(2) Each of the parties agrees to respond to fire calls within the boundaries of the other party upon request of the Fire Chief of said other party or his designated and authorized assistant, at any and all times, provided that it shall be entirely within the dis- cretion of the Fire Chief of the answering party or his designated assistant as to what personnel and equipment shall answer such fire call and whether or not, in any event, such fire call may be an- swered consistently with the safety and protection of the citizens and property of said answering party. (3) Each of the parties agrees to answer fire calls of the other party subject to the approval of each call by the Fire Chief of the answering party or his designated assistant, as set forth in paragraph (2) above, without charge therefor, and with the express understanding that fire personnel and equipment of said answering party shall be subject only to the liability, workmen's compensation and/or other insurance of said answering party. The equipment and personnel of the answering party shall at all times be under the direct supervision and control of the Fire Chief of said party, or his designated assistant, subject to the general direction of the incident commander. 4/7, ./ ." 1 (4) The equipment and personnel of each of the parties, while engaged in performing any mutual aid service, activity or undertak- ing under provisions of this Agreement, shall have and retain all rights, privileges and immunity of, and be deemed to be engaged in, the service and employment of such party, notwithstanding that such mutual aid service is being performed in or for the requesting party. ALLENSPARK FIRE PROTECTION DISTRICT By President, Board of Directors ATTEST: (seal) Secretary By President, Board of Directors ATTEST: (seal) Secretary RNL:mj 2 MUTUAL AID AGREEMENT THIS AGREEMENT, made and entered into this 13th day of April , 1976, by and between the TOWN of ESTES PARK, COLORADO, a municipal corporation, hereinafter referred to as Town, and the ALLENSPARK FIRE PROTECTION DISTRICT, a quasi-municipal corporation, hereinafter referred to as Dis- trict, WITNESSETH: WHEREAS, the parties desire to provide for mutual aid and assistance to each other in the event of any conflagra- tion, fire or other such emergency within their respective jurisdictions; and WHEREAS, the parties desire to state in writing their policies relative to such emergencies and the laws of the State of Colorado pertaining thereto. NOW, THEREFORE, it is agreed as follows: 1. In accordance with the provisions and authority of section 29-5-107, C.R.S. 1973, as amended, the chief of the fire department of one of the parties hereto may request the chief of the fire deparment of the other party hereto to assign to him firemen and/or equipment of such other party, to perform temporary duty within the boundaries of the request- ing party when, in his opinion, the same are required by any conflagration, fire or other such emergency. Such firemen and/or equipment shall be under the direction and control of the requesting chief and under such terms and conditions as shall be agreed upon between the requesting and assigning chiefs. Such firemen shall; while so assigned and performing duties subject to the direction and control of the requesting chief, have the same power as regular firemen of the request- ing party. 2. In accordance with the provisions of section 29- 5-105, C.R.S. 1973, as amended, the chief of the fire depart- . ment of either of the parties hereto may, in his discretion and upon the request therefor by the chief of the fire depart- ment of the other party hereto, assign members of his depart- ment, together with such equipment as he determines proper, to perform temporary fire fighting or other duties under the direction and control of the requesting fire chief; however, the assigning fire chief may require that such firemen and equipment shall be under the immediate direction and control of a superior officer of the assigning fire department, which superior officer shall be, during such temporary assignment, under the direction and control of the requesting fire chief. 3. During the time that firemen of one of the par- ties hereto are assigned to temporary duty within the juris- diction of the other party hereto, in accordance with the provisions hereof and the statutes of the State of Colorado, any liability which accrues under the provisons of article 10 of title 24, C.R.S. 1973, as amended, on account of the negligence or otherwise tortious act of any of such firemen while performing such duty, shall be imposed upon the request- ing party and not upon the assigning party. 4. The liability for any loss or damage to any equip- ment assigned under the provisions of this agreement shall be that of the assigning party. 5. The term of this agreement shall be for one (1) year from the date hereof, and from year to year thereafter until revoked in writing by either of the parties hereto. It is agreed that such revocation, if mailed by certified mail to the Town at P. O. Box 1200, Estes Park, CO 80517, and to ALLENSPARK FIRE PROTECTION DISTRICT the District at , % HAROLD BERGMAH P. O. This agreement hereby revokes any prior agree- ments between the parties hereto concerning mutual fire depart- ment assistance. -2- . 7. ESTES PARK FIRE DEPARTMENT (Volunteer) Estes Park, Colorado 80517 DATE: June 27, 1985 TO: Public Safety Committee Town of Estes Park SUBJECT: Fire Department Training Facility -PROPOSAL-' It is the concensus of the members of the Estes Park Volunteer Fire Department, that having a facility where potential fire and rescue situations can be staged would be of great benefit to the community. Such a facility would allow "hands on" practice to augment classroom instruction and would add to the readiness, efficiency, and safety of the Department in handling actual emergencies. The lack of such a facility has been cited in past inspections of fire protection in our community. The following is an outline of facilities which would be required, together with site facilities; FIRE TRAINING BUILDING: A one-story concrete building, 20 to 30 feet square, in which various fire situations could be simulated. Actual fires would be started and extinguished. TRAINING TOWER: Approximately 40 feet high, 12 to 15 feet square, with several platforms to simulate floors of a structure. To be used for ladder drills and practice of rescue from structures. FLAMMABLE LIQUID PIT: A shallow sand-filled pit, 10 to 12 Feel-- in diameter in which fires would be started and extinguished to simulate spilled flammable liquid situations FLAMMABLE LIQUID TANK TRUCKS: An old tank truck on and around which fires would be started and extinguished. LIQUID PROPANE GAS TANK TRUCKS: Same use as stated above for Flammable Liquid Tank Trucks. LIQUID PROPANE GAS STORAGE TANKS: Same as stated above. -PROPOSAL- Page 2 LIQUID PROPANE GAS FIRE TREE: An apparatus of piping approximately 6 feet high and 6 feet wide with which open Liquid Propane gas fires are simulated. AUTOMOBILES: One or two vehicles which fire fighting and rescue can be practiced. In considering necessary space for the above facilities, room must be allowed around each to manuever equipment and men. -SITE CONSIDERATIONS- WATER SUPPLY: A reasonalbe distance from nydrant. ACCESSABILITY: In any weather. DISTANCE FROM FIRE STATION: In case of a fire call, equipment left at the station can be activated in a reasonable amount of time. NEIGHBORS: Consider the impact of smoke, noise, danger, distraction, etc. STREAM CONTAMINATION: Can drainage of water used be controlled. From observation of training facilities of other departments, we feel that three or four acres would be adequate, although a larger area would be more desireable, considering future needs are difficult to identify. The cost of the physical items and improvements could be held to a minimum Dy using donated labor and materials. In closing, we urge your serious consideration to this matter.
