the time. 2. That the loaning party shall receive no reimbursement from the benefiting party for services rendered unless the benefiting party specifically requests such services as may be beyond that assistance which is readily available /in the immediate vicinity and the lending party incurs expenses in supplying the same. 3. The Town (Estes Park Volunteer Fire Department) will be the primary responder for structural and vehicle fires as well as matters relating to hazardous material incidents occurring within Rocky Mountain National Park west FRWK €Sres PR/2127 <ZIZE~to the Trail Ridge Store and south to the Allenspark Fire Protection District' s north boundary on Highway 7. The Service (Rocky Mountain National Park) will not maintain its own structural fire organization but instead will rely on the Town (Estes Park Volunteer Fire Department) to provide structural fire protection within the area described above. The Town (Estes Park Volunteer Fire Department) will maintain a substation and structural fire truck within the Rocky Mountain National Park Headquarters Utility ARea, as specified in the attached special use permit, for fire response both within and outside the park. 4. The Service (Rocky Mountain National Park) will maintain its own wildfire control/management organization (for suppression/management of forest, brush and grass fires). 5. That each party shall be responsible for the control of wildland (forest, brush, grass) fires within its jurisdiction, but shall report all fires discovered on the other party's property. 6. That either party may take initial wildland fire suppression action on lands of the other party, provided that notification of such action shall be made as soon as practicable by the initial action party's fire chief or person in charge to the benefiting party. The initial response party shall be in charge of wildland fire suppression until such time as he is relieved by the fire chief or responsible party of the suppression crew within whose jurisdiction the wildland fire is burning. 7. That upon occasions when wildland fires occur near boundaries between jurisdictions, each party shall bear the entire cost of suppression which it actually incurs. 8. That suppression action shall be taken concerning wildland fires occurring on properties not owned by the parties but lying within the boundaries of their jurisdictions when such fires threaten public lands. 9. That in dispatching wildland fire fighters, equipment, supplies and tools to a fire located upon the other party's property, the loaning party shall provide all transportation to and from the fire for said personnel and materials. 10. That neither party shall be expected to jeopardize the security of its property by dispatching all of its available fire protection resources to the fire on property of the other. 11. That with respect to cooperative fire assistance under the terms hereof, each party shall submit a copy of its report of the fire and the party's efforts in regard thereto to the other. 12. That no engine-powered earth-moving equipment of any type shall be used for fire suppression action on any lands or upon privately owned lands outside Rocky Mountain National Park without prior approval of the landowner. 13. That each party hereto waives all claims against the other for liability for any loss, damage, personal injury or death occurring in consequence of the performance of this agreement--except as specifically set forth in the attached special use permit as concerns fire response/operations outside the boundaries of Rocky Mountain National Park. 14. That the parties to the Agreement shall not discriminate against any employee or applicant for employment because of race, color, religion, sex or National origin. They will take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, color, religion, sex or National origin. Rocky Mountain National Park will maintain the fire truck described above including the chassis, engine and pump. All other equipment, as described on Exhibisel#it be maintained by the Town. The fire truck will be replaced by the park at a future date, as necessary, based upon National Park Service standards concerning replacement of special purpose vehicles. 18. Licensing. The fire truck described above will be licensed by the Town; Estes Park Volunteer Fire Department identification decals will be affixed to the truck. 19. Indemnification. The Town will indemnify and hold harmless the United States from any and all damages, including claims of third parties, arising out of or in any way connected with the operation by the Town of the fire truck outside the boundaries of the park. The Town shall carry insurance to comply with this provision and to reimburse the park for damages to or total loss of the fire truck should such an event occur in connection with fire suppression activities outside the boundaries of the park. The Town shall furnish proof of such insurance coverage to the park by submitting a copy of the policy or a certification from the insurance company by January 30 each year of the term hereof.
