KAPPELY SUBJ: RADAR SIRS; AFTER HAVING MET WITH THE THREE REPRESENTATIVES OF THE RADAR MANUFACTURES, "MPH", KUSTOM AND DECATUR, I WOULD LIKE TO MAKE THE FOLLOWING RECOMMENDATIONS. I RECOMMEND THAT WE PURCHASE THE DECATUR "HUNTER" AND THAT WE PURCHASE THREE UNITS, ONE FOR EACH PATROL VEHICLE. ALONG WITH THE RADAR UNITS, I RECOMMEND THAT WE BUY ONE EXTRA ANTENNA FOR EACH PATROL VEHICLE. THE WHITE SWITCH THAT IS AN OPTIONAL UNIT FOR THE RADAR UNIT SHOULD ALSO BE PURCHASED FOR EACH CAR. THE REASONS FOR MY RECOMMENDATIONS ARE AS FOLLOWS: 1. COST! THE COST OF EACH "HUNTER" RADAR UNIT BASIC PACKAGE IS $695.00. WITH ONE EXTRA ANTENNA, COST $200.00, AND THE WHITE SWITCH, $25.00, THE TOTAL COST IS $920.00. THE TOTAL COST TO OUTFIT THE THREE PATROL VEHICLES WOULD BE $2760.00. "KUSTOM" AND "MPH" COULD NOT EVEN COME CLOSE TO THIS FIGURE. 2. USE! THE "HUNTER" FROM DECATUR IS PERFECT FOR OUR NEEDS IN THE ESTES PARK AREA. THE "HUNTER" IS COMPUTERIZED, WHICH I BELIEVE WILL BE THE FUTURE OF RADAR. NO OTHER RADAR MANUFACTURER HAS THIS CAPABILITY.. 3. SIZE! THE "HUNTER" IS THE SMALLEST RADAR UNIT AVAILABLE AND WILL FIT NEATLY IN THE PATROL VEHICLES WITH OUT BEING AN OBSTICLE. 4. SERVICE! BECAUSE OF THE COMPUTERIZATION OF THE RADAR UNIT,
PAGE 2 DOWN TIME OF THE UNIT FOR SERVICE OR REPAIR CAN BE KEPT TO 72hrs TO ONE WEEK. OTHER REASONS FOR MY RECOMMENDATIONS AS TO OPTIONS ARE: 1. EXTRA ANTENNAS! BY PURCHASING AN EXTRA ANTENNA, WHICH WOULD BE PLACED IN THE REAR WINDOW OF THE PATROL CARS, IS THAT OF EFFICIENCY. WHEN THE RADAR UNIT IS BEING USED IN THE "STATIONARY" MODE OF OPERATION AND YOU WANT TO PICK UP A VEHICLE THAT IS COMING UP BEHIND YOU, ALL YOU HAVE TO DO IS "FLIP A SWITCH" INSTEAD OF PHYSICALLY REACHING UP AND TURNING THE ANTENNA THAT IS MOUNTED ON THE DASH, AROUND. FOR ONE THING, THE LESS YOU HANDLE THE EQUIPMENT, THE LONGER THE EQUIPMENT WILL LAST. THE SECOND REASON IS THAT OF TIME. IT TAKES LESS TIME TO FLIP A SWITCH THAN TO UNLOOSEN A NUT, TURN THE ANTENNA, TIGHTEN THE NUT AGAIN AND THEN RETEST THE UNIT. PROBABLY THE MOST IMPORTANT REASON IS THAT THE RANGE OF THE RADAR IS GREATLY REDUCED WHEN "SHOOTING" THRU THE METALIC CAGES THAT SEPARATE THE FRONT SEAT FROM THE BACK SEAT. 2. WHITE SWITCH! THIS ITEMS GREATEST ADVANTAGE IS ONE OF SAFETY. THIS SWITCH ALLOWS THE OPERATOR TO OPERATE THE RADAR UNIT WHILE DRIVING, WITH OUT HAVING TO TAKE YOUR EYES FROM THE ROAD AND TRAFFIC, TO LOCK ON THE RADAR, RELEASE THE RADAR SPEED BEING HELD AND OPERATE THE RADAR DETECTOR HOLD BUTTON. 3. THREE RADAR UNITS! BY PURCHASING THREE RADAR UNITS, THIS WOULD ELIMINATE THE NEED OF MOVING THE RADAR FROM CAR TO CAR. ANY TIME YOU CAN KEEP FROM HANDLING THE UNITS, THE BETTER. THE LIFE OF THE RADAR UNIT CAN BE DOUBLED BY LEAVING THE UNIT ALONE.

