Staff has researched grinding and burning the infested trees. The process of grinding, hauling and disposing of the tree material after grinding will soon become cost prohibitive. Staff has discussed this with Light and Power because that department generates an enormous amount of tree slash and removed trees in their trimming program to protect the power lines. Staff has also discussed this with the Fire Department as relates to their mitigation program and the Town's Christmas tee disposal. Staff has looked at the purchase of an Air Curtain Burner for disposal of the Beetle trees and slash generated within the Estes Valley by Town departments and citizens. This burner meets all EPA regulations, and it is the approved bid winner by the Federal Government GSA program. The Town can purchase an Air Burner and receive the Federal GSA bid pricing. This would be a joint purchase between Public Works and Light and Power. Staff feels that the Air Curtain would pay for itself within the first two to three years. We would like to purchase this Air Curtain Burner and set it up on the Town's dump site located on Elin Road. Cost/Budget: Cost: • Air Bumers LLC. Director of Public Works SUBJECT: Mountain Pine Beetle Management Ordinance Background: The Mountain Pine Beetle is beginning its proliferation in the Estes Park valley and its immediate adiacent forests. The Town is in a position to decide to actively manage this infestation through education, identification and enforcement. Estimates are that most of all Lodge pole pines will be lost and up to 60% of Ponderosa pines will be lost without active mitigation. The Public Works Dept. is recommending the adoption of an ordinance which requires removal and elimination of infested trees on privately-owned properties. Action: Staff seeks authorization of an ordinance regulating the management of the Mountain Pine Beetle on privately-owned properties. This ordinance is similar to the current State and County regulations. Both the State and Larimer County regulations are enforceable within the Town limits; however the resources from these agencies are currently stressed. After adoption of this ordinance, the community may call the Public Works Dept. for education and identification of infected trees. This ordinance can be enforced through the municipal court and if required as a referral to Larimer County Forester office. The Town currently is training three employees and three members of the Tree board to investigate and do beetle identification. This training will be provided by U.S. Forest Service area foresters. At this time there will be no budget impacts for this service. 2.

AN ORDINANCE DECLARING THE FAILURE TO MITIGATE THE INFESTATION OF THE MOUTAIN PINE BEETLE, SPRUCE IPS AND DOUGLAS FIR BEETLE WITHIN THE TOWN OF ESTES PARK AS A NUISANCE AND PROVIDING FOR THE ABATEMENT OF SAID NUISANCE WHEREAS, Section 31-15-401 (1)(C) C.R.S. provides that the Town ofEstes Park may declare what is a nuisance, abate the same, and impose fines upon parties who may create such nuisance or fail to abate such nuisance; and WHEREAS, the infestation of the mountain pine beetle, spruce ips and douglas fir beetle have reached epidemic proportions in the forested area of Colorado including, but not limited to, areas surrounding the Town of Estes Park; and WHEREAS, mitigation of beetle infestation will prevent the spread of beetle infestation throughout the Town of Estes Park; and WHEREAS, without a managed mitigation program, beetle infestation is estimated to destroy 100% o f infested lodge pole pine and up to 60% of infested ponderosa pine; and WHEREAS, areas which contain dead trees due to beetle infestation are a prime source of fuel for wild fire which may endanger property within and without the Town of Estes Park; and WHEREAS, the Town of Estes Park has the ability to identify beetle infected trees and provide equipment and services to mitigate beetle infestation, and WHEREAS, the Board of Trustees of the Town of Estes Park through the provisions of this Ordinance, declares beetle infestation from the mountain pine beetle, spruce ips and/or douglas fir beetle as a nuisance within the Town of Estes Park, establishes a program for inspection and mitigation thereof. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO. Section 1: The Municipal Code of the Town of Estes Park shall be amended by the addition of Section 8.04.100 as follows: 8.04.100 Beetle Infestation a. It is unlawful for the owner of any lot, block, or parcel land within the Town, or any occupant of such property or agent in charge of such property, to fail to mitigate infestation of the mountain pine beetle, spruce ips and/or douglas fir beetle following identification of said infestation as provided in this Section. b. The Town of Estes Park's Public Works Director is hereby designated as the administrator of the beetle infestation program. 1
