General Liability: Require a certificate of insurance in the amount of $400,000; such certificate Will indicate either bodily injury and property damage in the amount of $400,000, or bodily injury and property damage combined in the amount of $400,000. 2. Liquor: If an event is to have liquor served free-of-charge to participants, the insurance certificate Will include "host liquor liability coverage." Should the event serve liquor for a fee, a "Special Events" Liquor Permit and "liquor legal liability coverage" will be required. 3. Town Facilities: If the event is to use Town facilities which will be under the control of the participants, not the Town, the coverage will include "all risks legal liability." 4. Minor Injuries: In order to provide no-fault coverage for minor injuries, "premises medical coverage" will be required which provides $1,000 worth of medical coverage without regard to liability. 5. In the event the certificate indicates that a broad form comprehensive general liability endorsement is part of the policy, all the aforementioned coverages will be contained therein. 6. Automobile Liability: Bodily injury, per person, $400,000 and property damage $400,000; or bodily injury and property damage combined $400,000; "Garage keepers liability" will be provided where automobiles are going to be parked on Town property; this coverage will provide coverage for damages to said vehicles. 7. Excess Liability: The Town will require an "umbrella" of $1,000,000 over and above the primary coverages. The Town of Estes Park will be named as an "additional insured" on all the policies. The parties will be required to provide the Town with a copy of the endorsement naming the Town as an addi- tional insured prior to the event. The Board of Trustees will retain the right to grant exceptions where applicable. Finance Officer Vavra administer all insurance certificates. Participants will be required to submit an insurance certificate at least 30 days prior to the event. Santals Storybook Parade Friday, November 28th, 5 pm - Following the 4:30 Lights On Ceremony Saturday, December 13th, 5 pm Both parades this year will be an offical part of the NewsCenter 4/Salvation Army 'Spirit of Giving' program, whereby people attending the parade will be asked to bring non-perishable foodstuffs, to be put in ten collections boxes along the parade route and to be used for Christmas baskets. A combined effort by the Salvation Army and Crossroads Ministry will insure that the necessary amounts of food will be left for Estes Park use prior to the remainder being used by the Salvation Army throughout the rest of the state. Each parade will have a minimum of two bands, ten to fourteen floats and 200 walking costumed characters. There will be no horses in the parade. The December 13th parade will also feature Miss Tennesee, Miss Colorado and Scott Howard of the Walt Disney Productions. The costumes, again, are being furnished by the Fine Arts Guild. The events will be backed by the Ad Committee with 140,000 newspaper inserts, a radio campaign and Channel 4's own PR campaign. We will again have Ed Greene as host, Larry Green as Chairman of the 'Spirit of Giving', Marc McLean of KYOU, Larry Petersen Cheyenne. For the second parade we will invite two additional radio personalities. We again wish to have the main stage in the Coffee Bar parking lot and a second announcers truck in front of Bob's Chevron. The alternative proposal appears quite costly to end up with a unit which is still slightly undersized to ventilate the total area. Box 1200 Estes Park, CO 80517 RE: Dispatch, Reception, and New Office HVAC in the Police Station Attn: Mike Mangelsen Dear Sir, Thank your for requesting our solution to your year round ventilating and cooling requirements. Our understanding of the problem is as follows: 1. Ventilation of four to five air changes per hour in the three rooms is desired. 2. Warm air off of the central air handling unit over heats this interior space which has its own internal gain of approximately 18000BTU/hour. This is especially true in the winter season. 3. The new office is particularly stuffy and needs air conditioning and ventilation. We believe the best solution would consist of a new roof top unit in replacement of the two-ton existing Ammana Air Conditioner. The new unit should be a three-ton air conditioner with an economizer. Other minor system modifications would be done as to provide the best system energy consumption. This effort would have an approximate design-build cost of $5,500.00 (five thousand five hundred). In reply to utilizing the existing Ammana roof top unit (approximately 1972 equipment), we feel the unit is slightly undersized to provide adequate ventilation and air conditioning. Nevertheless our solution in conjunction with this existing system is as follows: 1. Place a new two position damper on the return air outside plenum which will open on the cooling call. 2. Place a new thermostat on the wall with an operational "fan· on" call. 3. Hook up one of the existing eight inch diameter flex lines to the new office diffusers from the air conditioner supply. 4. Rebalance the air supply from the existing central air handling system. 5. Install a low ambient operation kit on the Ammana compressor refrigeration system. We will perform this work and supply all labor, equipment, material, and necessary insurance for the sum of $1490.00 (one thousand four hundred ninety). This quote is made on a not to exceed basis and any savings would be passed on to you. Please feel free to contact us with any question or suggestions. We hope our solutions will assit you. Gentlemen: At a recent board meeting of the High Drive Property Owners' Association the existance of a dangerous situation to traffic was discussed and motion made that we seek study and solution by the Town and County Government. The map of the recent acquisition of property by the Town of Estes Park tends to indicate that the HIGH DRIVE *road remains as a County maintenance responsibility from the also recently installed traffic light at this inter- section, to the road's western terminus. As I learned in a discussion with Mr. Richard Widmer at the Estes Town Hall, the acquisition did not include any *part of the High Drive road (with the possible exception of that from the light to the demarcation as indicated on the map copy attached) -- The Town's annexation conceive- ably begins on North edge of the road almost immediately east of the Bait and Bullet (building) and before the East property line (numbered 10) and continues westerly to a point beyond the west limits of property #9, then north around the (Sterling) cottages. The problem as we see it is, it is difficult to con- trol traffic parking and leaving the areas in front of and between both properties on the north side of High Drive west of the intersection -- and presently, parking is per- mitted at the front of the (convenience) store and the Bait and Bullet, as well as in the area between both of these stores; exiting from these parking spaces may be made only to the South on to High Drive, with visibility limited East or West by buildings and cars parked in front of each estab- lishment; traffic approaching from the east, depending on the traffic control light, may enter High Drive at speeds of from zero to 35 MPH with similar visibility limits as men- tioned for those vehicles and pedestrians leaving the parking areas. *Par. 2 -- with Mr. Widmer *Par. 3 -- writer's opinion after further review of - - - attached map. SAFETY -- (Page 2) 7/25/86 (Cont'd.) Also, adding to the problem, cars parked in front of the (Convenience) store, depending on the length, the manne r in which and the dexteriby of the driver, may extend their rear portion out into the travel area of High Drive -- (please note in particular the WESTERLY two parking areas in front of the convenience storj -- the cars parked in front of both stores, may, at times, be required to back into the heavily travelled road. One possible (passive) control discussed with Mr. Widmer consisted of a yellow line at the road's north edge to the western end of Town acquisition, however, Mr. \Vidmer rightly indicated that a solid line on the road is a '4:o Cross" situation, therefore it was rationalized that a "broken" yellow line would tend to pose a warning to persons/cars entering High Drive from the property taken over by the Town of Estes Park that "Caution should be used in entering High Dri*e" further, that this line could define parking area limits. May we respectfully request your consideration of this matter which we consider a potential hazard to both life and property. The Parties to this Agreement are the PINEWOOD SPRINGS FIRE PROTECTION DISTRICT ("Pinewood") and the TOWN OF ESTES PARK ("Town"). 2. RECITALS AND PURPOSE. District is a special district organized pursuant to state statute and provides fire protection services and other emergency services within its boundaries. Town is a statutory town organized pursuant to state statute and maintains and operates a fire department which also provides fire protection services and other emergency services both within and without its boundaries. The parties have determined that it will be to the mutual benefit of each party to assist the other when necessary in providing mutual assistance in the performance of fire fighting and related emergency services. The purpose of this Agreement is to set forth the terms and conditions of such mutual assistance and to revoke all prior agreements. 3. DEFINITIONS. For the purposes of this Agreement , the following terms shall have the following meanings: 3.1 "Requesting Party" shall mean the party reqeusting assistance. 3.2 "Answering Party" shall mean the party responding to a request for assistance within the boundaries or service area of the requesting party. 3.3 "Incident Commander" is the officer or designated person who is in charge of the emergency scene. 3.4 "Response or Respond" shall mean the actual responding of the answering party to an emergency scene for the purposes of rendering mutual aid and assistance and shall connote a period of time which is more limited in duration as distinguished from a temporary assignment of duty. 3.5 "Emergency" shall mean situations or incidents endangering life or property including, but not limited to, conflagrations, forest fires, disasters (both natural and man-made) and may, at the discretion of the requesting party, include certain medical responses. 4. MUTUAL AID AND ASSISTANCE. Each party hereby agrees to respond to emergencies within the boundaries and service areas of the other party upon request of the Fire Chief of the requesting party (or his/her designated assistant) without charge therefor and subject to the following terms and conditions: 1 . 4.1. Response by the answering party shall be at the sound discretion of the Fire Chief (or his/her designated assistant) as to what personnel and equipment shall answer the emergency and as to whether, in any event, such response may be given consistent with the safety and protection of the residents and property of the answering party. 4.2 Equipment and personnel of the answering party shall at all times be under the direct supervision and control of the Fire Chief and officers of the answering party and subject to the general direction of the incident commander. 4.3 Pursuant to Sections 29-5-109 and 110 C.R.S., 1973, workmen's compensation, medical disability payments, pensions and other benefits provided by the answering party to its firefighters shall be unaffected by the fact that the occurrence giving rise to such benefits may occur outside of the party's boundaries or service area under this Agreement. 4.4 The answering party shall remain responsible and liable for its own equipment and personal property while responding under this Agreement. 5. INSURANCE. The District and the Town affirmatively represent that each party has liability insurance coverage for any negligent or otherwise tortious act of any responding fireman and/or personnel committed while said person is responding under the terms of this agreement. Each party shall annually provide the other party with a certificate of insurance showing the other party as a certificate holder. Each party shall immediately notify the other party of any material change in any of its insurance coverage. Each party shall maintain liability and insurance coverage in an amount necessary to satisfy the insurance requirements of the Colorado Governmental Immunity Act. 6. TERM. This Agreement shall continue in full force and effect until revoked in writing by either party giving the other party 30 days advance notice. 7. IMPLEMENTATION. The respective Fire Chiefs shall establish standard procedures to implement this Agreement and shall conduct periodic critiques of mutual aid incidents. 8. BINDING EFFECT. This Agreement shall be self executing and shall be binding upon the successors in office of the respective parties and need not be ratified by the successive governing bodies of the respective parties.
