, ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 7 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO, THE SAME PERTAINING TO ANIMALS BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: Section 1. That Section 7.12.040 of the Municipal Code of the Town of Estes Park, Colorado, shall be amended to read as follows: 7.12.040 Dogs running at large prohibited. A. Every person owning or having charge, care, custody or control of any dog shall keep the dog exclusively upon his own premises except that the dog may be off said premises if it is under the effective control of a person. The dog shall be construed to be under the effective control of a person as follows: 1. Confinement within a vehicle, fencing, or other adequate enclosure where the dog has no access to passers-by, or 2. Attachment to a leash not over six feet in length and held by a person of sufficient size and strength to restrain the dog. B. Notwithstanding the provisions of Subsection A of this Section, a dog shall be deemed to be not under effective control of a person as follows: 1. Every female dog in pre-estrus, estrus, or post-estrus (in heat or in season} shall be confined in a building or secure enclosure in such a manner that the female dog cannot come into contact with another male dog except for planned breeding; or 2. The dog inflicts damage or injury to the person or property of someone other than its owner, custodian or possessor; or 3. A dog is tethered on the premises of its owner, custodian or possessor such that it has access to passers-by on a public street, sidewalk or right-of-way. I ./4 C. Nothing herein shall restrict the ordinary uses of seeing eye dogs. Section 2. That Section 7 of the Municipal Code of the Town of Estes Park, Colorado, shall be amended by the addition of Section 17.12.110 to read as follows: 17.12.110 Dog waste removal. The owner, custodian or possessor of any dog shall be responsible for removal of any
0 9 feces deposited by said dog on public sidewalks, rights of way, streets, parks, or recreation areas. Said person shall immedi- ately remove and sanitarily dispose of said feces. Also, the owner, custodian or possessor shall be responsible for the removal of any feces deposited by his dog on any private property not owned, controlled or possessed by said person. Said person shall immediately remove and sanitarily dispose of said feces. Section 3. The Board of Trustees of the Town of Estes Park, Colorado, herewith finds, determines and designates that this Ordinance is necessary for their immediate preservation of the public peace, health and safety, in order to provide for ' uniform animal control; and whereas, in the opinion of the Board of Trustees, an emergency exists, this Ordinance shall take effect and be in force immediately after its passage, adoption and signature of the Mayor. + 8: The Estes Park Police Officers Association in cooperation with the Estes Park Volunteer Fire Department, The Kiwanis Club , The Cable Systems Inc. and the Park School District. Have put together a program to Video tape and finger print the children of the Estes Park school district area in conjunction with the Colorado crime stoppers program. The Program is to be titled Operation Ident-A-Care. The purpose of the program is to Video tape and finger print all the children in the area, in case they become missing or lost. This will include children between the ages of 1 yr to 18years of age. Police departments across the nation are experiencing problems in different areas and age groups as far as missing or lost children. these are some of the areas . 1. 14 to 18 years of age runaways both Male and Female. 2. 2 to 14 years of age Parental kidnapping. 3. 14 to 18 years of age Females , Kidnapping for prostitation , sexual assaults, Homicide. 4. all ages becoming lost while on outings with their families. HOW the program will be operated: We are sending out a letter explaining the program along with a permission form and an information for requesting a detailed description of each child. This is being mailed to each family in the school district. The program will include Video taping the children as a detailed description and other pertinent facts about the child are narrated onto the tape. Each child will be filmed individually and then together with the family.
, Finger Print tables will be also set up so that those children and other family menbers who have not been finger printed in one of our other past programs, Maybe printed at this time . The finger print cards can be retained by the family or given to the school district to be put in the childs school records. The Master tapes will be kept by the school district. Release of the childs or family section on a master tape will only be given. Upon request by the parent or legal guardian' by a written letter to the Estes Park Police Department, or by the Parent or Legal guardian permission to another Police Department. For those families wishing to use a personal tape, a second camera will be used for simultaneous video taping. A receipt will be given to the parent or legal guardian, showing on which tape and at what sequence on the tape the family appeared on the tape. Also the family name and the date of the taping will be permanently ~ labelled on the tapes. As the cameras being used cam be programed to show the names and dates. TIMES , Dates and Locations, The dates, times, and locations are as followes: SAT and SUN. May 1land 12, and May 18th and 19th, form 9200 am to 5:00 pm at the Fire House. Mon to Fri. May 13th to 17 th from 6:00 pm to 9:00 PM at the school. During the weekend taping at the fire house. Tours will be offered of the Fire station and the Fire equipment. A Police squad car will also be available along with tours threw the Police Department.
4 Groups Involved and how. Police department and Town , Provide man power for paperwork, finger printing and tours. VCR Tapes and one recorder. Kiwanis Culb Providing man power for paper work, mailing out the forms to the parents. paying for the postage. Fire Department. Providing camers , man to operate the camera , manpower for the tours of the fire department and equipment. Park School District, Providing students to run cameras, Cameras and recorders, the Storage of the tapes,roomes to do the recording and finger Printing, The school district has also provided us with a mailing list of all the students in the school district and provides us with the use of their bulk mailing permit. Cable systems Inc. providing cameras and recorders , and manpower to operate the equipement. We hope that this will be an on going program. to be done each school year.

Third choices Starting in front of library; proceeding around Bond Park via Park Lane to MacGregor Avenue;,out MacGregor Avenue to Devll' s Gulch ' Road; east on Devil's.Gulch Road to Black / Canyon Drive;.down Black Canyon Drive and Steamer' Drive to Elkhorn; Elkhorn west back to library (approx, 60 minutes).