Draft No. 1, 2/29/08 c. The Public Works Director, or his authorized agent, shall inspect any property for suspected infestation if at least one o f the following has occurred: 1). The landowner or occupant has requested an inspection; 2). A neighboring landowner or occupant has reported a suspected beetle infestation and requested an inspection; or 3). The Public Works Director, or his authorized agent(s), has made a visual observation from a public right-of-way or area and has reason to believe that a beetle infestation exists. d. Upon the occurrence of one of the events described in Paragraph c 1 -3 above, the Public Works Director shall: 1). Give written notice of the suspected infestation by first class mail to landowners or occupants of the subject property; and 2). Conduct inspection of the subject property ten (10) days after the notices are mailed. e. The Public Works Director is authorized to give written notice by first class mail to the landowner or occupant of the findings of the inspection and to advise the landowner or occupant of methods which can be used to control and mitigate mountain pine beetle, spruce ips, and douglas fir beetle infestation. The written notice shall also: 1). Include a deadline for completion of control and/or mitigation work; 2). Require the landowner or occupant to acknowledge the terms ofthe notification and submit an acceptable plan and schedule for completion o f control work and/or mitigation within ten (10) days after receiving the notification; and 3). Inform the landowner or occupant of his/her right to request a hearing before the Board of Trustees within ten (10) days of the receipt of the notice to dispute the finding of infestation. The landowner or occupant need not take any action to control infestation pending the outcome o f the hearing. f When necessary to enforce the provisions of this Section, the Public Works Director, after giving notice to the landowner or occupant pursuant to Paragraph d and e above, shall cause control and/or mitigation action to be taken. Control an(For mitigation measures shall not, however, be commenced pending outcome of any hearing before the Board of Trustees requested pursuant to Paragraph e above. g. Upon completion of enforcement, a written request for payment shall be submitted to the landowner at the last known address for the amount of the Town's direct costs and expenses only. The amount requested cannot exceed five thousand dollars ($5,000.00) annually. The written request shall inform the landowner of the right to appear before the Board of Trustees at any meeting thereof, as fixed by law, to be held within the following four months, and be heard as to the amount of such claim. 2

If the Board o f Trustees finds that a beetle infestation is a result of, or can be attributed to, an infestation on land owned by any federal, state, county or local government unit that has not been treated, is not under control, or has not been mitigated, the landowner shall not be charged for any relief ordered pursuant to this Section. i. It shall be a violation of the Municipal Code for any person an(For entity to fail to abide by any order for control and/or mitigation from the Public Works Director or fail to pay any amount due pursuant to Paragraph g o f this Section. WHEREAS, there is an immediate threat of beetle infestation within the Town of Estes Park that needs to be abated immediately and therefore an emergency exists, this Ordinance shall take effect and be enforced immediately after its passage, adoption and signature of the Mayor. Specifically, this is \ Lodge Travel ~ Lot 13 of the Schroeder \ N Subdivision, and is located on the ~ c-x- zal \ . ...4 east side of Grand Estates Drive. - 1 -1 ' This development plan contemplates the development of ««4 4/m thirteen residential units on a 1.88 acre parcel zoned "A" -Nk Accommodations. A condition of approval was to dedicate appropriate "half' right-of-way. The Public Works Director requested this condition. The right-of-way requirements for Grand Estates Drive call for 22.5 feet from the centerline of the road, for a total width of 45-feet. Grand Estates currently has a right-of-way width of 30-feet (15-feet from centerline). Therefore, an additional 7.5-feet of right-of-way dedication is required. In order to complete dedication by the property owner/developer, the Town Board must formally accept the right-of-way. Therefore, Staff presents this dedication proposal for review by the Public Works Committee. This item will be heard by the full Board at the March 25 hearing. Budget. NA Action. Staff recommends the Public Works Committee forward this item to the Town Board with a recommendation of approval.