AGREEMENT THIS AGREEMENT, made this day of , 1986, by and between the Town of Estes Park, Colorado, A Municipal Corporation, as party of the first part, and the Longs Peak Scottish Highland Festival, Inc., as party of the second part; WITNESSETH: WHEREAS, the second party desires to hold its Scottish Highlands Festival at the Estes Park Fairgrounds at Stanley Park (hereinafter referred to as "Stanley Park") Estes Park, Colorado on the hereinafter set forth dates and to make contractural agreements for the use of the facilities at Stanley Park and services to be furnished by the first party in connection with the use of said facilities. NOW, IT IS AGREED AS FOLLOWS: 1. The second party shall hold a Scottish Highlands Festival on the following date or dates: September 5, 1986 September 6, 1986 2. The first party agrees to furnish to second party the use of grandstands and Arena A of Stanley Park after 6:00 P.M. on said dates. The rental of the grandstands and Arena A of Stanley Park shall be $200.00 per day. 3. The first party agrees to furnish to the second party use of West Barn (Barn V) for animals at Stanley Park. The first party will not furnish any feed or straw for any of the animals and no cleaning of the stalls. The rental of the West Barn (Barn V) of the Stanley Park area shall be assessed at $5.00 per stall per day. 4. The first party agrees to furnish to second party all available camper hook-up sites with water, electrical and sewer facilities. The first party will not furnish any cleaning of the facilities. The rental of the camper hook-up sites with sewer facilities shall be $10.00 per hook-up per day. All vehicles with self-contained sewage storage units must be dumped only at the sanitation dump station, located within Stanley Park. Each
vehicle using said dump station shall be assessed a fee of $2.00 for each use of the sanitation facility. 5. The first party agrees to furnish to second party all available automobile parking in the northeast pasture only of the Stanley Park area. The first party will not furnish any cleaning of the parking or pasture area. The rental of the automobile parking in the northeast pasture of the Stanley Park area shall be 50¢ per automobile per day. 6. First party assumes no responsibility or liability for injury, sickness or death of any person or animal, nor for the loss, damage or destruction of personal property of any person, while on first party's property in accordance with the provisions of this agreement. The second party agrees to save the first party harmless for any liability or expenses from any third party claims for losses, damages or injuries including attorneys fees and costs, which are caused or alleged to be caused directly or indirectly, by second party, its employees, agents, animals or equipment. 7. The second party must furnish to first party a duly executed certificate of insurance of an insurance company authorized to do business in the State of Colorado at least thirty (30) days before September 5, 1986. Said certificate must show first party as an additional named insured and shall evidence the existence of the following minimum limits of liability: $150,000 bodily injury for each person, with total liability for two or more persons injured in a single occurrence of $400,000; $400,000 property damage for each occurrence; and that at least ten (10) days notice must be given to the first party as holder of the certificate before the policy certified to can be cancelled. Second party shall furnish all other coverages as required by the Town of Estes Park. 8. The first party shall provide for the use of second party the Stanley Park grandstands and Arena A, water utilities, a public address system, microphone, amplifiers and light for all night performances without expense to second party. The arena -2-
lights shall be turned off by second party one half hour after each night show. First party shall not be responsible or be required to provide any spotlights to second party. First Party agrees to work the arena to the best of its ability prior to 6:00 P.M. 9. The first party shall not furnish parking attendants, security, ticket sellers or takers, to or for the benefit of second party. 10. First party shall have at least one representative at the Stanley Park area during the time the second party is using said park as herein provided. 11. Second party acknowledges that the Northern Colorado Quarterhorse Association has the right to use the Stanley Park area fairgrounds including three arenas and horse barns other than the Barn V rented to second party as herein provided, on the following days and times: September 5, 1986 4:00 A.M. - 6:00 P.M. September 6, 1986 4:00 A.M. - 6:00 P.M. September 7, 1986 4:00 A.M. - 6:00 P.M. 12. Second party acknowledges that the Estes Park Lion's Club has an exclusive food and beverage contract for all food and beverages sold within the Stanley Park area during the time of the Scottish Highlands Festival. 13. All dogs and other small animals that are on first party's property must be on a leash and under the control of the owner or custodian of said animals. The provisions of Chapter 7.12 of the Estes Park Municipal Codes will apply to all dogs on the first party's property. 14. The first party, by and through its designated representatives, shall conduct a count on all stalls and service hook-ups for which a daily fee is to be charged pursuant to this agreement. Said count shall be made each morning beginning at 7:00 A.M. The amount due from second party to first party pursuant to this agreement shall be determined on the basis of said count. 15. The parties agree that during the time pertaining to this agreement, persons not affiliated with second party should -3-