Director of Public Works SUBJECT: Developer obligation cash in-lieu of improvements Background: The current development code requires that numerous publicly owned improvements such as roads and drainages are required to be improved or replaced adiacent to and through proposed developments. Frequently these improvements fall in areas that are currently developed. Often infill developments are constructed within these already improved areas and it is detrimental to have patch guilt sections of public improvements. Construction of code required improvements sometimes leads to curb and sidewalk for only a few hundred feet leading to nowhere, roadway widths varying in and out and sections of pavement depth being removed for only a few hundred feet to meet standards when the adiacent pavement is old and thin . These are only a few instances. However, they are examples that create numerous problems. As a policy, the Public Works Dept. would evaluate each circumstance and decide if the Town of Estes Park would benefit more from constructing the improvements or accepting cash in lieu of these required improvements. These funds would be utilized for future improvements as these areas would be reconstructed or improved. Therefore the entire segments would be engineered together assuring proper location and function. Action: Staff seeks authorization to exercise the policy of cash in lieu of improvements to provide ' consistency of development costs and reserve funds for future cohesive improvements when it's in the best interest of the Town of Estes Park. 5.
Memo Date: February 11, 2008 TO: Scott Zurn, Public Works Director From: Gregory A. White Re: Public Improvements, Cash in Lieu Scott: You requested that I review the Estes Valley Development Code with regard to the process necessary to allow you, in your capacity as Public Works Director, to accept cash in lieu of the developer's required installation of a public improvement pursuant to an approved Development Plan or Subdivision Plat. For example, a developer is required to put in road improvements to serve his development. The road improvements are of a nature that the Town will, in the foreseeable future, reconfigure or repave the road surface thereby rendering the developer's improvements meaningless. In this specific instance, may the Town accept the projected cost of developer's improvements in cash, and relieve the developer of any responsibility for the improvement. The cash will be used to defray a portion of the cost of the future improvement of the street. Estes Valley Development Code. The only applicable provision is found in Section 10.5 (K) on page 10-8 through 10-9 of the EVDC. Specifically Section 10.5 (K) (2) (b) provides that "a deposit of cash in an amount not less than the Staffs estimate of the cost of the completion of all required improvements." It is my opinion that there is no necessity to amend the Estes Valley Development Code to enable the Public Works Director to accept cash in lieu of a required public improvement. Policy. It is my opinion that a written policy should be developed outlining the parameters of a cash in lieu of program. Suggested topics which may be included are as follows: • Types of improvements in which cash in lieu would be accepted. For example, streets, curb and gutter, drainage improvements. • A dollar cap on the amount of cost of the improvement that is eligible for the cash in lieu of payment. • Identification at the time of accepting of cash in lieu for an improvement of a time frame in which the Town will construct the improvement. For example, cash in lieu will not be
accepted for any improvement that is not scheduled for construction within three (3) years of the date of payment of the cash in lieu. • In order to assure the public that the cash in lieu payment is not just being lost in the General Fund, accounting of the cash in lieu needs to occur reserving the cash for the specified public improvement and use of the cash for the specified public improvement. It is my opinion that after the development of the written policy, this should be reviewed by the Public Works Committee and approved by the Town Board. This is a PROPOSED list. We are willing to change it to accommodate your capital or maintenance projects. Please take this opportunity to inform the Public Works Department of your upcoming and future plans. Whether you have capital or maintenance infrastructure plans or not, it is imperative that you reply to the Public Works Department in writing at your earliest convenience. As is stated on the attached spreadsheet, the cost of Right-of-Way work will increase substantially after street repaving. The Town of Estes Park would much prefer to work closely with utility companies to avoid damage to new street and/or partner on paving projects.