not be permitted to utilize the stalls or barn area assigned to second party except as herein provided. First party assumes no responsibility or liability for injury. 16. The first party chairman of the Scottish Highland Festival Committee is: The second party's representative for the Scottish Highland Festival is: 17. This contract represents the entire agreement between the parties and shall not be amended by either of the parties hereto without written consent of the other party. 18. This contract shall be binding upon the inure to the benefit of the parties hereto, their respective heirs, personal representatives and assigns as the case may be. 19. All of the participants, guests and employees of the second party shall comply with the ordinances, rules and regulations of the Town of Estes Park. IN WITNESS WHEREOF the parties hereto have hereunto set their hands the day and year first above written. AGREEMENT THIS AGREEMENT, made this day of , 1986, by and between the Town of Estes Park, Colorado, A Municipal Corporation, as party of the first part, and the Longs Peak Scottish Highland Festival, Inc., as party of the second part; WITNESSETH: WHEREAS, the second party desires to hold its Scottish Highlands Festival at the Estes Park Fairgrounds at Stanley Park (hereinafter referred to as "Stanley Park") Estes Park, Colorado on the hereinafter set forth dates and to make contractural agreements for the use of the facilities at Stanley Park and services to be furnished by the first party in connection with the use of said facilities. NOW, IT IS AGREED AS FOLLOWS: 1. The second party shall hold a Scottish Highlands Festival on the following date or dates: September 5, 1986 September 6, 1986 2. The first party agrees to furnish to second party the use of grandstands and Arena A of Stanley Park after 6:00 P.M. on said dates. The rental of the grandstands and Arena A of Stanley Park shall be $200.00 per day. 3. The first party agrees to furnish to the second party use of West Barn (Barn V) for animals at Stanley Park. The first party will not furnish any feed or straw for any of the animals and no cleaning of the stalls. The rental of the West Barn (Barn V) of the Stanley Park area shall be assessed at $5.00 per stall per day. 4. The first party agrees to furnish to second party all available camper hook-up sites with water, electrical and sewer facilities. The first party will not furnish any cleaning of the facilities. The rental of the camper hook-up sites with sewer facilities shall be $10.00 per hook-up per day. All vehicles with self-contained sewage storage units must be dumped only at the sanitation dump station, located within Stanley Park. Each
vehicle using said dump station shall be assessed a fee of $2.00 for each use of the sanitation facility. 5. The first party agrees to furnish to second party all available automobile parking in the northeast pasture only of the Stanley Park area. The first party will not furnish any cleaning of the parking or pasture area. The rental of the automobile parking in the northeast pasture of the Stanley Park area shall be 50¢ per automobile per day. 6. First party assumes no responsibility or liability for injury, sickness or death of any person or animal, nor for the loss, damage or destruction of personal property of any person, while on first party's property in accordance with the provisions of this agreement. The second party agrees to save the first party harmless for any liability or expenses from any third party claims for losses, damages or injuries including attorneys fees and costs, which are caused or alleged to be caused directly or indirectly, by second party, its employees, agents, animals or equipment. 7. The second party must furnish to first party a duly executed certificate of insurance Of an insurance company authorized to do business in the State of Colorado at least thirty (30) days before September 5, 1986. Said certificate must show first party as an additional named insured and shall evidence the existence of the following minimum limits of liability: $150,000 bodily injury for each person, with total liability for two or more persons injured in a single occurrence of $400,000; $400,000 property damage for each occurrence; and that at least ten (10) days notice must be given to the first party as holder of the certificate before the policy certified to can be cancelled. Second party shall furnish all other coverages as required by the Town of Estes Park. 8. The first party shall provide for the use of second party the Stanley Park grandstands and Arena A, water utilities, a public address system, microphone, amplifiers and light for all night performances without expense to second party. lights shall be turned off by second party one half hour after each night show. First party shall not be responsible or be required to provide any spotlights to second party. First Party agrees to work the arena to the best of its ability prior to 6:00 P.M. 9. The first party shall not furnish parking attendants, security, ticket sellers or takers, to or for the benefit of second party. 10. First party shall have at least one representative at the Stanley Park area during the time the second party is using said park as herein provided. 11. Second party acknowledges that the Northern Colorado Quarterhorse Association has the right to use the Stanley Park area fairgrounds including three arenas and horse barns other than the Barn V rented to second party as herein provided, on the following days and times: September 5, 1986 4:00 A.M. - 6:00 P.M. September 6, 1986 4:00 A.M. - 6:00 P.M. September 7, 1986 4:00 A.M. - 6:00 P.M. 12. Second party acknowledges that the Estes Park Lion's Club has an exclusive food and beverage contract for all food and beverages sold within the Stanley Park area during the time of the Scottish Highlands Festival. 13. All dogs and other small animals that are on first party's property must be on a leash and under the control of the owner or custodian of said animals. The provisions of Chapter 7.12 of the Estes Park Municipal Codes will apply to all dogs on the first party's property. 14. The first party, by and through its designated representatives, shall conduct a count on all stalls and service hook-ups for which a daily fee is to be charged pursuant to this agreement. Said count shall be made each morning beginning at 7:00 A.M. The amount due from second party to first party pursuant to this agreement shall be determined on the basis of said count. 15. The parties agree that during the time pertaining to this agreement, persons not affiliated with second party should -3-
not be permitted to utilize the stalls or barn area assigned to second party except as herein provided. First party assumes no responsibility or liability for injury. 16. The first party chairman of the Scottish Highland Festival Committee is: The second party's representative for the Scottish Highland Festival is: 17. This contract represents the entire agreement between the parties and shall not be amended by either of the parties hereto without written consent of the other party. 18. This contract shall be binding upon the inure to the benefit of the parties hereto, their respective heirs, personal representatives and assigns as the case may be. 19. All of the participants, guests and employees of the second party shall comply with the ordinances, rules and regulations of the Town of Estes Park. The estimated premium at this time is $1500. I will need payment for this prior to the event to insure coverage. Also we were discussing the town's requirements for insurance. We are writing $500,000 limits for premises and operations. For a special event there is no medical payments coverage available through our markets, broad form comprehensive general liability is also not available, excess liability is not available and neither is garage keepers liability. Also liquor liability for a special event is currently not available. Estes Valley Recreation District does have a liquor liability policy and it is possible you could be added to their policy but only with their permission could this be done and it is only a possibility. We do not have any problem adding the Town of Estes Park as an additional insured as is .indicated on the certificate. Please let me know if you have any questions or need further information. Box 1820 Estes Park, CO 80517 Dear Dr. Durward: This is in response to your request for information about.the Association of Scottish Games and Festivals. The Association was formed in 1982 by Chuck Bearman, then President of the Virginia Games, to: "encourige, support and assist member organizations in the prod- uction and presentation of Scottish Games and Festivals....by serving as a clearing house and open forum for the exchange of ideas, information and techniques." Member organizations must have presented a Sdottish Games or Festival for a minimum of three years, be associated with, or incorporated as a non-profit corp- oration, and be dedicated to furthering the cultures heritage and traditions of Scotland. Newly formed organizations, who are unable to meet all three criteria are encouraged to join as Associate members. Associates receive the same benefits of mem- bership as do Members, except that they may not vote, and their representative(s) may not serve as Officers of ASGF. One of the most important aspdcts of the Association is acting as a clearing house for dates, and .for the exchange of information at special and annual meetings. To accomodate the increased size of the Association - nearly fifty Games and Festivals - I am developing a Newsldtter on an irregular schedule, as a means of transmitting information received and to provide a means of communicating in addition to those al- ready in place. ASGF conducts surveys as -a service to tha members, provides points- of-contact with other games, publishes an events calendar each year, and encourages reciprocal listing of member's events in Games Souvenir Programs.The-annual meeting is held on the first Saturday in December in Alexandria, VA; coinciding with the Christmas Walk and associated events. Many of the ASGF members have participated in a Group Liability Insurance coverage for the past several years. The coverage is for any event sponsored by the member dur- ing the year, ·and includes $1,000,000 general- li-ability,plus $3,000 organizational property damage, $2,000 in currency loss at the gate through theft, and host liquor insurance; the rate for this year ('86) was $213.00 per participating member. The ASGF By-Laws requires a.$50.00 initiation fee for both Regular and Associate members, and the Annual dues are currently $25.00.
